It has not been given protection by most of our state constitutions despite the fact that the Federal Constitution has guaranteed life, liberty, and the pursuit of happiness. However, most states have enacted Wrongful Death statutes to allow protection to their inhabitants. In order for the next of kin to damages in a Wrongful Death action, there must be shown a relationship to the deceased. The fact must be established that there was an interest akin to insurable interest in the deceased, which has been lost. Therefore in order to recover damages in a death action, under most statutes, proof of dependency is not necessary

    Predicting Maximal Oxygen Uptake Using the 3-Minute All-Out Test in High-Intensity Functional Training Athletes

    Maximal oxygen uptake (VO2max) and critical speed (CS) are key fatigue-related measurements that demonstrate a relationship to one another and are indicative of athletic endurance performance. This is especially true for those that participate in competitive fitness events. However, the accessibility to a metabolic analyzer to accurately measure VO2max is expensive and time intensive, whereas CS may be measured in the field using a 3 minute all-out test (3MT). PURPOSE: Therefore, the purpose of this study was to examine the relationship between VO2max and CS in high-intensity functional training (HIFT) athletes. METHODS: Twenty-five male and female (age: 27.6 ± 4.5 years; height: 174.5 ± 18.3 cm; weight: 77.4 ± 14.8 kg; body fat: 15.7 ± 6.5%) HIFT athletes performed a 3MT as well as a graded exercise test with 48 h between measurements. True VO2max was determined using a square-wave supramaximal verification phase and CS was measured as the average speed of the last 30 s of the 3MT. RESULTS: A statistically significant and positive correlation was observed between relative VO2max and CS values (r = 0.819, p \u3c 0.001). Based on the significant correlation, a linear regression analysis was completed, including sex, in order to develop a VO2max prediction equation (VO2max (mL/kg/min) = 8.449(CS) + 4.387(F = 0, M = 1) + 14.683; standard error of the estimate = 3.34 mL/kg/min). Observed (47.71 ± 6.54 mL/kg/min) and predicted (47.71 ± 5.7 mL/kg/min) VO2max values were compared using a dependent t-test and no significant difference was displayed between the observed and predicted values (p = 1.000). The typical error, coefficient of variation, and intraclass correlation coefficient were 2.26 mL/kg/min, 4.90%, and 0.864, respectively. CONCLUSION: The positive and significant relationship between VO2max and CS suggests that the 3MT may be a practical alternative to predicting maximal oxygen uptake when time and access to a metabolic analyzer is limited

    Effects of different zinc oxide sources on weanling pig growth performance

    A total of 192 pigs (initially 13.61b and 18 d of age) were used in a 27-d growth assay to determine the effects of different ZnO sources on weanling pig growth performance. The four experimental treatments consisted of a control diet or three diets containing Zn from ZnO from one of three different sources. For the entire trial, no differences occurred in growth performance of pigs fed the different ZnO sources; however, all sources increased ADG and ADFI compared to pigs fed the control diet.     Nuclear safety policy working group recommendations on nuclear propulsion safety for the space exploration initiative

    An interagency Nuclear Safety Working Group (NSPWG) was chartered to recommend nuclear safety policy, requirements, and guidelines for the Space Exploration Initiative (SEI) nuclear propulsion program. These recommendations, which are contained in this report, should facilitate the implementation of mission planning and conceptual design studies. The NSPWG has recommended a top-level policy to provide the guiding principles for the development and implementation of the SEI nuclear propulsion safety program. In addition, the NSPWG has reviewed safety issues for nuclear propulsion and recommended top-level safety requirements and guidelines to address these issues. These recommendations should be useful for the development of the program's top-level requirements for safety functions (referred to as Safety Functional Requirements). The safety requirements and guidelines address the following topics: reactor start-up, inadvertent criticality, radiological release and exposure, disposal, entry, safeguards, risk/reliability, operational safety, ground testing, and other considerations

    Interactive effects of modified tall oil and fat source on growth performance and carcass characteristics of finishing barrows and gilts

    A total of 144 pigs (initially 90 lb) was used to determine the interactive effects of fat source: none (NF), 6% choice white grease (CWG), or 6% poultry fat (PF); modified tall oil (MTO, 0 or .5%); and sex (barrows or gilts) on growth performance and carcass characteristics. Regardless of fat source, MTO improved belly firmness but did not influence growth performance. Gilts were leaner, had increased loin muscle area, and had softer bellies compared to barrows.     Understanding the DayCent model: Calibration, sensitivity, and identifiability through inverse modeling

    AbstractThe ability of biogeochemical ecosystem models to represent agro-ecosystems depends on their correct integration with field observations. We report simultaneous calibration of 67 DayCent model parameters using multiple observation types through inverse modeling using the PEST parameter estimation software. Parameter estimation reduced the total sum of weighted squared residuals by 56% and improved model fit to crop productivity, soil carbon, volumetric soil water content, soil temperature, N2O, and soil NO3− compared to the default simulation. Inverse modeling substantially reduced predictive model error relative to the default model for all model predictions, except for soil NO3− and NH4+. Post-processing analyses provided insights into parameter–observation relationships based on parameter correlations, sensitivity and identifiability. Inverse modeling tools are shown to be a powerful way to systematize and accelerate the process of biogeochemical model interrogation, improving our understanding of model function and the underlying ecosystem biogeochemical processes that they represent

    Extreme weather‐year sequences have nonadditive effects on environmental nitrogen losses

    The frequency and intensity of extreme weather years, characterized by abnormal precipitation and temperature, are increasing. In isolation, these years have disproportionately large effects on environmental N losses. However, multi-year sequences of extreme weather years (e.g., wet-dry vs. dry-wet) and annual crop rotation (legume-cereal vs. cereal-legume) may interact to affect cumulative N losses across the complete crop rotation sequence. We calibrated and validated the DAYCENT model with a comprehensive set of biogeophysical measurements from a maizesoybean rotation managed at three different N fertilizer inputs with and without a winter cereal rye cover crop in Iowa, USA. Our objectives were to determine: i) how two-year sequences of extreme weather years interact with annual crop rotation sequence to affect two-year cumulative N losses, and ii) if the inclusion of a winter cover crop between corn and soybean and N fertilizer management mitigate the effect of extreme weather on N losses. Using historical weather data (1951-2013), we created nine two-year weather scenarios with all possible combinations of the hottest and driest (‘dry’), coolest and wettest (‘wet’), and average (‘normal’) weather years. We analyzed the effects of these scenarios following a period of relatively normal weather. Compared to the normal-normal two-year weather scenario, two-year extreme weather scenarios affected two-year cumulative NO3- leaching (range: -28 to +295%) more than N2O emissions (range: -54 to +21%). Moreover, the two-year weather scenarios had non-additive effects on N losses: although dry weather decreased NO3- leaching in isolation, two-year cumulative NO3- losses from the dry-wet scenario were 89% greater than the normal-normal scenario. Cover crops reduced the effect of extreme weather on NO3- leaching, but not N2O emissions. As the frequency of extreme weather events is expected to increase, understanding of interactions between crop rotation and interannual weather patterns can be used to mitigate the effect of extreme weather on environmental N losses

    Highly sp3-bonded, nearly hydrogen-free carbon-based materials can exhibit extremely low friction and wear in the absence of any liquid lubricant, but this physical behavior is limited by the vapor environment. The effect of water vapor on friction and wear is examined as a function of applied normal force for two such materials in thin film form: one that is fully amorphous in structure (tetrahedral amorphous carbon, or ta-C) and one that is polycrystalline with sp3 to disordered sp2 bonding is observed, no crystalline graphite formation is observed for either film. Rather, the primary solid-lubrication mechanism is the passivation of dangling bonds by OH and H from the dissociation of vapor-phase H2O. This vapor-phase lubrication mechanism is highly effective, producing friction coefficients as low as 0.078 for ta-C and 0.008 for UNCD, and wear rates requiring thousands of sliding passes to produce a few nanometers of wear
