INCONSECVENȚA CURȚII CONSTITUȚIONALE CU PRIVIRE LA REGIMUL JURIDIC AL ANALOGILOR SUBSTANŢELOR STUPEFIANTE SAU PSIHOTROPE

Considerentele reproduse în Decizia Curții Constituționale nr.43/2018 contravin argumentelor invocate în Adresa către Parlamentul Republicii Moldova inclusă în Hotărârea Curții Constituționale nr.25/2015. Aceasta deschide calea pentru comiterea de abuzuri în activitatea de aplicare a art.217 și 2171 CP RM. În pofida poziției exprimate în Decizia Curții Constituționale nr.43/2018, definiţia din alin.(6) art.1341 CP RM nu este clară, previzibilă şi lipsită de echivoc. Destinatarii legii penale nu pot avea o reprezentare clară asupra dispoziţiilor art.217 și 2171 CP RM (în partea ce se referă la analogi), astfel încât să-şi adapteze conduita şi să prevadă consecinţele ce decurg din nerespectarea acestor norme. Maniera ambiguă de redactare, precum și utilizarea unor sintagme neclare, sunt neconforme cu dispoziția de la alin.(2) art.23 din Constituție. Profitând de lipsa unor repere obiective, inclusiv normative, cei abilitați cu aplicarea legii penale au puterea discreționară să atribuie (în condiții obscure) unei substanțe statutul juridic de analog. Expertul este cel care conferă conținut conceptului de similaritate utilizat în alin.(6) art.1341 CP RM. În alți termeni, expertul este cel care stabilește limitele de aplicare a acestei norme penale. Calificarea oficială de către un expert a unei infracțiuni reprezintă nu altceva decât depășirea atribuțiilor de serviciu, intrând sub incidența art.328 CP RM sau a art.313 din Codul contravențional. În concluzie, stabilirea de către expert a cantității de analogi reprezintă un act de ilegalitate.THE INCONSISTENCES OF THE CONSTITUTIONAL COURT WITH REGARD TO THE LEGAL STATUS OF THE ANALOGUES OF NARCOTIC OR PSYCHOTROPIC SUBSTANCESThe paragraphs reproduced in the Constitutional Court's Decision No.43/2018, contradicts the Courts arguments put forward by it in the Address to the Parliament of the Republicof Moldovaand included in the Constitutional Court Decision No.25/2015. This opens the way for potential abuses in the application of art. 217 and art.2171 PC RM. Notwithstanding the position expressed in the Constitutional Court Decision No.43/2018, the definition in par.(6) art.1341 PC RM is still not clear it is predictable and unambiguous. In this context, the appliers of penal law cannot have a clear representation of art.217 and art.2171 PC RM (the paragraphs addressing the analogues issue) so as to adapt their conduct and to foresee possible consequences as a result of the non-compliance to these rules. The ambiguous editing, as well as the use of unclear syntax makes it diverge from the provision of par.(2) art.23 of the Constitution. Taking advantage of the lack of objective benchmarks, including normative ones, the penal law enforcement authorities have discretionary power to attribute (in unclear terms) a substance to the legal status of an analogue. It is the expert the one the one who is entitled to confer the quality of similarity used in par.(6) art.1341PCRM. In other terms, it is the expert who sets the limits of the application of this penal rule. A official qualification made by an expert in relation to an offence is nothing more than a breach of the work duties and it falls under art.328 PC RM or art.313 of the Contravention Code. In conclusion, it is illegal for an expert to determine the amount of analogues.</p

Surgical treatment of short bones fractures in children

Catedra Chirurgie, Ortopedie și Anesteziologie Pediatrică, USMF ,,Nicolae Testemițanu’’Studiul nostru este bazat pe analiza tratamentului ortopedic și chirurgical al fracturilor oaselor scurte la 239 copii, tratați pe parcursul anilor 2011-2016, în Clinica de Ortopedie Pediatrică a USMF ”Nicolae Testemițanu”. Dintre cei 239 copii tratați, 125 copii au fost cu fractură de claviculă, 85 copii au fost cu fractura oaselor mâinii, 25 copii – cu fractura oaselor piciorului. La 178 copii tratați chirurgical s-a efectuat: repoziția deschisă, adaptarea fragmentelor și osteosinteza cu broșe încrucișate urmată de imobilizare gipsată.Our study is based on the analysis of non-operative and surgical treatment of the fractures of short bones in 239 children, treated in the Clinic of Pediatric Orthopaedy of USMF ”Nicolae Testemițanu” during the years 2011-2016. Among the 239 treated children, 125 of them were with fracture of clavicle, 89 – with fractures of hand bones, 25 with fracture of foot bones. There was performed surgical treatment to 178 children: open reduction, internal fixation with crossing K-wires followed by cast immobilization

Medidas de protección laboral para las mujeres víctimas de violencia de género

Se trata de un estudio repartido en 3 bloques: en la primera parte se hace una breve referenciaa la regulación llevada a cabo por parte de las Naciones Unidas y la Unión Europea sobre el asunto, para así llegar y comprender mejor el concepto de Violencia de Género ofrecido por la legislación española y la transcendencia del fenómeno violento en la esfera laboral y su alcance en la CAPV. El segundo bloque, que es el núcleo del trabajo, contiene aquellas medidas, de discriminación positiva, que tratan de compensar si se puede hablar de ese modo, la delicada situación de las víctimas de violencia de género. De ahí que no vaya a insistirse tanto en las actuaciones directas de protección de la víctima de violencia, ni de aquellas otras que deban tomarse contra la persona que ejerce la violencia sobre la mujer maltratada. Clasificarea patologiei în 9 grupe. Tratamentul chirurgical unde tehnica chirurgicală este separată, strict individuală şi depinde de caracterul patologiei, nivelul deformităţii, gradul deformităţii. Recuperarea joacă un rol important în restabilirea funcţiei. Problema înlăturării deformaţiilor membrelor inferioare rămâne una din cele mai actuale în practica ortopedică

Diseño de instalaciones industriales para nave de almacenamiento de distribuidora editorial

The warehouse plays a fundamental role in the proper functioning of the supply chain in the industrial sector or any business area that works with merchandise. Located between the production process and the distribution process, it allows optimizing costs and improving the service offered to the customer and thereby benefits the company. Therefore, one must be able to preserve the merchandise in the most optimal state possible. But first, it must have the appearance of it and be able to function according to its use. Hence, in this project, minimum facilities have been designed to achieve that purpose. The owner of this warehouse is a distribution company, specifically a publishing company, dedicated to the distribution of books. So the only activity that will be carried out in the warehouse will be as storage, although it has also been planned that a smaller office area will be built for the workers of that company, so these conditions have been taken into account when designing the basic facilities. In this project, the low voltage electrical installation has been designed and calculated so it can provide enough energy supply to the establishment, a fire protection system and emergency lighting as a basic security system in the building, lighting system so that the workers can perform their function properly and mechanical ventilation to provide a clean environment for those employees. As an extra complement, the installation of electricity has taken into account the possibility of recharging the basic transport of a warehouse such as electric forklifts through recharging points for this type of vehicle, so the necessary wiring for it has been calculated too. All the design and the proposed solution have been carried out following the current regulations for each type of installation required, mainly using the low voltage regulations as it is the main part of the installation in the industrial building

Testemiţanu”Materialul clinic este compus dintr-un grup de 155 copii (225 gambe) cu vârsta cuprinsă între 3 și 15 ani, care au suportat tratament chirurgical. Cele mai bune și stabile rezultate, în cazul patologiei Blount, au fost obținute cu ajutorul tratamentului chirurgical după metoda P. Moroz. Perioada de reabilitare, după tratament chirurgical, joacă un rol important cu respectarea regimului ortopedic pe parcursul creșterii copilului și are o mare însemnătate în profilaxia recidivelor deformațiilor.The clinical material includes a group of 155 children of 3 to 15 years old that were surgically treated. The best and most stable results of treatment of Blount's illness have been achieved with the help of surgical treatment, in accordance with the method of P. Moroz. Multidisciplinary rehabilitation, realized by stages, with strict maintaining of orthopedic treatment, has a big importance for receiving good results in the future and for prophylaxis of relapses in time of child’s growth.Клинический материал состовляет группу из 155 детей (225 голени) от 3 лет до 15 лет у которых было проведено хирургическое лечение. Наилучшие и стабильные результаты при болезни Блоунта достигнуты с помощью хирургических вмешательств по методике П. Мороз. Реабилитационый период, после хирургического лечения, играет важную роль с соблюдением ортопедического режима на протежения роста ребёнка и имеет большое значение в профилактике рецидивов деформации

Algoritm de diagnostic şi tratament al deformităţii de varus al gambei la copil

Tratamentul chirurgical în maladia Blount este indicat la copiii cu vârsta peste 3 ani. Cele mai efective şi stabile rezultate în această maladie au fost obţinute prin intervenţia chirurgicală de corecţie după procedeul Moroz (în ultimii 18 ani un singur rezultat nesatisfăcător). În deformităţile displastice diafi zare corecţia este obţinută prin osteotomia segmentară diafi zară cu rotaţia segmentului la 180°. Studierea rezultatelor bune la distanţă la copiii operaţi permite să considerăm că tratamentul de recuperare şi reabilitarea copiilor are o mare importanţă în profi laxia recidivelor deformităţii

تهدف هذه الدراسة، من جهة، إلى الكشف عن دلالات مفهوم الحركات البيئية وتطوراتها، وتحديد مدى فعالية عملها وقدرتها على إحداث التغيير الثقافي المنشود في بعض البُلدان العربية (حالة تونس ولبنان والمغرب)، من جهة ثانية؛ منهجيًا، لتتمكّن – انطلاقًا من أدبيات الحركات الاجتماعية الجديدة – من تحديد ما تعنيه وما تقوم به عمليًا؛ لإعداد الجواب عن إمكانية وصف التحركات المدنية الساعية إلى الحفاظ على البيئة من الأخطار الواقعة والمتوقعة في هذه البلدان بأنها حركات اجتماعية متجذّرة ومؤثّرة، كما هو الحال في عديد الدول المتقدّمة. تفترض الدراسة أنَّ هذه الإمكانية تتأثر بالظروف التي نشأت فيها، ووُلِدت بموجبها ولادة طبيعية أو مصطنعة؛ ووعيًا باختلاف المشكلات البيئية والخصوصيات الديموغرافية والاجتماعية داخل كل بلد على الرغم من وجود بعض القواسم المشتركة، خلصت الدراسة – بالارتكاز على بعض المعطيات البيبليوغرافية والإثنوغرافية – إلى صُعوبة تجاهل إرهاصات ما يمكن تسميته عربيًا حركات اجتماعية إيكولوجية تطمح، وَفقًا لبيئتها السياسية والثقافية، وإكراهات ميزان القوة والنفوذ داخلها، إلى التأثير في هذه البيئة التي يبدو أنها لا تزال مُطمَئنة – بغض النظر عن الوفرة التي تحيط بها من كل جانب – لسردية الندرة، وما أفرزته من تطبيع مع خطاب الإكراهات، على نحو يُبقي أثر الجهود المبذولة محدودًا، والسباق من جانب واحد مستمرًا وضاغطًا
