Le monopole étatique de la violence : le Brésil face à l´héritage occidental
Dans un livre publié en 2004 – La violence – Michel Wieviorka  suggère l´hypothèse d’une remise en cause, à l’heure actuelle, dans les sociétés occidentales, de la formule weberienne qui plaide en faveur du monopole légitime de la violence physique en tant que fondement de l´État moderne. Bien que l’on puisse être d´accord avec cette hypothèse générale, on ne peut pas l´accepter aussi complètement, si l’on considère les sociétés « de l´extrême Occident » (selon l’expression d’Alain Rouquier), comme c’est le cas du Brésil. En dépit des mutations survenues de par les liens de société brésilienne avec le mouvement de la mondialisation, le contrôle démocratique de la violence et du crime urbain suggère un double défi à relever : d’un côté, le contrôle d’une violence endémique qui se déploie au sein de la société civile; et d’un autre côté, le contrôle, autant par la société civile organisée que par le gouvernement civil, des forces répressives de l’Etat.Michel Wieviorka (2004) raises the hypothesis that Max Weber´s formulation of the legitimate monopoly of physical violence as the foundation of Modern State, in the western societies, is exhausted. Although one can agree with this proposition, we cannot accept it in absolute terms should we consider the societies of the Extreme Occident (Rouquié, 1986) as it is the case of Brazil. This paper explores the concept according to which, in contemporary Brazil, in spite of changes as result with globalization in its different aspects, the democratic control of violence and urban crime continues to challenge present double form: on the one hand, the social control of endemic violence within civil society; and on the other hand, the control both by civil and the government of the repressive forces of the State

A violĂŞncia na sociedade brasileira: um painel inconcluso em uma democracia nĂŁo consolidada
After 21 years of political authoritarianism (1964-1985), Brazilian society has returned to constitutional normality and civilian government. In spite of the democratic conquests, it has not been enough to establish the democratic State of law. Grave violations to human rights have persisted, caused by an endemic violence, rooted upon the social structure and customs, and expressed through the behavior of social groups and of moral agents supposed to preserve the public order. Everything seems to indicate that, during the process of democratic transition, the opportunities to solve violently social conflicts and intersubjective tension have increased. A significant number of facts and situations have happened such as: mishandling and torture of prisoners within police districts and penitential institutions; murders and menaces to female peasant workers and their leaders; homicides, that seem deliberate, of children and teen-agers; violence of all kinds against women and young people, specially within the domestic space; lynchings and private justice; extermination of ethnical minorities. To explain these facts under the sociological perspective requires considering, among other aspects, the assymetry between social and political rights, the absence of institutional political and public mediations which can ensure the pacification of society, and also those characteristics of the dominant political culture which seem to point to a certain “socially rooted authoritarianism ”.Après avoir subi 21 ans de regime politique autoritaire (1964- 1985), la sociĂ©tĂ© brĂ©silienne a retrouvĂ© la constitutionalitĂ© et le gouvemement civil. MalgrĂ© ses conquĂŞtes dĂ©mocratiques, elle n’a pas rĂ©ussi Ă instaurer um effectif Etat dĂ©mocratique de Droit. De graves violations des droits de 1’homme, rĂ©sultat d’une violence endĂ©mique enracinnĂ©e dans les structures sociales et dans les moeurs, ont continuĂ© Ă ĂŞtre comises. Cette violence se manifeste aussi bien dans les groupes de la sociĂ©tĂ© civile que parmi les agents chargĂ©s de la preservation de 1’ordre publique. Selon toutes les indications, au long du processus de transition dĂ©mocratique, les solutions violentes des conflits sociaux et les tensions dans les rapports intersubjectifs se sont accrues. Un nombre pas nĂ©gligeable de situations et Ă©vĂ©nements — tels la brutalisation des enfants et la torture des prisonniers; assassinais et menaces aux femmes et aux leaders paysans; homicides dĂ©liberĂ©s d’enfants et d’adolescents; violence domestique; lynchages et exĂ©cutions sommaires; exterminations des minoritĂ©s ethniques — se sont accumulĂ©s au cours des temps. Une visĂ©e sociologique capable d’expliquer la permanence de ces phĂ©nomènes exige que Ton considère, parmi d’autres aspects, rassymĂ©trie entre les droits politiques et droits sociaux, les caractĂ©- ristiques de la culture politique dominante et son “autoritarisme socialement implanté”, ainsi que l’absence de mĂ©diations institution- nelles, politiques et publiques capables d’assurer la paix sociale.ApĂłs 21 anos de vigĂŞncia de regime autoritário (1964-1985), a sociedade brasileira retomou Ă normalidade constitucional e ao governo civil. NĂŁo obstante os avanços democráticos conquistados, nĂŁo se logrou a efetiva instauração do Estado democrático de Direito. Persistiram graves violações de direitos humanos, produto de uma violĂŞncia endĂŞmica, radicada nas estruturas sociais, enraizada nos costumes, manifesta quer no comportamento de grupos da sociedade civil, quer no de agentes incumbidos de preservar a ordem pĂşblica. Mais do que isso, tudo indica que, no curso do processo de transição democrática, recrudesceram as oportunidades de solução violenta dos conflitos sociais e de tensões nas relações intersubjetivas. Um apreciável nĂşmero de situações e acontecimentos acumularam-se no tempo, como sejam os maus tratos e torturas impingidos a presos nas delegacias e distritos policiais, como tambĂ©m no sistema penitenciário; assassinatos e ameaças a trabalhadoras e suas lideranças no campo; homicĂdios, ao que parece deliberados, de crianças e de adolescentes; violĂŞncias de toda ordem cometidas contra mulheres e jovens, sobretudo no espaço domĂ©stico; linchamentos e justiçamentosprivados; extermĂnio de minorias Ă©tnicas. Sob a perspectiva sociolĂłgica, explicar a persistĂŞncia desses fatos requer considerar, entre outros aspectos, a assimetria entre direitos polĂticos e direitos sociais, a ausĂŞncia de mediações institucionais, polĂticas e pĂşblicas, capazes de assegurar a pacificação da sociedade, bem como as caracterĂsticas da cultura polĂtica dominante que acenam no sentido de um “autoritarismo socialmente implantado’’
Conflict and violence: reflections on anomy in the contemporary world
Based on a critical analysis of the essay Law and Order (1985) by Ralf Dahrendorf about the erosion of law and order in contemporary society, this article reviews the arguments of the essay pointing out the changes involved in the modes of subjection of the individuals. What is in question in the present turn-of-the-century context of radical transformations is rather the way individuals govern themselves and each other (Foucault, 1984) than the liberation of each individual from social ties and controls – the problem of “ligatures”. In order to justify this hypothesis, the analytical reference is a specific case: the colonization of urban criminality by organized crime, specially by one of the most emblematic examples of violence production in contemporary world: drug-trafficking.A partir de uma análise crĂtica de ensaio de Ralph Dahrendorf, Law and Order (1985), sobre a erosĂŁo da lei e da ordem na sociedade contemporânea, procura-se desconstruir os argumentos contidos no ensaio sugerindo as mudanças que incidem sobre o modo de assujeitamento dos indivĂduos. Mais do que liberação dos indivĂduos dos liames e controles sociais, para alĂ©m de um problema de “ligaduras”, o que parece estar no centro das radicais transformações da ordem neste final do sĂ©culo Ă© o modo como os indivĂduos governam a si e aos outros (Foucault, 1984). Para sustentar esta hipĂłtese, toma-se como referĂŞncia para a análise um caso determinado: a colonização da criminalidade urbana pelo crime organizado, em particular por uma das modalidades mais emblemáticas de produção da violĂŞncia no mundo contemporâneo – o narcotráfico

A pesar de haberse iniciado la transiciĂłn a la democracia a mediados
de los años 80, la sociedad brasileña no ha alcanzado su pacificación.
Para reprimir el crimen violento, formas igualmente violentas
fueron frecuentemente adoptadas, con malos resultados.
Una sucesión de motines en las cárceles de máxima seguridad, por
la responsabilidad del crimen organizado, principalmente en Sao
Paulo, evidencia los lĂmites de las polĂticas penitenciarias del gobierno
federal y provincial. Este artĂculo aborda los lĂmites y los
desafĂos que tales polĂticas ejercen en el control del crimen y de la
violencia en la democracia del Brasil contemporáneo.In spite of the political transition under way since the 1980's, the
Brazilian society has not attained peace. To repress violent crime,
methods equally violent have often been employed, with disastrous
results. A series of riots in high security prisons, insdgated
by organized crime, mainly in Sao Paulo, show the limitations of
penitentiary policies of both federal and provincial governments.
This essay analyzes the limits and the challenges of these policies
for the control of crime and violence faced by the Brazilian democracy
today
Insegurança versus direitos humanos: entre a lei e a ordem
The purpose of this article is to analyses the public security policy formulated and implemented by the government of Fernando Henrique Cardoso in his first governoship (1995-1998). This analysis tries to inventory some political constraints, which limit the target of the line of directions formulated and implemented. Initially it presents a social and political scenery wider than the previous ones, which has contributed that public security and penal justice problems occupy a central position in the governmental policies. Then, we analyses the government of FHC's initiatives mainly in human rights, evaluating some impacts and results, identifying ambivalence and impasses as well.O propĂłsito deste artigo Ă© analisar a polĂtica de segurança pĂşblica formulada e implementada pelo Governo do presidente Fernando Henrique Cardoso em sua primeira gestĂŁo governamental (1995-1998). A análise procura inventariar alguns dos constrangimentos polĂticos que limitam o alcance e escopo das diretrizes formuladas e implementadas. Apresenta inicialmente o cenário social e polĂtico mais amplo que contribuiu para que problemas de segurança pĂşblica e de justiça penal viessem a ocupar certa centralidade nas polĂticas governamentais. Em seguida, detĂ©m-se na análise das iniciativas implementadas pelo governo FHC, particularmente no campo dos direitos humanos, avaliando alguns de seus impactos e resultados bem como identificando-lhes ambivalĂŞncias e impasses
