Bad Character Evidence in the Criminal Trial: the English Statutory/Common Law Dichotomy--Anglo-Australian Perspectives
Evidence of Bad Character (BCE) is an important evidential category, and its admission can have a significant impact upon the criminal trial. The Criminal Justice Act 2003 (CJA 2003) provides a definition of bad character evidence (s98/112 CJA 2003) that where applicable requires BCE to surmount one of the gateways to admissibility in s101(1) CJA 2003. Regarding some Uniform Evidence Law jurisdictions in Australia, the Evidence Act 1995 (EA 1995) governs the admissibility of evidence to demonstrate ‘tendency’/’coincidence’ (or the improbability thereof) and the use of BCE to rebut defendant-led good character (see ss97, 98, 101 and 110 Evidence Act 1995). The definition of BCE provided in s98 CJA 2003 requires ‘evidence of, or of a disposition towards, misconduct’ and ‘misconduct’ is further defined within s112 CJA 2003 as ‘the commission of an offence or other reprehensible behaviour’. A wealth of case law has developed around when evidence ‘has to do with the alleged facts of the offence charged’ in s.98(a) CJA (an exception to the definition of BCE) as well the scope of the overlap between s.98(a) and certain gateways to admissibility (for example, s101(1)(c), (d) CJA 2003), which has led to both a degree of flexibility and also to uncertainty within the law in this area. Similarly, in Australia, in many cases evidence incidentally disclosing other (mis)conduct by the accused have been held to fall outside the provisions regulating the admission of tendency (and coincidence) evidence. This article will explore some of the areas of uncertainty that have developed since the implementation of the 2003 reforms, informed by consideration of the approach to equivalent questions in the Australian jurisdictions

Cross-species gene expression analysis of species specific differences in the preclinical assessment of pharmaceutical compounds
Animals are frequently used as model systems for determination of safety and efficacy in pharmaceutical research and development. However, significant quantitative and qualitative differences exist between humans and the animal models used in research. This is as a result of genetic variation between human and the laboratory animal. Therefore the development of a system that would allow the assessment of all molecular differences between species after drug exposure would have a significant impact on drug evaluation for toxicity and efficacy. Here we describe a cross-species microarray methodology that identifies and selects orthologous probes after cross-species sequence comparison to develop an orthologous cross-species gene expression analysis tool. The assumptions made by the use of this orthologous gene expression strategy for cross-species extrapolation is that; conserved changes in gene expression equate to conserved pharmacodynamic endpoints. This assumption is supported by the fact that evolution and selection have maintained the structure and function of many biochemical pathways over time, resulting in the conservation of many important processes. Ambitions of Cidade: War-Displacement and concepts of the urban among bairro residents in Benguela, Angola
The dissertation explores concepts of upward social mobility, proper personhood and processes of social change as a result of the rural - urban migration provoked by the war in post-colonial Angola between 1975 and 2002. The study focuses on the city of Benguela, which received large numbers of war-displaced people, most of whom settled in bairros, informal settlements surrounding the cidade, the formally structured area of the town. The experience of displacement and establishment in urban areas is not marked only by material struggles and recent experiences of violence, displacement, humanitarian aid and so on, but also by social and historical constructions of rural - urban relationships and of urban space. These frame actors' choices, decisions and actions. I show that 'war-displaced people' are individuals with a history and in history. Drawing on ethnographic work conducted in Bairro Calombotão, surveys, life histories and historical data, I show how classificatory categories shape imaginings and concepts of the urban and the forms of life appropriate to it. The categories of 'mato (bush) and cidade (city)', 'avanço (advancement) and atraso (backwardness)', developed and non-developed are often used to describe rural'urban relationships and are strongly entrenched in Angola. Following Bourdieu (1979, 1980), I argue that these categories function as 'classificatory schemes', that is, as socially and historically constructed and embodied structures of perception and appreciation. In exploring the classificatory power of categories, I sought to understand what I call 'ontological development', people's attempts to become avançados (advanced, developed). I show that cidade is not only the place where it is possible to live a proper material life, but it is also the place where one becomes a proper person. I draw on theories that ground analysis in history and structural relations. However, mine is not a determinist argument. Using the concept of conjuncture I highlight possibilities for mobility and social change. The notion of vital conjunctures (Johnson-Hanks, 2002) helps me understand social change in a country where a succession of wars forced considerable and sometimes abrupt contextual change onto many people. But, the outcome of vital conjunctures does not necessarily result in significant change at either an individual or a social level. I therefore propose the analytic concept of 'transformative conjunctures' to demonstrate how change is possible

A Contextual Examination of Educator Conceptions of Gifted Individuals
Historically, white, affluent students have been overrepresented in gifted education. Although changes to the testing procedures and nominations of students for gifted education have been recommended and implemented, this trend continues with only marginal improvement. One recommendation in particular has focused on challenging the implicit biases of educators involved in the nomination process. Unfortunately, prior research relating to teacher conceptions of giftedness is limited, especially as it relates to differences across student demographics. This dissertation study proposes a return to the examination of educator conceptions of giftedness, but within the school context. Because ideologies and implicit beliefs do not develop independently, it is important that educator views be examined as functions within a larger network. Only then can accurate interpretation of those beliefs be made and by extension pragmatic interventions can be developed. Educators from nine districts were invited to semi structured interviews where they described their conceptions of gifted students. Their descriptions were then analyzed using thematic analysis with the prevailing gifted theory and Bronfenbrenner as a theoretical framework. Results further indicated that educators are shifting away from the whole child paradigm in favor of more modern paradigms. Despite this, a majority of districts maintain tenants of the whole child paradigm for gifted identification. Additionally, participants reported a lack of knowledge relating to giftedness among their coworkers. This study did not find any evidence of differential student perspectives based on race. However, the was a difference in teacher perspectives of parents across races. Finally, the major environmental factors affecting teacher perspectives were a whole child minded school environment and obedience oriented teachers
