    From text: Welcome to the Centenary Issue of the Journal for Juridical Science. This volume is a special issue to mark 2004 as the Centenary Year of the University of the Free State. The idea of a Centenary Issue, where members of the Faculty of Law would make a special contribution to the University of the Free State to celebrate the Centenary Year, owes much to the initiative of the Dean of the Faculty of Law, Professor JJ Henning. It is an idea that was fully supported and endorsed by the editorial committee of the JJS. The result has been an assortment of contributions of authors who are either full-time members of the Faculty or are associated with the Faculty. The topics are wide-ranging representing the diversity of the Departments of the Faculty as well as diversity of interests among authors

    Conscientious objection and legal abortion in South Africa: delineating the parameters

    The purpose of this article is to delineate the scope and limitations of the exercise of the right to conscientious objection in respect of participation in abortion procedures under the Choice on Termination of Pregnancy Act. The Act is silent about the right to conscientious objection. However, section 15 of the South African Constitution in particular, implicitly accommodates conscientious objection to abortion. It is submitted that whilst the Choice on Termination of Pregnancy Act fails to provide the principles for determining the limits of the right to conscientious objection, guidance can be derived from section 36 of the Constitution. It is submitted that section 36 supports the limitation of the right to conscientious objection where maternal life or health is in serious danger or there is a medical emergency. Furthermore, it is argued that in the particular circumstances of South Africa, section 36 is also capable of supporting the imposition of a duty to at least provide the pregnant woman with information about where she might be able to obtain an abortion. It is noted that determining the parties that are entitled to conscientious objection beyond health care professionals that are immediately involved with abortion procedures can raise difficult issues. However, section 36 of the Constitution is, once again, a useful tool for resolving any difficulties in this regard

    Equality for people with disabilities in the workplace: an overview of the emergence of disability as a human rights issue

    In essence, the article explores the development of disability as a human rights issue with a particular focus on equality in the workplace. It draws from developments that have been taking place at the international plane as well as in other jurisdictions. Throughout, the article seeks to ultimately relate disability to the South African workplace. It is submitted that human rights jurisprudence has been slow in harnessing equality as a normative tool for overcoming prejudice and indifference in the workplace environment. However, in the last two decades or so, there has been a paradigm shift, with disability emerging as a human rights issue at international and domestic levels. The growing recognition of the concept of reasonable accommodation as a mechanism for realising equality for people with disabilities in the workplace, is one of the most promising signs of a new approach to disability

    Karl Barth’s doctrine of creation: Convergence and divergence with African Christology

    This article explores the intersection between Karl Barth’s doctrine of creation and African Christology seeking to elicit similarities as well as differences. It argues that this intersection is contested and open to different understanding and interpretation. The common goal amongst the two doctrines is that they derive from biblical teachings about creation and the creator. However, there is also divergence between the doctrines. Barth’s point of departure in his doctrine of creation maintains the Covenant of God to humanity which is not extended to all creation. African Christology’s point of departure, on the other hand, maintains that the relations between God, humanity and all life-forms are sacred because of its intrinsic value and sacramental nature. From an African perspective, creation is mutually related and interconnected to the web of life. All life forms hold intrinsic value. It is argued that African Christology implicates Barth’s Christological focus as something that reveals Barth’s doctrine of creation as anthropocentric. Contribution: The article promotes a multi-disciplinary approach to eco-theology by exploring the intersection between Karl Barth’s doctrine of creation and an African Christological perspective on ecology. It implicates Christian anthropocentrism as a contributory factor to ecological degradation and suggests that African Christology is an important resource for developing a remedial eco-theolog

    Section 27 of the South African Constitution guarantees everyone a right of access to healthcare services, including reproductive healthcare. This paper discusses how domestic courts have interpreted and applied section 27. It explores the extent to which section 27 is justiciable in the sense of being amenable to judicial interpretation and application in practice. The paper highlights the scope as well as the limits of the constitutional and institutional competences of the courts to adjudicate a claim relating to the right to health that is guaranteed by section 27. The justiciability of the right to health under the South African Constitution is interrogated through a critical appraisal of three cases decided by the South African Constitutional Court, namely, Soobramoney versus Minister of Health KwaZulu-Natal, Minister of Health and Others versus Treatment Action Campaign and Others, and Government of the Republic of South Africa and Others versus Grootboom and Others against the backdrop of the transformation of the South African constitutional landscape in the post-apartheid era.Este trabalho discute como as cortes sul-africanas têm interpretado e aplicado o artigo 27 da Constituição da África do Sul, que garante a todos o direito de acesso aos serviços de saúde, incluindo cuidados reprodutivos. A extensão da judicialização do artigo 27 é analisada, considerando a possibilidade de interpretação judicial e aplicação prática. Destaca-se a abrangência e os limites das competências constitucional e institucional dos tribunais para julgar uma ação relacionada ao direito à saúde. A judicialização deste direito na Constituição da África do Sul é investigada por meio de uma análise crítica de três casos decididos na Corte Constitucional do país: (1) Soobramoney versus Secretaria de Saúde de KwaZulu-Natal; (2) Ministro da Saúde e Outros versus Campanha de Tratamento e Outros; e (3) Governo da República da África do Sul e Outros versus Grootboom e Outros, tendo como pano de fundo a transformação do quadro constitucional sul-africano na era pós-apartheid

    African eco-theology : land, ecology, and indigenous wisdom in the works of Samson Gitau, Kapya Kaoma, and Jesse Mugambi

    Abstracts in English, Xhosa and Afrikaans.Using an interdisciplinary and multidisciplinary approach, this study investigates the eco-theological contributions of three main interlocutors from East and Southern Africa, namely Samson Gitau, Kapya Kaoma and Jesse Mugambi, all of whom are African theologians. The three theologians seek to address ecological degradation from an African ecological perspective, by drawing on African Indigenous Knowledge Systems and African Christianity and Religiosity. The contributions of the three theologians in their respective chapters enable the study to identify the systems and practices that are under-researched and not utilised even though they are ecologically sensitive systems. Owing to a number of factors, African Indigenous Wisdom Knowledge Systems have not been adequately explored. African Indigenous Wisdom is a body of knowledge systems with ecological overtones. From a theological and African religiosity perspective, Gitau, Kaoma and Mugambi highlight the need for natural theology to be adopted by the Church as an institution. Gitau stresses the importance of relations based on the African concept of God, humanity and creation. The study addresses the gap in the existing knowledge by drawing on the main interlocutors to investigate the ecological crisis and by adopting an interdisciplinary and multidisciplinary approach. According to this approach, as applied by Gitau, Kaoma and Mugambi, the indigene’s systems are not adequately explored and churches in Africa are ecologically insensitive. African churches ought to embrace Indigenous Wisdom Knowledge Systems and form an African eco-theology. The study has brought to the fore the ecological overtones of African religious belief systems and African Christianity that, together, provide the basis for Christian ecological ethics inside and outside the faith community. Uit 'n teologiese perspektief dring Gitau, Kaoma en Mugambi daarop aan dat die Kerk as 'n instelling die ekologiese teologie volgens Afrika-religiositeit aanvaar. Gitau beklemtoon die belangrikheid van verhoudings wat op die Afrika-konsep van God, menslikheid en skepping gebaseer is. Hierdie studie vul 'n leemte in die bestaande kennis aan deur uit die primêre gespreksgenote se kennis te put om die ekologiese krisis deur ʼn interdissiplinêre en multidissiplinêre benadering aan te pak.     AIDS in schools: a human rights perspective on parameters for sexuality education

    This article is set against the background of a sustained HIV/AIDS epidemic affecting the South African population, including the education sector. It explores the education sector’s responses to the epidemic in the area of sexuality education for learners. It is submitted that lifeskills education — the main medium for imparting sexuality education — is an essential instrument in the armamentarium against HIV/AIDS. However, lifeskills education is not value-free. The values that underpin lifeskills education are libertarian in orientation. They cherish diversity, and do not sit easily with a sectarian view of life. The success of lifeskills education will depend, in part, on striking an acceptable balance between the duty of the school to impart the knowledge and skills essential for development and survival, the evolving capacity of the learner, and parental authority. In the final analysis, the impetus is towards a sexuality education in which the core values of human dignity, liberty and equality are protected and promoted in accordance with the imperatives of the Constitution

    What is Africanness? Contesting nativism in race, culture and sexualities

    What is Africanness: Contesting nativism in culture, race and sexualities, by Charles Ngwena, Professor of Law at the Centre for Human Rights, Faculty of Law, University of Pretoria, is a peer-reviewed monograph aiming to contribute to the ongoing scholarly conversation in and beyond South Africa about who is African and what is African. It aims to implicate a reductive sameness in the naming of Africans (‘nativism’) by showing its teleology and effects; and offers an alternative understanding of how Africans can be named or can name themselves. The book develops an epistemology for constructing the hermeneutics of Africanness today, long after the primal colonial moment and its debasing racialising ideology. It interrogates the making of Africa in colonial discourses and the making of an African race and African culture(s) and sexuality(ies) in ways that are not just historically conscious but also have a heuristic capacity to contest nativism from the outside as well as from within. The arguments in this book go beyond problematising African identity by addressing an existential gap in theory for explicating African social identity. The book develops an interpretive method – a hermeneutics – for locating and deciphering African identifications in ways that are historically conscious and conjunctural. The hermeneutics look to the present and the future in addition to the past, so that African identifications are not nailed to a mast but remain invested with mobility and the capacity to mutate radically and make new and unexpected beginnings
