DISRUPTION ON REGIONAL ROAD MANAGEMENT
Abstract This paper describes the disruption of Directorate General of Highway, Ministry of Public Works and Housing, in improving the good governance and financing systems for the execution of regional road. Together with Australia Government through Indonesia Infrastructure Initiative Program, Directorate General of Highway made a grant program called Provincial Road Improvements and Maintenance in the Province of Nusa Tenggara Barat. This program is delivered through pre-financing by local budget and reimbursement grant scheme maximum of 40% by the Central Government with incentives around 10% from total program. Provincial Road Improvements and Maintenance applies good governance and open government principles by involving the road authorities, service provider, and road users through Road Transport and Traffic Forum.The Provincial Road Improvements and Maintenance program successfully improved the stability and service of roads in the Province of Nusa Tenggara Barat with the optimum budget. The program also encourages women participation in order to improve gender equality. As a result, Bappenas with the Ministry of Public Works and Housing and Ministry of Finance plan to replicate this program for the broader coverage in 2018. Bersama Pemerintah Australia, melalui Program Inisiatif Infrastruktur Indonesia, Direktorat Jenderal Bina Marga membuat program hibah yang disebut Provincial Road Improvements and Maintenance di Provinsi Nusa Tenggara Barat. Program ini disampaikan melalui pre-financing dengan skema kompensasi anggaran daerah dan penggantian maksimum sebesar 40% oleh Pemerintah Pusat dengan insentif sekitar 10% dari total program. Provincial Road Improvements and Maintenance menerapkan tata pemerintahan yang baik dan prinsip-prinsip pemerintahan yang terbuka dengan melibatkan pihak penyelenggara jalan, penyedia jasa, dan pengguna jalan melalui Forum Lalulintas Jalan. METODOLOGI ANALISIS MODEL SISTEM NERACA SOSIAL EKONOMI-AR SEBAGAI ALAT BANTU PERENCANAAN JARINGAN JALAN YANG BERKEADILAN
Abstract The development of road infrastructure network aims to support economic growth as well as equity. To design the right strategy in line with its objectives, it is necessary to measure the magnitude of the multiplier effect of road infrastructure development for descriptive and quantitative analyzes. This paper is intended to examine the use of the multiplier measurement methodology with the analysis model of the Interregional Social Accounting Matrix (IRSAM). Analyzes that can be done with IRSAM analysis model include income distribution, impact analysis of road network development policy. Keywords: road infrastructure, quantitative analysis, income distribution, social accounting matrix, road network development policy Abstrak Pengembangan jaringan infrastruktur jalan bertujuan untuk mendukung pertumbuhan ekonomi sekaligus pemerataan. Untuk merancang strategi yang tepat sesuai dengan tujuannya, perlu untuk diukur besarnya efek multiplier pembangunan infrastruktur jalan untuk dianalisis secara diskriptif dan kuantitatif. STANDARD OPERATING PROCEDURES OF THE INTEGRATED DESIGN AND BUILD TOLL ROAD CONSTRUCTION IN INDONESIA
Abstract The government is striving for planned toll roads to be realized so as to increase connectivity, competitiveness and lower logistics costs. In turn, the toll road can be the backbone that supports the growth of the national economy as well as the equitable distribution of development. Based on the review of Indonesia Toll Road Authority of the Ministry of Public Works and Housing in 2017, it is projected that Indonesia will have an additional 1,851 km of new toll roads by the end of 2019. The additional projection of the new toll road exceeds the targets set in the Strategic Plan of the Ministry of Public Works and Housing 2015-2019 as long as 1,060 km. The additional projection of new toll roads is possible besides the acceleration of land acquisition process through bailout fund by Toll Road Business Entity also introduced system delivery innovation by implementing Integrated Design and Build Constructions. Therefore, it needs to be equipped with Standard Operating Procedures for the Integrated Construction Design and Build on Toll Road Project in Indonesia. Pada gilirannya, jalan tol dapat menjadi tulang punggung yang mendukung pertumbuhan ekonomi nasional serta pemerataan pembangunan. Berdasarkan kajian Badan Pengatur Jalan Tol, Kementerian Pekerjaan Umum dan Perumahan Rakyat, pada 2017, diproyeksikan bahwa Indonesia akan memiliki tambahan 1.851 km jalan tol baru pada akhir 2019. Proyeksi tambahan jalan tol baru ini melebihi target yang ditetapkan dalam Rencana Strategis Kementerian Pekerjaan Umum dan Perumahan Rakyat 2015-2019, yaitu sepanjang 1.060 km. Proyeksi tambahan jalan tol baru dimungkinkan karena selain percepatan proses pembebasan tanah melalui dana talangan oleh Badan Usaha Jalan Tol juga diterapkannya sistem Design and Build Integrated Constructions. Review Of The Execution Of The Decision Of The Lubuklinggau State Court Number 15/Pdt.G/2018/Pn Llg
In 2018, there was a lawsuit filed by Asbiati and Murisa Binti Nang Agus as the Plaintiffs against PT. Buana Sriwijaya Sejahtera (PT. BSS) as Defendant I, Plantation Cooperation of Tritunggal Jaya as Defendant II, Regent of Musi Rawas Utara as Defendant III, and Village Head of Biaro Lama as Co-Defendant that was submitted to the Lubuklinggau District Court and had been decided in Decision Number: 15/ Pdt. G/2018/PN.Llg In the course, this decision could not be executed. This study discusses the reasons for the Lubuklinggau District Court Decision Number 15/Pdt.G/2018/PN.Llg which has permanent legal force (inkracht van gewijsde) cannot be executed, as well as discussing the obstacles to the execution of the Lubuklinggau District Court Decision Number 15/Pdt.G/2018/PNLlg. Execution is the implementation of a Court Decision which has permanent legal force (in kracht van gewijsde) which is carried out forcibly by the District Court where the parties file a lawsuit caused by the losing party in the case rejecting to comply with and to carry out the Court's Decision. The approach used in this study was a normative juridical approach. This study used secondary data obtained from primary and secondary legal materials. The results of this study describe a decision that cannot be executed because there is no argument in the Plaintiffs' lawsuit that places a confiscation of collateral (conservatoir beslaag), and confiscation of execution (excekutorial beslaag) for a decision that has permanent legal force (inkracht van gewijsde), so that the decision does not have executive power. While the obstacles that arise are in the form of the absence of a time limit that serves as a guide for the Head of the Lubuklinggau District Court to carry out and determine an execution of a decision, and the resistance by the executed party who does not want to voluntarily carry out the contents of the judge's decision.
IMPLEMENTATION OF CSR IN BENGKULU AFTER THE ISSUANCE OF THE BENGKULU GOVERNOR'S DECREE NUMBER: P.127.DINSOS. OF 2018 CONCERNING THE ESTABLISHMENT OF THE CSR FORUM OF BENGKULU PROVINCE
CSR is an element in improving people's welfare. Through the establishment of a CSR Forum which was established based on the Bengkulu Governor's Decree Number: P.127.Dinsos. In 2018 concerning the Establishment of the Bengkulu Province CSR Forum, the Regional Government seeks to increase the participation of every company in Bengkulu. However, the results have not been effective, this is because the formation of this forum was not accompanied by the authority and mechanism in the form of a Governor Regulation. Theimpact is that CSR implementation in Bengkulu Province is small and not focused. The problem in this research is how the implementation of CSR after the issuance of the Bengkulu Governor's Decree Number: P.127.Dinsos. 2018 concerning the Establishment of the Bengkulu Province CSR Forum and What Are the Obstacles in the implementation of the CSR forum. This type of research is empirical, data sources obtained from interviews, documents, as well as literature and legislation relevant to the research. The result of thisresearch is the finding of a 16% percentage of the participation rate of companies in Bengkulu, from a total of 196 companies in Bengkulu, only 33 companies registered by the CSR Forum have distributed CSR. The rest of this company never reported the distribution of CSR. This is very inconsistent with the Utilities Theory because large companies in Bengkulu Province have not contributed too much to the Environment and Society, and are still focused on Company Profits only. Furthermore, in the second discussion it was also conveyed that several obstacles were experienced by the CSR Forum, among others: The government has not yet embraced the forum in relation to companies, There is no Regulation on Implementation Mechanism in the Investment Law and the TDP Law, the Report Submission Mechanism is not Clearly, the absence of basic technical rules for implementing CSR reporting, absence of punishments and sanctions from the local government to companies for distributing CSR
CASE STUDY OF CLAIM AGAINST VIOLENCE IN HOUSEHOLD IN RELIGION COURT OF CLASS I A BENGKULU
This study aims to determine what factors cause one of the parties to commit domestic violence and how is the judge's consideration in completing the case for divorce due to domestic violence in the Class I A Bengkulu Religious Court. In this study the authors use a normative juridical approach, also called research on doctrinal law that is the law conceptualized as what is written in the legislation or law conceptualized as a rule or norm which is a benchmark of human behavior that is considered appropriate. In this study, what was sought was the decision of the Bengkulu Class Religion Court in deciding the case for divorce due to domestic violence. In this study the authors used a type of descriptive research, which is to provide as much detailed data as possible about human conditions or other symptoms. This descriptive method is intended to obtain a good, clear picture and can provide as much detailed data as possible about the object under study. In this case to describe the divorce due to domestic violence. The results of this study are expected to be used as a reference in conducting legal counseling in the city of Bengkulu to increase community legal awareness that domestic violence is contrary to applicable laws and regulations and as a reference material for the enrichment of civil law teaching materials in general and marriage law in general. especially
PERBANDINGAN KONTRAK JUAL BELI ELEKTRONIK MENURUT HUKUM POSITIF DAN HUKUM ISLAM
The purpose of this research is to find out and analyze the provisions of Islamic Law in buying and selling transactions in electronic contracts as well as legal protection of the parties in buying and selling transactions via electronic. Normative legal research is used in this study, because this research will examine and analyze various laws and regulations concerning sale and purchase agreements made via electronic based on positive law and Islamic law. The results of the research, namely agreements or transactions electronically in Indonesia, have generally been regulated by positive law, in particular the provisions regarding the engagement set out in Book III of the Civil Code and the Agreement in general, and are regulated in the electronic information and transaction regulation. Whereas in the applicable Islamic law in Indonesia, although this electronic transaction is not specifically regulated, the rules contained in Islamic law can be accommodated in terms of electronic transactions. However, in practice in the field there may be deficiencies related to electronic transaction activities, for example regarding legal protection for consumers / buyers. For this reason, it is necessary to make more specific regulations related to legal protection in terms of electronic transactions, considering that the electronic trading system is always increasing its transaction activities and it is necessary to establish an association of merchants / sellers electronically, especially sellers who use social networking media, so that parties merchand is more detectable
IMPLEMENTATION OF CONSUMER PROTECTION ON EXECUTION OF UNREGISTERED FIDUCIARY WARRANTYAT PT.FEDERAL INTERNATIONAL FINANCE (FIF) OF BENGKULU BRANCH
The execution of collateral in the financing institution as contained in the UUJF is clearly made by the creditor against the debtor whose is breach of contract, in which the execution of the creditor has a permanent legal forceand legitimate. However, for unregistered warranty in accordance with UUJFwould cause conflict. One of the conflicts that arises is the unprotected consumer rights. The purpose of this research is to understand and analyze the implementation of consumer protection on execution of fiduciary Warranty which is not registered at PT.Federal International Finance (FIF) of Bengkulu Branch. The method used was empirical juridical approach, by using qualitative analysis. Result of the research mentioned that implementation of consumer protection at execution of unregistered fiduciary Warranty at PT. Federal International Finance (FIF) of Bengkulu Branch was not in accordance with the provisions of applicable legislation where the execution of PT. Federal International Finance (FIF) of Bengkulu Branch was not accompanied by a fiduciary certificate and was not through previous mediation efforts so that the execution of non-registered fiduciary warrantyviolated the rights of the debtor as a consumer
