Why Judges Applying the Daubert Trilogy Need to Know About the Social, Institutional, and Rhetorical - And Not Just the Methodological - aspects of Science
In response to the claim that many judges are deficient in their understanding of scientific methodology, this Article identifies in recent cases (1) a pragmatic perspective on the part of federal appellate judges when they reverse trial judges who tend to idealize science (i.e., who do not appreciate the local and practical goals and limitations of science), and (ii) an educational model of judicial gatekeeping that results in reversal of trial judges who defer to the social authority of science (i.e., who mistake authority for reliability). Next, this Article observes that courts (in the cases it analyzes) are not interested in pragmatically constructing legal science, but rather attempt to ensure that science itself, conceived pragmatically (i.e., without idealizing science), is appropriated in law. This Article concludes that trial judges who fail to appreciate the social, institutional, and rhetorical aspects of science tend to reject reliable—albeit pragmatic—science, welcome unreliable—albeit authoritative— science, and thereby create a body of legal science that is out of sync with mainstream science
THE COST STRUCTURE OF MICROFINANCE INSTITUTIONS IN EASTERN EUROPE AND CENTRAL ASIA
Microfinance institutions are important, particularly in developing countries, because they expand the frontier of financial intermediation by providing loans to those traditionally excluded from formal financial markets. This paper presents the first systematic statistical examination of the performance of MFIs operating in Eastern Europe and Central Asia. A cost function is estimated for MFIs in the region from 1999-2004. First, the presence of subsidies is found to be associated with higher MFI costs. When output is measured as the number of loans made, we find that MFIs become more efficient over time and that MFIs involved in the provision of group loans and loans to women have lower costs. However, when output is measured as volume of loans rather than their number, this last finding is reversed. Satellite laser ranging work at the Goddard Space Flight Center
Laser ranging systems, their range and accuracy capabilities, and planned improvements for future systems are discussed, the systems include one fixed and two mobile lasers ranging systems. They have demonstrated better than 10 cm accuracy both on a carefully surveyed ground range and in regular satellite ranging operations. They are capable of ranging to all currently launched retroreflector equipped satellites with the exception of Timation III. A third mobile system is discussed which will be accurate to better than 5 cm and will be capable of ranging to distant satellites such as Timation III and LAGEOS
Folate catabolites in spot urine as non-invasive biomarkers of folate status during habitual intake and folic acid supplementation.
Folate status, as reflected by red blood cell (RCF) and plasma folates (PF), is related to health and disease risk. Folate degradation products para-aminobenzoylglutamate (pABG) and para-acetamidobenzoylglutamate (apABG) in 24 hour urine have recently been shown to correlate with blood folate.
Since blood sampling and collection of 24 hour urine are cumbersome, we investigated whether the determination of urinary folate catabolites in fasted spot urine is a suitable non-invasive biomarker for folate status in subjects before and during folic acid supplementation.
Immediate effects of oral folic acid bolus intake on urinary folate catabolites were assessed in a short-term pre-study. In the main study we included 53 healthy men. Of these, 29 were selected for a 12 week folic acid supplementation (400 µg). Blood, 24 hour and spot urine were collected at baseline and after 6 and 12 weeks and PF, RCF, urinary apABG and pABG were determined.
Intake of a 400 µg folic acid bolus resulted in immediate increase of urinary catabolites. In the main study pABG and apABG concentrations in spot urine correlated well with their excretion in 24 hour urine. In healthy men consuming habitual diet, pABG showed closer correlation with PF (rs = 0.676) and RCF (rs = 0.649) than apABG (rs = 0.264, ns and 0.543). Supplementation led to significantly increased folate in plasma and red cells as well as elevated urinary folate catabolites, while only pABG correlated significantly with PF (rs = 0.574) after 12 weeks.
Quantification of folate catabolites in fasted spot urine seems suitable as a non-invasive alternative to blood or 24 hour urine analysis for evaluation of folate status in populations consuming habitual diet. In non-steady-state conditions (folic acid supplementation) correlations between folate marker (RCF, PF, urinary catabolites) decrease due to differing kinetics
Arsenic and Old Chemistry: Images of Mad Alchemists, Experts Attacking Experts, and the Crisis in Forensic Science
Drawing on research into the use of experts in early 19th-century criminal trials, the image of mad alchemists in popular culture representations of science, and the distinction between empirical and contingent “interpretive repertoires” in the discourse of scientific controversies, this article explores the controversy over arsenic-detection technologies prior to the Marsh test. In addition to noting the predictable criticism of incompetent expertise in the service of law, this article highlights implied accusations of hubris and amorality on the part of over-confident experts, both in the early 19th-century and in today\u27s crisis of forensic science
A comparison of two stereolithography resins : an honors thesis (HONRS 499)
The researcher has done a project on the new technology of stereolithography (SLA). This technology uses a 3-D model of a part to rapidly produce a prototype part using a laser to solidify a liquid resin. This procedure gives the customer the chance to see a product in hours instead of months. The material, however, is too brittle for tests that involve stress on the part to be conducted. It was the intent of the research project to find the right combination of cure time and variable settings which would yield the maximum strength of the material. Since the project was for Delco Remy, the researcher compared a GM resin with a suggested resin from the SLA manufacturer. Because of understandable reasons with competition in the automotive industry, the actual names of the resins have been withheld from the report. Law and its Limits: Ethical Issues in Mary Shelley’s Frankenstein or, The Modern Prometheus
The law and literature movement is frequently associated with the use of literary images of law as a point of reflection upon the ethical obligations of lawyers. Mary Shelley’s Frankenstein (1818)—the story of a young scientist whose unorthodox experiments end up creating the famed “monster”—is not, at first glance, a likely candidate for that enterprise. However, Dr. Frankenstein’s ambition and ruthless pursuit of knowledge has become a contemporary image of science out of control and the need for ethical limitations on scientific progress. Consequently, the novel raises currently important issues of regulating science and technology. Given the lawyer’s ethical obligation to work for the improvement of the law, is Artificial Intelligence (“AI”) and the trend toward automated decision-making in legal contexts, the professions own out of control “monster?” Shelley’s novel includes depictions of injustice in unsympathetic criminal courts: two innocent characters are condemned to death, one on weak evidence and one for his religious beliefs alone, while another has his property cruelly confiscated. While Frankenstein raises issues pertaining to “Big E” ethics—such as the responsibility of lawyers for law reform and justice in society—it also engages our everyday concerns for injustice as reflected in relevant judicial codes of ethics and rules of professional conduct
