La gestión de derechos de autor en entornos digitales, un reto para las bibliotecas y centros públicos de información

Estudia la aparición de los dispositivos de gestión de derechos de propiedad intelectual en el mercado de información electrónica y sus implicaciones para las bibliotecas y centros públicos de información. Se abordan las implicaciones que conlleva la protección de los contenidos digitales en el modelo económico y de servicio de estas instituciones, así como para los derechos tradicionalmente reconocidos a los usuarios. El estudio de la regulación legal que se lleva a cabo en Estados Unidos y en la Unión Europea pone de relieve el papel que se ha asignado en Norteamérica a la Library of Congress en la redacción de las normas que contemplan las excepciones a la protección de contenidos.This article studies the appearance or mechanisms for the management of intellectual property rights in the electronic information market and their implications for libraries and public information centers. The study tackles the implications of proecting digital content on the economic and service model of these institucions as well as on traditionally recognized users’ rights. The study of the legal regulation which is under way in the United States and the European Union emphasizes the role which has been assigned in North America to the Library of Congress for the drawing up of standards which take into account exceptions to the protection of content

The article examines the role of library lending as one of the most important services guaranteeing information access. Also, it highlights the importance of intellectual property laws in managing library services. The public lending right is analysed, within the context of the right to distribution, and its characteristics and legal regulation are studied. Finally, public lending is addressed as a service and as an author right, in connection with the new information services now available in the digital world

El uso de las licencias libres en los datos públicos abiertos

Big data, the massive amounts of data collected using different technological tools or extracted from large collections of information in different formats, are able to generate new knowledge in diverse sectors. But problems are posed regarding both their ownership and subsequent use. This study analyzes the concept of data analysis, as well as the different types of data and their possible regulation, presenting an overview of how in recent years some open licensing schemes have begun to be implemented for avoiding the legal obstacles facing the inclusion of these data types in the creation of new knowledge. The study shows how different governments and international organizations that produce public data have found an appropriate mechanism for promoting the use and reuse of large volumes of public data through these licenses - in particular, the PPDL and CC0 modalities in which all rights to databases are waived.Los datos masivos o big data recopilados a través de distintas herramientas tecnológicas o extraídos de grandes colecciones de información en distintos formatos son capaces de generar nuevo conocimiento en los sectores más diversos, pero, a la vez, plantean problemas tanto de titularidad como de su uso posterior. El estudio analiza el concepto de análisis de datos, los distintos tipos de datos y su posible regulación, presentando un panorama sobre cómo en los últimos años los países más avanzados en apertura de datos han comenzado a aplicar unos esquemas de licencias abiertas que remueven los obstáculos legales para incorporar estos tipos de datos a la creación de nuevo conocimiento. La investigación realizada muestra cómo distintos gobiernos y otras corporaciones y organismos internacionales productores de datos públicos han encontrado en estas licencias —en particular, las modalidades PPDL y CC0 en las que se renuncia a todos los derechos sobre las bases de datos— un mecanismo adecuado para favorecer el uso y reutilización de estos grandes volúmenes de datos

Even if only a small part of the documentary heritage is digitalized it has been an increase of its presence on the Internet in the last few years. In addition to the preservation it’s also important that this documentation be accessible to everyone in the context of an open data policy that allows the reutilization of the digitalized heritage in other areas. In this regard it’s distinguished the public information sector which is subject to be seized in commercial and social activities from other stored content and collections sector which generate less commercial interest. In any case the conservation and diffusion of the digital heritage is a very expensive task that needs the collaboration of the private sector, that is contained in the Directive (2013/37/EU) of the European Parliament regarding the information of the public sector, and that also contains the collections drawn from archives, libraries and museums

Reuse of the transparency-related information posted on Spanish library and archive websites

This study addresses the types of formats and ease of reuse of transparency-related information available on the websites of 53 national public libraries and 53 provincial historic archives. Further to Spain's Transparency Act, reuse of public sector information is one of the elements comprising the right of access to information. Access and use must consequently be ensured to enable citizens and businesses to reuse all available data. The working methodology deployed here consisted in searching for, identifying and analysing the transparency-related documents carried on library and archive websites and the legal warnings governing their reuse. The findings revealed a wide variety of formats and rules governing reuse and indications of scant interest in these institutions in fostering the transparency and reuse of public information.
