    PEMBINAAN NARAPIDANA YANG MENGALAMI GANGGUAN JIWADI LEMBAGA PEMASYARAKATAN Agusriadi Dahlan Ali Suhaimi ABSTRAKLembaga Pemasyarakatan sebelumnya disebut Penjara adalah tempat orang-orang yang melakukan kriminalitas dan pelanggaran hukum lainnya agar mereka dapat menyadari kesalahannya dan mempertanggungjawabkan apa yang telah mereka perbuat. Hukuman yang mereka terima sebagai balasan yang setimpal terhadap perbuatan mereka, meskipun nilai-nilai kemanusiaan beserta hak asasinya kurang diperhatikan. Lembaga Pemasyarakatan merupakan tempat yang stressfull atau menekan yang dapat berpengaruh terhadap fisik dan kejiwaan (psikologi) seseorang ditambah kecemasan yang berlebihan sehingga muncul depresi yang mengakibatkan seseorang melakukan bunuh diri. Akibat stress melahirkan depresi dan depresi biasanya akan terjadi kegoncangan kejiwaan yang luar biasa yang dapat mengakibatkan seseorang menjadi tidak waras (gila). Undang-Undang No.12/1995 tentang Lembaga Pemasyarakatan maupun Peraturan Pemerintah No. 99 Tahun 2012 tentang Perubahan Kedua Atas Peraturan Pemerintah Nomor 32 Tahun 1999 tentang Syarat dan Tata Cara Pelaksanaan Hak Warga Binaan Pemasyarakatan tidak menjelaskan ketentuan terhadap narapidana yang gila di dalam lapas sebagaimana yang pernah terjadi di Lapas Kelas II-A Lambaro, Aceh Besar dan Rutan Klas I Tanjung Gusta, Medan. Selanjutnya yang bersangkutan dikirim ke Lapas Kelas Klass II-B Meulaboh tanggal 27 Januari 2014. Selama tujuh hari di Lapas Klass II-B Meulaboh Zabir bin Ilyas kemudian di titipkan di Rumah Sakit Jiwa Banda Aceh karena penyakitnya sudah mencapai stadium empat untuk mendapatkan perawatan dan penyembuhan kejiwaannya. Bagaimanakah pengaturan dan pembinaan terhadap narapidana yang mengalami gangguan kejiwaan dalam Lembaga Pemasyarakatan. Kemudian bagaimanakah kepastian hukum bagi narapidana yang sedang mengalami gangguan kejiwaan, dan bagaimana status hukum bagi narapidana yang sembuh dari gangguan kejiwaan. Penelitian dan pengkajian ini bertujuan untuk mengetahui pengaturan dan pembinaan terhadap narapidana yang mengalami gangguan kejiwaan dalam Lapas dan mengidentifikasi kepastian hukum bagi narapidana yang sedang mengalami gangguan kejiwaan serta mengetahui status hukum bagi narapidana yang sembuh dari gangguan kejiwaan.Metode yang digunakan adalah metode penelitian yuridis-normatif dengan menggunakan jenis penelitian deskriptis analisis dalam rangka untuk menemukan aturan hukum, prinsip-prinsip hukum, norma maupun doktrin-doktrin hukum dengan pendekatan undang-undang, kasus. Sumber data adalah data sekunder berupa bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier.Hasil penelitian menunjukkan bahwa Pengaturan tentang perawatan narapidana yang mengalami gangguan kejiwaan dalam Lembaga Pemasyarakatan di Indonesia belum diatur, baik dalam Undang-Undang Nomor 12 Tahun 1995 tentang Lembaga Pemasyarakatan maupun PP No. 99 Tahun 2012 tentang PP No. 99 Tahun 2012 tentang Perubahan Kedua Atas PP No.32 Tahun 1999 tentang Syarat dan Tata Cara Pelaksanaan Hak Warga Binaan Pemasyarakatan. Namun bila narapidana sakit atau gangguan kesehatan lainnya yang tidak termasuk gangguan kejiwaan ada aturan tentang perawatan medis. Adapun mengenai narapidana yang mengalami gangguan kejiwaan di Lembaga Pemasyarakatan di Indonesia hingga kini belum ada kepastian hukum karena kasus seperti ini sangat langka terjadi di Indonesia. Pihak otoritas hanya menggunakan hak diskresi yang dimilikinya untuk menyelesaikan kasus tersebut sebagaimana terjadi di Lapas Porong Surabaya. Tetapi di Aceh kasus ini baru pertama kali terjadi yang dialami Zabir bin Ilyas pada tahun 2014. Pimpinan Lapas memutuskan memasukkan Zabir bin Ilyas ke Rumah Sakit Jiwa Banda Aceh. Terkait status hukum narapidana yang sembuh dari gangguan kejiwaan masih tetap sebagai tersangka (ditahan). Tidak ada keringanan hukuman apalagi sampai dibebaskan sebelum masa hukuman habis dijalankan. Hingga kini tidak ada satupun aturan yang mengatur baik secara implisit maupun ekplisit yang mengatur tentang narapidana yang sembuh dari penyakit kejiwaan (gila).Disarankan kepada Pemerintah agar merevisi Undang-Undang Nomor 12 Tahun 1995 tentang Lembaga Pemasyarakatan dan memasukkan salah satu pasal yang mengatur mengenai narapidana yang mengalami gangguan kejiwaan di dalam Lembaga Pemasyarakatan. Agar terwujudnya kepastian hukum di Indonesia mengenai narapidana yang mengalami gangguan kejiwaan dalam lebaga pemasyarakatan untuk membuat regulasi legal baik berupa undang-undang khusus atau melalui Peraturan Pemerintah. Kemudian disarankan agar narapidana yang mengalami gangguan kejiwaan dalam Lembaga Pemasyarakatan dapat dibebaskan dan dikembalikan ke keluarganya atau dimasukkan ke rumah sakit jiwa hingga sembuh.Kata Kunci : Pembinaan, Narapidana, Gangguan Jiwa, Lembaga Pemasyarakatan.Banda Ace

    Sea breezes drive currents on the inner continental shelf off southwest Western Australia

    In southwest Western Australia, strong and persistent sea breezes are common between September and February. We hypothesized that on the inner continental shelf, in the absence of tidal forcing, the depth, magnitude, and lag times of the current speed and direction responses to sea breezes would vary though the water column as a function of the sea breeze intensity. To test this hypothesis, field data were used from four sites were that were in water depths of up to 13 m. Sites were located on the inner continental shelf and were on the open coast and in a semi-enclosed coastal embayment. The dominant spectral peak in currents at all sites indicated that the majority of the spectral energy contained in the currents was due to forcing by sea breezes. Currents were aligned with the local orientation of the shoreline. On a daily basis, the sea breezes resulted in increased current speeds and also changed the current directions through the water column. The correlation between wind–current speeds and directions with depth, and the lag time between the onset of the sea breeze and the response of currents, were dependent on the intensity of the sea breezes. A higher correlation between wind and current speeds occurred during strong sea breezes and was associated with shorter lag times for the response of the bottom currents. The lag times were validated with estimates of the vertical eddy viscosity. Solar heating caused the water column to stratify in summer and the sea breezes overcame this stratification. Sea breezes caused the mixed layer to deepen and the intensity of the stratification was correlated to the strength of the sea breezes. Weak sea breezes of <5 m?s?1 were associated with the strongest thermal stratification of the water column, up to 1°C between the surface and bottom layers (6 and 10 m below the surface). In comparison, strong sea breezes of >14 m?s?1 caused only slight thermal stratification up to 0.5°C. Apart from these effects on the vertical structure of water column, the sea breezes also influenced transport and mixing in the horizontal dimension. The sea breezes in southwest Western Australia rotated in an anticlockwise direction each day and this rotation was translated into the currents. This current rotation was more prominent in surface currents and in the coastal embayment compared to the open coast

    Genome-wide associations of human gut microbiome variation and implications for causal inference analyses

    Recent population-based1-4 and clinical studies5 have identified a range of factors associated with human gut microbiome variation. Murine quantitative trait loci6, human twin studies7 and microbiome genome-wide association studies1,3,8-12 have provided evidence for genetic contributions to microbiome composition. Despite this, there is still poor overlap in genetic association across human studies. Using appropriate taxon-specific models, along with support from independent cohorts, we show an association between human host genotype and gut microbiome variation. We also suggest that interpretation of applied analyses using genetic associations is complicated by the probable overlap between genetic contributions and heritable components of host environment. Using faecal 16S ribosomal RNA gene sequences and host genotype data from the Flemish Gut Flora Project (n = 2,223) and two German cohorts (FoCus, n = 950; PopGen, n = 717), we identify genetic associations involving multiple microbial traits. Two of these associations achieved a study-level threshold of P = 1.57 × 10-10; an association between Ruminococcus and rs150018970 near RAPGEF1 on chromosome 9, and between Coprococcus and rs561177583 within LINC01787 on chromosome 1. Exploratory analyses were undertaken using 11 other genome-wide associations with strong evidence for association (P < 2.5 × 10-8) and a previously reported signal of association between rs4988235 (MCM6/LCT) and Bifidobacterium. Across these 14 single-nucleotide polymorphisms there was evidence of signal overlap with other genome-wide association studies, including those for age at menarche and cardiometabolic traits. Mendelian randomization analysis was able to estimate associations between microbial traits and disease (including Bifidobacterium and body composition); however, in the absence of clear microbiome-driven effects, caution is needed in interpretation. Overall, this work marks a growing catalogue of genetic associations that will provide insight into the contribution of host genotype to gut microbiome. Despite this, the uncertain origin of association signals will likely complicate future work looking to dissect function or use associations for causal inference analysis.status: publishe

    Short-term and seasonal variation in metabolic balance in Liverpool Bay

    Regions of freshwater influence (ROFIs) are dynamic areas within the coastal seas that experience cycles of stability driven by density gradients and the spring-neap tidal cycle. As a result, pulses of biological production may occur on a more frequent timescale than the classic seasonal cycle. Net community production (NCP) rates and chlorophyll a concentration are presented from a site within the ROFI of Liverpool Bay and compared to similar measurements made at a site outside the ROFI during 2009. The influence of water column stability on biological production in the ROFI was also investigated using high-frequency observations from a Cefas Smartbuoy. Both sites were autotrophic from spring to autumn before becoming heterotrophic over winter. NCP at the inshore site was estimated to range from 30.8 to 50.4 gC m(-2) year(-1). A linear relationship detected between chlorophyll a and NCP from both sites was used to estimate metabolic balance over 1 year at the ROFI site using high-resolution chlorophyll a concentrations from the Smartbuoy but was found to poorly replicate NCP rates compared to those derived from dissolved oxygen fluxes. There was no clear biological response to periods of stratification within the ROFI, and it is proposed that changes in light attenuation in the Liverpool Bay ROFI, driven not only by stratification but also by fluctuations in riverine sediment load, most likely play an important role in controlling phytoplankton growth in this region

    Influence of sea surface wind wave turbulence upon wind-induced circulation, tide–surge interaction and bed stress

    A three-dimensional finite volume unstructured mesh model of the west coast of Britain, with high resolution in the coastal regions, is used to investigate the role of wind wave turbulence and wind and tide forced currents in producing maximum bed stress in the eastern Irish Sea. The spatial distribution of the maximum bed stress, which is important in sediment transport problems, is determined, together with how it is modified by the direction of wind forced currents, tide–surge interaction and a surface source of wind wave turbulence associated with wave breaking. Initial calculations show that to first order the distribution of maximum bed stress is determined by the tide. However, since maximum sediment transport occurs at times of episodic events, such as storm surges, their effects upon maximum bed stresses are examined for the case of strong northerly, southerly and westerly wind forcing. Calculations show that due to tide–surge interaction both the tidal distribution and the surge are modified by non-linear effects. Consequently, the magnitude and spatial distribution of maximum bed stress during major wind events depends upon wind direction. In addition calculations show that a surface source of turbulence due to wind wave breaking in shallow water can influence the maximum bed stress. In turn, this influences the wind forced flow and hence the movement of suspended sediment. Calculations of the spatial variability of maximum bed stress indicate the level of measurements required for model validation
