    Copyright and Commerce: The DMCA, Trusted Systems, and the Stabilization of Distribution

    The Digital Millennium Copyright Act has been criticized for granting too much power to copyright holders, offering them new technological controls that may harm the public interest. But, by considering this exclusively as a copyright issue, we overlook how the DMCA anticipates a technological and commercial infrastructure for regulating not only copying, but every facet of the purchase and use of cultural goods. In upholding the law in Universal v. Reimerdes, the courts not only stabilized these market-friendly arrangements in cultural distribution; they extended these arrangements into realms as diverse as encryption research and journalism, with consequences for the very production of knowledge

    Engineering a Principle: 'End-to-End' in the Design of the Internet

    The term 'end-to-end' has become a familiar characterization of the architecture of the Internet, not only in engineering discourse, but in contexts as varied as political manifestos, commercial promotions, and legal arguments. Its ubiquity and opacity cloaks the complexity of the technology it describes, and stands in for a richer controversy about the details of network design. This essay considers the appearance, in the 1970s, of the term 'end-to-end' in computer science discourse, and how the term became a point of contention within disputes about how to build a packet-switched network. I argue that the resolution of some of those disputes depended on the transformation of the term from descriptor to 'principle'. This transformation attempted to close specific design debates, and, in the process, made the term dramatically more useful in those discourses beyond engineering that eventually took a keen interest in the design of digital communication networks. The term, drawn from common parlance and given not only meaning but conviction, was shaped and polished so as to be mobile. As such, it actively managed and aligned disparate structural agendas, and has had subtle consequences for how the Internet has been understood, sold, legislated, and even re-designed

    Rhythmedia: A Study of Facebook Immune System

    This paper examines the politics behind algorithmic ordering in social media, focusing on the advertising logic behind them. This is explored through a practice I call rhythmedia – the way media companies render people, objects and their relations as rhythms and (re)order them for economic purposes. As a case study I examine the way the Facebook Immune System algorithm orchestrates people’s mediated experience towards a desired rhythm (sociality) while filtering out problematic rhythms (spam). This anti-spam algorithm shows that it is important for Facebook to understand people as rhythms and assemble a dynamic database from their mediated experiences, to convince advertisers that they know when and where people do things. People’s rhythms become a product that advertisers pay and bid for through Ad Auction to intervene in specific moments and shape people’s experience. Thus, the company can shape, manage, and filter specific rhythms to order sociality that brings more value

    Bureaucracy as a Lens for Analyzing and Designing Algorithmic Systems

    Scholarship on algorithms has drawn on the analogy between algorithmic systems and bureaucracies to diagnose shortcomings in algorithmic decision-making. We extend the analogy further by drawing on Michel Crozier’s theory of bureaucratic organizations to analyze the relationship between algorithmic and human decision-making power. We present algorithms as analogous to impartial bureaucratic rules for controlling action, and argue that discretionary decision-making power in algorithmic systems accumulates at locations where uncertainty about the operation of algorithms persists. This key point of our essay connects with Alkhatib and Bernstein’s theory of ’street-level algorithms’, and highlights that the role of human discretion in algorithmic systems is to accommodate uncertain situations which inflexible algorithms cannot handle. We conclude by discussing how the analysis and design of algorithmic systems could seek to identify and cultivate important sources of uncertainty, to enable the human discretionary work that enhances systemic resilience in the face of algorithmic errors.Peer reviewe

    How Software Matters : Connective Tissue and Self-Driving Cars

    Drawing on the example of self-driving and connected cars, this chapter explores how the software that is being integrated into, and transforming, everyday objects might be conceptualised within theories of practice. It argues that although software is an especially dynamic and intangible ‘material’ it can still be accommodated within existing conceptualisations of materiality in practice theories. The automation that software enables can be positioned as part of practice complexes, even when it does not play a direct, constitutive role in any single practice. In addition, through performing varied work in connecting practices and enabling ‘feedback’ over time and space, software can be understood to form part of the connective tissue by which practice complexes hang together and change

    The Politics of 'Platforms'

    Online content providers such as YouTube are carefully positioning themselves to users, clients, advertisers, and policymakers, making strategic claims as to what they do and do not do, and how their place in the information landscape should be understood. One term in particular, 'platform,' reveals the contours of this discursive work. 'Platform' has been deployed in both their populist appeals and their marketing pitches - sometimes as technical platforms, sometimes as platforms from which to speak, sometimes as platforms of opportunity. Whatever tensions exist in serving all of these constituencies are carefully elided. The term also fits their efforts to shape information policy, where they seek protection for facilitating user expression, yet also seek limited liability for what those users say. As these providers become the curators of public discourse, we must examine the roles they aim to play, and the terms with which they hope to be judged.Institute for the Social Science
