    Group and Other Legal Services for the Middle Class

    The public interest is an oft-used elusive concept that often emerges from the adversarial system. This Comment analyzes whether economic barriers to using the adversary system make it difficult to link the public interest as the product of the adversarial system. This Comment address whether middle income people need more legal services than they are presently receiving because of the economics of the legal system. Present restrictions on group legal services, such as the ban on solicitation and advertising, increases the difficulty of obtaining legal services. Moreover, the high costs of legal services, and the ignorance of legal rights and remedies, play a role in the denying middle income people access to the legal system. The author concludes by suggesting the removal of the ban on solicitation and advertising, an expansion of the scope of legal services, and a system of peer review over group practitioners

    In Re Lynch and Beyond to Judicial Review of Sentences

    In in re Lynch, the defendant was sentenced to life in prison for second degree indecent exposure, a punishment the defendant argued was disproportionate to his crime under the California statute prohibiting cruel and unusual punishment. This Comment examines California remedies law with a focus on correcting excessive sentences. Furthermore, this Comment explores the function, procedures, and discretion of the Adult Authority, as well as the feasibility of establishing an abuse of discretion standard for reviewing sentences. In California, there is a well established policy of judicial abstention from reviewing sentences, and thus an appeal from the determination of the sentence by the Adult Authority is usually not reviewable because of the lack of a detailed record. However, other jurisdictions have statutes allowing for appellate review of sentences. Therefore, this Article concludes by recommending possible alternatives to California policy and California sentence review by evaluating the experience of other jurisdictions on sentence review

    LSMAC and LSNAIT: Two Approaches for Cluster-based Scalable Web Servers

    Server responsiveness and scalability are more important than ever in todayā€™s client/server dominated network environments. Recently, researchers have begun to consider cluster-based computers using commodity hardware as an alternative to expensive specialized hardware for building scalable Web servers. In this paper, we present performance results comparing two cluster-based Web servers based on different server infrastructures: MAC-based dispatching (LSMAC) and IP-based dispatching (LSNAT). Both cluster-based server systems were implemented as application-space programs running on commodity hardware. We point out the advantages and disadvantages of both systems. We also identify when servers should be clustered and when clustering will not improve performance

    Ionizing Radiation and Chronic Lymphocytic Leukemia

    The U.S. government recently implemented rules for awarding compensation to individuals with cancer who were exposed to ionizing radiation while working in the nuclear weapons complex. Under these rules, chronic lymphocytic leukemia (CLL) is considered to be a nonradiogenic form of cancer. In other words, workers who develop CLL automatically have their compensation claim rejected because the compensation rules hold that the risk of radiation-induced CLL is zero. In this article we review molecular, clinical, and epidemiologic evidence regarding the radiogenicity of CLL. We note that current understanding of radiation-induced tumorigenesis and the etiology of lymphatic neoplasia provides a strong mechanistic basis for expecting that ionizing radiation exposure increases CLL risk. The clinical characteristics of CLL, including prolonged latency and morbidity periods and a low case fatality rate, make it relatively difficult to evaluate associations between ionizing radiation and CLL risk via epidemiologic methods. The epidemiologic evidence of association between external exposure to ionizing radiation and CLL is weak. However, epidemiologic findings are consistent with a hypothesis of elevated CLL mortality risk after a latency and morbidity period that spans several decades. Our findings in this review suggest that there is not a persuasive basis for the conclusion that CLL is a nonradiogenic form of cancer

    Testing implementation facilitation of a primary care-based collaborative care clinical program using a hybrid type III interrupted time series design: a study protocol

    Abstract Background Dissemination of evidence-based practices that can reduce morbidity and mortality is important to combat the growing opioid overdose crisis in the USA. Research and expert consensus support reducing high-dose opioid therapy, avoiding risky opioid-benzodiazepine combination therapy, and promoting multi-modal, collaborative models of pain care. Collaborative care interventions that support primary care providers have been effective in medication tapering. We developed a patient-centered Primary Care-Integrated Pain Support (PIPS) collaborative care clinical program based on effective components of previous collaborative care interventions. Implementation facilitation, a multi-faceted and dynamic strategy involving the provision of interactive problem-solving and support during implementation of a new program, is used to support key organizational staff throughout PIPS implementation. The primary aim of this study is to evaluate the effectiveness of the implementation facilitation strategy for implementing and sustaining PIPS in the Veterans Health Administration (VHA). The secondary aim is to examine the effect of the program on key patient-level clinical outcomesā€”transitioning to safer regimens and enhancing access to complementary and integrative health treatments. The tertiary aim is to determine the categorical costs and ultimate budget impact of PIPS implementation. Methods This multi-site study employs an interrupted time series, hybrid type III design to evaluate the effectiveness of implementation facilitation for a collaborative care clinical programā€”PIPSā€”in primary care clinics in three geographically diverse VHA health care systems (sites). Participants include pharmacists and allied staff involved in the delivery of clinical pain management services as well as patients. Eligible patients are prescribed either an outpatient opioid prescription greater than or equal to 90Ā mg morphine equivalent daily dose or a combination opioid-benzodiazepine regimen. They must also have an upcoming appointment in primary care. The Consolidated Framework for Implementation Research will guide the mixed methods work across the formative evaluation phases and informs the selection of activities included in implementation facilitation. The RE-AIM framework will be used to assess Reach, Effectiveness, Adoption, Implementation, and Maintenance of PIPS. Discussion This implementation study will provide important insight into the effectiveness of implementation facilitation to enhance uptake of a collaborative care program in primary care, which targets unsafe opioid prescribing practices.https://deepblue.lib.umich.edu/bitstream/2027.42/146542/1/13012_2018_Article_838.pd

    Draft Genome Sequencing of Three Glutaraldehyde-Tolerant Bacteria from Produced Water from Hydraulic Fracturing

    Here, we report the draft genome sequence of three glutaraldehyde-resistant isolates from produced water from hydraulic fracturing operations. The three strains were identified as sp. strain G11, sp. strain G15, and sp. strain G16. The genome sequences of these isolates will provide insights into biocide resistance in hydraulic fracturing operations
