L'usage du droit comparé dans le raisonnement du juge : analyse en matière de droits fondamentaux au Canada et en Afrique du Sud
L’établissement de textes de droits fondamentaux dans de nombreux pays du
monde offre un terrain élargi d’observation pour le juge constitutionnel national interprétant
ces droits. Pour donner vie à ces textes, il arrive que les juges nationaux s’intéressent à leur
mise en application dans d’autres États.
Cette étude portera dans un premier temps sur la façon dont ces juges recourent à la technique
comparative. Ainsi, l’utilisation de cette méthode dans le raisonnement du juge est souvent
utile afin de s’inspirer du travail que d’autres ont effectué avant lui.
Deux États qui se distinguent par le recours à la technique comparative dans l’interprétation
de leurs textes fondamentaux sont le Canada et l’Afrique du Sud. Les juges des hautes
juridictions de ces pays recourent de façon régulière au droit comparé, offrant ainsi un terreau
fertile d’analyse de l’utilité, mais aussi, des limites de cette technique.
L’utilisation du droit comparé dans le raisonnement du juge est donc souvent justifiée, mais
est-elle toujours légitime ? Au cours de cette étude, nous nous intéresserons plus en
profondeur aux différents aspects concernant l’utilisation de la technique comparative par le
juge. Ainsi, nous observerons quelle est l’utilité du recours à cette méthode, mais aussi les
dangers que peut susciter l’utilisation du droit étranger dans l’interprétation des textes
fondamentaux nationaux.Establishing fundamental rights texts over a broad diversity of countries offers the
national constitutional judge a full field of study to interpret these rights. To give life to the
text itself, it is common that national judges focus a lot on the methods applied in other states.
This study will primarily be centered around how these judges use the comparative technique.
Therefore, the use of this method in the judge's reasoning can often be seen as useful in order
to be inspired by the work of others that came before him.
Two states that stand out by the way they use the comparative method in their fundamental
rights interpretation are Canada and South Africa. These two countries higher courts judges
are using this method in a recurrent way, and thus providing a fertile ground for the analysis
of the pros and cons, utilities and limits of this technique as a whole.
The use of comparative law in the judge's reasoning is thus often useful, but is it always
legitimate? Over the course of this study, we will dig deeper to take a closer look at the way
judges are using the comparative method. Thus, we will note the utility as well as the dangers
of resorting to foreign law in the practice of interpretating national fundamental texts
Axillary cerebral perfusion for arch surgery in acute type A dissection under moderate hypothermia
Backgound: Aortic arch surgery is still associated with increased mortality and morbidity especially in acute type A aortic dissection. Adequate brain protection is essential and commonly performed by either antegrade selective perfusion of the brachiocephalic arteries or an interval of profound hypothermic circulatory arrest. We present our experience for open aortic arch repair with continuous antegrade brain perfusion by means of direct cannulation of the right axillary artery, under moderate hypothermia in patients with acute type A aortic dissection. Methods: In, 25 consecutive patients (17 men) with a mean age of 62.6 ± 14.8 years, aortic repair extended to the arch, for acute type A aortic dissection, was performed through a midline sternotomy. The right axillary artery was used for arterial systemic and brain perfusion at a rectal temperature of 25-27 °C. Results: Mean duration of CPB and aortic cross-clamping was 241 ± 55 and 155 ± 72 min, respectively. The mean duration of circulatory arrest of the lower body and brain perfusion was 39.7 (range, 24-55 min). All the patients survived the procedure and all but one were discharged from hospital. One patient had left arm paralysis which he recovered the first postoperative month. There were no other transient or permanent neurologic deficits. A CT scan was performed at discharge for routine postoperative evaluation. There were no local neurovascular complications related to the cannulation site except for one local re-exploration for bleeding. Conclusions: The absence of any major permanent neurologic deficit or any visceral damages in our patients suggests that continuous moderate hypothermic cerebral perfusion, with an interval of circulatory arrest of the lower body, is adequate for acute type A aortic dissection surgery, allowing safe open repair of the distal aortic arc
Protective subpleural blanketing of intrathoracic esogastric anastomosis after esophagectomy
Esophagectomy followed by intrathoracic anastomosis is threatened by leakage which may prove all the more serious that mediastinal contamination is extensive. Incidence, risk factors and prognosis of changes in serum creatinine early after aortic abdominal surgery
Objective: To determine the incidence, risk factors, and prognostic implications of serum creatinine changes following major vascular surgery. Design: Observational study. Settings: University hospital. Patients: Cohort of 599 consecutive patients undergoing elective abdominal aortic surgery. Interventions: Review of prospectively collected data from 1993 to 2004. Measurements and results: The receiver-operator characteristic (ROC) curve analysis was used to detect the best threshold for postoperative elevation in serum creatinine (Δ Creat) in relation to major complications. Acut-off value of +0.5 mg/dl was selected to define renal dysfunction (RD0.5 group, n = 91; no RD0.5, n = 508) that was associated with higher mortality (7.7% in RD0.5 group vs 1.4% in no RD0.5 group, P  40 min; OR, 3.8, 95% CI, 1.9-7.2), blood transfusion (> 5 units; OR, 1.9, 95% CI 1.2-6.1), and rhabdomyolysis (OR, 3.6, 95% CI 1.7-7.9). Conclusions: Postoperative RD0.5 (Δ Creat  > 0.5 mg/dl) occurs in 15% of vascular patients and carries abad prognosis. Ligophorus pilengas n. sp. (monogenea: ancyrocephalidae) from the introduced so-iuy mullet, mugil soiuy (teleostei: mugilidae), in the sea of Azov and the Black sea
The monogenean Ligophorus chabaudi was originally described on the gills of the flathead mullet, Mugil cephalus, and was subsequently reported on the So-iuy mullet, Mugil soiuy. However, the morphology of sclerotized parts and multivariate statistical analyses suggest that the form from the So-iuy mullet represents a new species. This study provides a description of the new species Ligophorus pilengas n. sp. and provides additional morphological data concerning the morphology of the ventral bar that might be useful for the diagnosis of Ligophorus. Ligophorus pilengas n. sp. is the second species of Ligophorus reported on the So-iuy mullet. Zoogeographical records indicate that L. pilengas n. sp. was probably introduced to the Black Sea and the Sea of Azov from the western Pacific Ocean together with its host.Balbuena Diaz-Pines, Juan Antonio, [email protected]

Le présent exposé aborde en première partie le schéma général d’intervention mis en place
en Suisse pour faire face à une urgence radiologique. Seules les lignes générales sont
présentées, sans entrer dans les détails qui sont trop spécifiques et par là de peu
d’intérêt dans le cadre de cet article. Sont évoqués ensuite quelques problèmes
particuliers associés à l’intervention et qui ont donné lieu à des discussions lors de la
mise en place du plan d’intervention

Évaluation et surveillance des rejets radioactifs des installations nucléaires en Suisse
L'évaluation et la surveillance des rejets radioactifs des installations nucléaires
visent à garantir la protection de la population et de l'environnement vis-à -vis des
rayonnements ionisants. Répondre à cette préoccupation à la fois d'ordre
réglementaire, scientifique et d'information du public nécessite la mise en œuvre
d'un programme de contrôle fiable des rejets, d'une surveillance radiologique
vigilante dans l'environnement et d'un système d'information compréhensible du
public. L'acceptation des résultats et de leur interprétation par l'opinion requiert
que la surveillance des rejets et l'évaluation de leur impact soient confiées à des
organismes accrédités et indépendants des exploitants d'installations nucléaires.
C'est le cas en Suisse, où la loi et l'ordonnance de radioprotection stipulent que
l'Office fédéral de la santé publique (OFSP) est responsable de ces tâches en
collaboration avec les laboratoires cantonaux et les instituts universitaires. Cette
publication présente un aperçu des modalités actuelles d'évaluation de l'impact des
rejets des installations nucléaires suisses sur l'environnement et la population
avoisinante ainsi que du rôle et de l'organisation de la surveillance. Certains
