See You Later, Aggregator: How Hot News Misappropriation Deters Aggregators Without Overprotecting Facts

As traditional media scramble to find ways to monetize online content, the ease of digital publishing and online dissemination of news have led to a rise of a new form of news media: News aggregators. News aggregators compile information from journalism websites by various means, often drawing potential readers away from traditional news outlets, thus siphoning off advertising revenue from traditional journalism outlets, with little to no cost to the aggregators. News establishments have sought legal redress by claiming copyright infringement and hot news misappropriation, a state unfair competition common law principle created in 1918. Hot news misappropriation prevents direct competitors from distributing a journalism organization’s time-sensitive news, or “hot news,” for a limited time. But questions have unsettled both aggregators and content creators: How long is hot news protected as “hot?” Does this timed injunction violate the First Amendment? This thesis argues that hot news misappropriation is necessary to protect hot news and that it can do so in a way that does not violate the First Amendment. The hot news doctrine protects a right similar to the right of first publication, but only between direct competitors. Though existing case law is limited, this thesis also reviews past hot news cases and proposes guidelines in deciding the duration of protection of hot news and how they can be uniformly applied through federalization of the doctrine. This study aims to determine the factors affecting the assimilation of noble values among students. The factors studied include the influence of parents, peer group, mass media, the influence of teacher as role model and the influence of teaching by the teacher. A questionnaire survey involving a sample of 341 Form Four students at all Government aided Secondary School in the Lower Perak District was administered. The results indicate that the influence of parents, the influence of teacher as role model and the influence of teaching by the teachers were positively and significantly associated with the assimilation of noble values among students. The findings also suggest that the influence of mass media was negatively and significantly related to the assimilation of noble values among students. It was found that there was no significant relationship between the influence of peers with assimilation of noble values among students. The findings also shows that there is a significant difference among various sexes, races and religious beliefs of the students with regards to the assimilation of noble values. However, there is no significant difference in the assimilation of noble values among students whose parents are different in terms of occupation, monthly income and level of education. The study shows that it is important to ensure that the implementation of noble values education carried across the curriculum, of a strictier school regulation system, of beneficial co-curriculum activities and the collaboration among the school, the family and the community be carried out more effectively

Design of ternary signals for MIMO identification in the presence of noise and nonlinear distortion

    Get PDF
A new approach to designing sets of ternary periodic signals with different periods for multi-input multi-output system identification is described. The signals are pseudo-random signals with uniform nonzero harmonics, generated from Galois field GF(q), where q is a prime or a power of a prime. The signals are designed to be uncorrelated, so that effects of different inputs can be easily decoupled. However, correlated harmonics can be included if necessary, for applications in the identification of ill-conditioned processes. A design table is given for q les 31. An example is presented for the design of five uncorrelated signals with a common period N = 168 . Three of these signals are applied to identify the transfer function matrix as well as the singular values of a simulated distillation column. Results obtained are compared with those achieved using two alternative methods

The purpose of this professional-paper is to develop a marketing plan for Hertz China. Hertz China is a car rental company which focused on business to business and business to customer market and only short-term rentals, of less than one year\u27s duration. Acquirers’ prior related knowledge and post-acquisition integration: Evidences from four Chinese firms

    Get PDF
Purpose – This paper examines the role of acquirers’ prior related knowledge in the post-acquisition integration process. The purpose of this paper is to identify what constitutes the key prior related knowledge that can contribute to the reverse knowledge transfer following Chinese firms’ outward mergers and acquisitions (M&As) to Europe, and explain how prior related knowledge affects such transfer of knowledge. Design/methodology/approach – The authors employ a multiple case study approach. Semi-structured interviews were conducted from February 2012 to June 2013 with 24 managers. Findings – The authors find that, in addition to knowledge about the target, prior international business experience, R&D capability, and industrial capabilities are key components of acquirers’ prior related knowledge that can contribute to the success of M&A integration and post-acquisition reverse knowledge transfer. Indeed, Chinese acquirers’ prior related knowledge can influence the reverse knowledge transfer from acquired firms to acquirers by directly improving acquirers’ absorptive capacity and building a harmonious organisational climate to facilitate such transfer. Originality/value – This paper contributes to the absorptive capacity and the cross-border M&A literature. It extends the current knowledge on the key components of an acquirer’s prior related knowledge in the outward M&A by Chinese firms. It also uncovers how post-acquisition reverse knowledge transfer is affected by acquirers’ prior related knowledge.
