    Judiciário, aborto e laicidade : análise das entrelinhas de um habeas corpus

Dizem respeito à história de Tatielle, mulher que, portando alvará judicial para interrupção de gravidez de feto incompatível com a vida extrauterina, viu-se impedida de fazê-lo devido a habeas corpus, a favor do feto, impetrado por padre Lodi, sacerdote católico. Decisão por nomear determinadas personagens do arquivo deriva de reflexão ética e metodológica. Suspensão do procedimento abortivo após início de indução impôs ao corpo de Tatielle sofrimento de onze dias. Às doze horas do décimo primeiro dia, nasceu sua filha, vindo a óbito uma hora e quarenta minutos depois. Entrelaçamento de voz do Estado e de empresa de salvação somada a silêncio sobre laicidade causa estranhamento que motiva a pesquisa. Este é um trabalho de pesquisa em arquivo e que se aproxima de princípios da micro história. Arquivo é mais do que conjunto de processos para análise: é organização metodológica e epistemológica que estrutura e dispõe discursos sobre a verdade e fluxos de poderes. O caso de Tatielle habitou contexto e temporalidades, devendo ser compreendido também nas relações que estabelece com outros casos específicos. Construo acepção complexa de laicidade, descartando noção meramente formal, para argumentar que seu esvaziamento, no arquivo, é condição à existência do habeas corpus e à caminhada da ação de reparação de danos como se deu. Para isso, preciso situar laicidade para além de categoria analítica: como parte do objeto de análise, garantindo densidade teórica e prática. Analiso o deslocamento da discussão sobre o aborto de feto incompatível com a vida extrauterina dos campos político e jurídico para o campo do emaranhamento moral e como isso determinou a caminhada do arquivo. Concluo que vozes do poder no arquivo esvaziam princípio da laicidade, propondo que se discuta apesar dele, levando à transcedentalidade de determinados argumentos; que letalidade de síndrome que aflige o feto perde importância diante desse direito transcedental à vida; e que nesse panorama, é possível a existência do arquivo como existiu até então, situado sobre dispositivo processual frágil e ecos de discursos empregados por empresa da salvação no campo argumentativo.This research was based on an archive which sews three lawsuits. They’re about the story of Tatielle, a woman that, carrying a judicial order to interrupt the gestation of a fetus incompatible with life outside the womb, found herself unable to do so due to an habeas corpus, in the fetus’ favor, filed by minister Lodi, a catholic priest. The decision to name certain characters of the archive derives from the an ethical and methodological reflection. Suspension of the abortive procedure after the induction started imposed an eleven day suffering period on Tatielles body. At twelve a.m. on the eleventh day, her daughter was born, coming to death an hour and forty minutes later. Entanglement of voices from the state and a salvation enterprise added to silence about secularism causes a weirdness which motivates this research. This is an archival research which approaches some of micro historys principles. Archive is more than a set of lawsuits to analyze: it is a methodological and epistemological organization which structures and disposes discourses about the truth and power flows. Tatielle’s story inhabited certain context and temporality, and should be understood also through the relations it maintains with other specific cases. I build a complex meaning to secularism, discarding merely formal notions, to reason that its emptying, in the archive, is a condition to the existence of the habeas corpus and the walking of the damage reparation lawsuit the way it went on. To do so, I must locate secularism beyond being an analytical category: it must be part of the object of analysis, granting it theoretical and practical density. I analyze the displacement of the discussion about the abortion of a fetus with no possible life outside the womb from the political and legal fields to the field of moral entanglement, and how it determined the archive’s walk. I conclude that voices of the power, in the archive, empty the principle of secularism, proposing the discussion to happen in spite of it, leading to the transcendentality of certain arguments; that the lethality of the syndrome that afflict the fetus loses importance before that transcendental right to life; and that, in this frame, it is possible for the archive to exist as it has, lying on a fragile procedural device and on echoes of speeches issued by salvation enterprises inside the argumentative field

    Treatment of idiopathic congenital clubfoot using the Ponseti method: ten years of experience

    AbstractObjectiveTo evaluate outcomes of 229 idiopathic clubfeet (ICF) treated using the Ponseti method, from 2001 to 2011, comparing two groups with different follow-ups.Method155 patients (229 ICF) were treated separated in two groups: Group I: 72 patients (109 ICF – 47.6%) with a follow up of 62 to 128 months (mean of 85). Group II: 83 patients (120 ICF – 52.4%) with a follow up of 4 to 57 months (mean of 33.5). We have considered satisfactory outcomes for cases which correction of all deformed components, without surgery.ResultsMean age for the initial assessment was 5.4 months in Group I and 3.2 in Group II. Satisfactory outcomes were obtained in 85.4% in Group I and 97.5% in Group II. Mean cast placements were 9.5 in Group I and 7 in Group II. 67% were submitted to percutaneous Achilles tenotomy in Group I and 65% in Group II. Deformity relapses, when using abducted braces, occurred in 41 (37.6%) feet from Group I; 11 were treated surgically. In Group II, 17 feet relapsed (14.1%); three of them were submitted to surgery.ConclusionThe method was successful in both groups, in low number of complications. The results were statistically superior in Group II when deformity correction, cast placements, relapses and surgery indication

    Morphologic changes of Paleozoic and Mesozoic insect faunas from Argentina and Brazil: paleoecologic aspects

    During the Permian-Triassic transition, the insect faunas from all over the world suffered changes related to their diversity and abundance, as well as to their morphometric patterns. The data were obtained from the original descriptions of each species. The total size of wing was considered, whereas the small fragments without estimative total size were not taken into account. The morphometric analysis of the recorded species of the Carboniferous- Permian-Triassic entomofauna from Argentina and Brazil shows a morphologic change that reflects a general trend of body size reduction. The groups that showed an inverse trend were Mecopteroidea and Coleoptera. The statistical analysis demonstrated a decreasing trend of the wing size of Paleoptera, Orthopteroidea, Blattopteromorpha and Hemipteroidea from Paleozoic to Mesozoic. Decreasing or increasing trends could be directly related with climate changes occurred during Permian-Triassic times. These changes could have caused ecologic nanism or gigantism, connected to food availability or other synergetic factors. A high gradient of temperature provides ideal conditions to a big rate of insect proliferation, supporting its diversity, while the extinctions are associated to environmental catastrophic events. At first sight, it could be interpreted that the trend of decreasing insect dimensions reflects the high levels of environmental stress already documented in the literature. However, alochronic speciation, as a result of ecologic nanism or gigantism, should also be considered when the real diversity of Permian-Triassic boundary insects is analysed.Simposio III: Ecosistemas triásicos, su paleobiología y el contexto de recuperación de la gran extinciónFacultad de Ciencias Naturales y Muse
