La libĂ©ralisation des tĂ©lĂ©communications au Maroc est intimement mĂȘlĂ©e Ă la succession dynastique, d'une part par sa chronologie, d'autre part parce qu'elle rĂ©vĂšle les modalitĂ©s d'une transition politique voulue d'en haut et consensuelle. La victoire de la « transparence » que reprĂ©sente son relatif bon dĂ©roulement et la conformitĂ© aux normes internationales de la lĂ©gislation qui l'accompagne ne peuvent toutefois cacher la persistance de modes de fonctionnement hĂ©ritĂ©s de la pĂ©riode antĂ©rieure, avec l'Ă©crasante prĂ©dominance du Palais, l'amĂ©nagement, en partie dĂ©libĂ©rĂ©, de vides juridiques et d'interstices administratifs autorisant l'intervention de l'arbitraire, la persistance du secret et des relations non formelles qui sont au cĆur mĂȘme du Makhzen. The liberalization of telecommunications in Morocco] The liberalization of telecommunications in Morocco is closely linked to the royal succession, partly for chronological reasons, and partly because it reveals the workings of a political transition that was desired at the top and received a large consensus. The triumph of "transparency" evident in the relative success of the process and the consistency of the accompanying legislation with international norms cannot, however, conceal the persistence of ways of working inherited from the previous era, with the overwhelming predominance of royal power, the partly deliberate creation of legal and administrative loopholes making way for arbitrary intervention, the continuation of secrecy and informal relations that are at the very heart of the Makhzen. The result is a sometimes paradoxical interplay of tensions in which actors end up in spite of themselves playing the opposite role from what could have reasonably been expected
Une lecture weÌbeÌrienne de la trajectoire de lâEtat au Maroc
Cet article reconsideÌre les façons de gouverner au Maroc aÌ partir de lâencheveÌtrement de deux figures du politique, la figure nationale et la figure impeÌriale, en les consideÌrant comme des ideÌaltypes aÌ partir desquels analyser la situation contemporaine. A lâencontre dâune perspective dualiste, opposant tradition et moderniteÌ, bureaucratie et makhzen, nous avons pris au seÌrieux ce qui est souvent preÌsenteÌ comme du folklore politique ou des reÌminiscences dâune reÌsistance aÌ un Etat centraliseÌ, en le consideÌrant comme des expressions dâimaginaires mais aussi de pratiques partageÌs. La convocation du registre impeÌrial aÌ coÌteÌ de celui de la nation proceÌde dâune lecture des modes de gouvernement renouveleÌe par lâusage des cateÌgories weÌbeÌriennes, qui met en exergue la diversiteÌ de « traits » theÌoriquement preÌsenteÌs comme contraires, voire incompatibles, mais qui sont, dans la reÌaliteÌ, des expeÌriences empiriques se combinant, sâassemblant, se soutenant parfois, et contribuant aÌ former un large eÌventail de modes de gouvernement. En cherchant aÌ deÌcrire le plus finement possible les formes que prend la performance de lâEtat et les façons de concevoir la responsabiliteÌ, nous avons essayeÌ de montrer que les reÌpertoires de repreÌsentation, de mise en sceÌne, dâaction, de rationaliteÌ, de compreÌhension sont non seulement pluriels, mais quâils peuvent se reÌfeÌrer aÌ un temps extreÌmement long

By bringing a major innovation - the representation of employers in Parliament - the Constitution of Morocco, adopted on November 25, 2011, highlighted the employer groups and the divisions that cross them. This article proposes to analyze the dynamics of employers' organizations and the roles played by these actors in the transformations of the kingdom's political economy. To account for these developments, we focused our analysis on the two most prominent employers' groups: the General Confederation of Moroccan Enterprises (CGEM) and Amal Enterprises. N° ISBN - 978-2-7380-1284-5International audienceMorocco has attempted from the 1990s onwards to move towards Participative Management of Irrigation (PMI), promoting the involvement and empowerment of users in water management. This policy shift has led to the introduction of an institutional innovation: the Water Users Associations (WUA). This innovation is important in both the organizational and social change of the local population. The aim of this paper is to analyze how an institutional innovation initiated by public policy, has created a new institutional order, new dimensions of local governance, access, and collective organization around a resource that is the irrigation water. The analysis is based on two irrigation schemes. First, the Moyen Sebou scheme was delivered to farmers at the end of the project implementation ants is currently managed by AUEAs. Nevertheless, farmers took over the management of the AUEA and the Moyen Sebou has become a school for learning the model of Participative Management of Irrigation for the different stakeholders (public institutions, farmers, financial backer, and research institutions) for the past 10 years. On the other hand, the recently launched Sahla irrigation scheme was built by the same team that worked on the Moyen Sebou scheme. Being an adaptation of the same model, the Sahla scheme shows appropriation of the PMI model by public institutions

Aspects du droit communautaire dans l'Atlas marocain
The aim of this paper is to present an anthropological approach of the relationship between social structures, rules of conduct and social regulation system, in order to show the composite nature of the Morrocan law System. The system elements are : "modern" law, muslim law and customs. The place of this later is inhibited in jurists' knowledge, then rural collectivities are still producing such a law. The Morrocan communities in Atlas mountain studied illustrate how this kind of law is elaborated. It is almost a survival requirement, this because communities produce, consolidate their identity and legitimate their rights. Therefore, social practices are usually different from the established rules.Cet article présente une approche anthropologique de l'articulation entre structures sociales, normes de conduite et mode de régulation sociale et met à jour la nature composite du systÚme juridique marocain. Celui-ci puise ses sources dans trois registres compétitifs : le droit "moderne" , le droit musulman et le droit coutumier. La place de ce dernier est inhibée dans le discours des juristes. Or, pendant longtemps encore, les collectivités rurales demeureront des lieux de production de ce droit non étatique. Les communautés montagnardes de l'Atlas marocain étudiées illustrent ce travail d'élaboration de ce type de droit. Pour ces communautés, c'est presque un impératif de survie car, corrélativement, elles produisent, consolident leur identité, légitiment leurs droits.
