“Our Real Enemies”: Political Foundations of the Legality and Legitimacy of the Spanish “New State,” 1936-45

The legality and political legitimacy of the Francoist New State in Spain during the Civil War and the immediate post-war period entailed the formulation of a doctrine and criminal legislation that enabled the regime to repress its political opponents, as well as to gain control over Spanish society as a whole. This article analyzes how this process of the social construction of the offender was based on the categorization of the other as a dangerous and morally and socially harmful enemy, mainly through the creation of a new offender-based criminal law

Politics and criminality in Franco’s “New State”. The criminalization of “enemy” in post-war criminal law

La consolidación del «nuevo Estado» franquista conllevó la elaboración de una doctrina y una legislación penal que permitiera reprimir a los enemigos políticos de la dictadura, así como conseguir el control de la sociedad. Este estudio analiza la criminalización de la desviación social durante la posguerra. La criminalización es la selección de un grupo de personas, a las que el poder del Estado somete mediante la coacción punitiva de sus acciones. En este proceso de «construcción social» del delito, destacó la categorización del «otro» como un enemigo peligroso y dañino moral y socialmente, también en la justicia común en España.The consolidation of Franco’s «New State» brought with it the drafting of a doctrine and criminal legislation that allowed it to suppress the political enemies of the dictatorship, as well as to establish control over society. This paper studies the criminalization of social deviancy in the postwar period. Criminalization is the selection of a group of persons, whom the power of the State submits by coercive means. In the «social construction» of crime, the main feature was the categorization of the «other» as a dangerous and harmful enemy both morally, socially and in the common justice system in Spain

Propaganda and the construction of a war culture in Spain during the Civil War

Este trabajo analiza la propaganda de guerra durante la Guerra Civil española y los primeros años del «nuevo Estado» franquista. La bibliografía reciente ha analizado la construcción estereotipada de la imagen del enemigo, y cómo la persona del general Francisco Franco fue transfigurada simbólicamente mediante la construcción y la propagación de su imagen carismática en el discurso, los ritos y las liturgias del «nuevo Estado» durante la Guerra Civil. Mediante estos discursos e imágenes, la propaganda construyó una cultura de guerra en España de 1936 a 1939.This article analyses the war propaganda during the Civil War and the first years of the Francoist “New State». Recent work has addressed the construction of the image of the enemy on the basis of the prevailing stereotypes, and how General Franco’s persona was transfigured symbolically through the development of a charismatic image within the rhetoric, rites and liturgies of the ‘New State». This propaganda helped spread a culture of war from 1936 to 1939 and beyond

La formación del «espacio público» como factor de cambio político: precisiones al concepto de «publicidad» burguesa

El trabajo indaga en el sentido común de las nociones de «espacio público» y de «cultura política», no obstante su persistente ambivalencia teórica desde que fueran formulados ambos conceptos a principios de la década de 1960. En primer lugar, se destaca su necesaria imbricación cuando han sido empleados en disciplinas como la historiografía desde la década de 1980, sobre todo acerca de la dialéctica entre Estado y libertad en el cambio político del avance de la modernidad. En último término, se afirma que los límites de la división público/privado se establecen en cada contexto histórico a partir de la idea de libertad individual.This study explores common-sense meanings of “public space” and “political culture”, despite the ambiguity that has been inherent in both expressions since they were first articulated and defined in the early 1960s. The ways in which these expressions have been conditioned by their use in disciplines such as historiography since the 1980s is emphasized, especially in relation to the dialectic between the State and freedom which underlies political change in the progress of modernity. The principle line of argument followed here holds that distinctions between “public” and “private” are made in the specific context of each historical period on the basis of a concept of individual freedom
