    Effect of Immigration & Naturalization Service v. Chadha on Executive Reorganization

    Three recent decisions by the United States Supreme Court, Immigration and Naturalization Service v. Chadha, Consumer Energy Council v. Federal Energy Regulatory Commission, and Consumers Union v. Federal Trade Commissions have altered the balance of power between Congress and the executive branch, invalidating a congressional check on executive power which had been in use for over fifty years. In an opinion in Chadha and by affirmance in the other cases, the Court held that under the separation of powers doctrine the legislative veto violated the presentment and bicameral requirements of the Constitution and thereby intruded on the province of the executive branch. The effect of these decisions extends far beyond the legality of the immigration, natural gas, and trade commission acts considered by the Court. There is every indication in Chadha and in the memorandum opinion affirming the other two cases that some 320 legislative veto provisions in approximately 210 laws are now invalid. The specific impact of Chadha and its progeny on the executive reorganization acts and possible congressional alternatives to the legislative veto for controlling administrative agency discretion are the subjects of this comment

After examining the patient, the physician will typically send the patient home with a prescription for medication or refer the patient for admission to an appropriate health care provider, such as a hospital. In either instance, the patient incurs medical bills. If the patient is age sixty-five or older, the federal government probably pays for most of those bills through the Medicare program

Subjects covered include writers who influenced Burns; aspects of the writing of Burns and that of his friends and contemporaries; and Burns\u27s influence on later writers. The volume also includes essays on Ross Roy\u27s own accomplishments and on the Burns collection he built (now at the University of South Carolina), together with a checklist of his published writings. G. Ross Roy, Distinguished Professor Emeritus of English and Comparative Literature, founded the journal Studies in Scottish Literature in 1963, and as its editor for nearly fifty years he has had a central role in establishing international academic recognition for the field. His own scholarly work includes the standard Letters of Robert Burns (2 vols., Clarendon Press, 1985). His contributions to Scottish literature have earned him honorary doctorates from the Universities of Edinburgh (2002) and Glasgow (2009). The contributors are all former W. Ormiston Roy Visiting Fellows at the University of South Carolina. This book is also available in a print edition (ISBN: 978-1439270974) through the usual on-line vendors.     The relationship between consistent/inconsistent identification data of gifted children and their self-concept

    The purpose of this study was to investigate the self-concept of two groups of gifted fourth, fifth, and sixth grade public school students. The relationship between the child's self-concept and the child's perception of the teacher rating was also studied, as was the child's perception of the teacher rating compared to the actual scores from the Teacher Rating Form. It was hypothesized that there would be no significant difference between the self-concept scores, as measured by the Piers-Harris Children's Self-Concept Scale (PHCSCS), of gifted students with consistent identification data and gifted students with inconsistent identification data. It was also hypothesized that there would be no significant relationship between the self-concept scores of gifted students and the partial scoring of the "My Thoughts on School" scale which was developed by the present researcher to measure the child's perception of the teacher rating. And finally it was hypothesized that there would be no significant relationship between the scores of gifted students on the Teacher Rating Form and the partial scoring of the "My Thoughts on School" scale

    About Time: Visualizing Time at Burning Man

    About Time was a 30 foot long, 3000 pound wooden sundial that went up in flames at Burning Man 2019. The piece reflected on the role time plays in our lives. We organize our lives around time—are enslaved to time—and yet we know so little about it. Physicists and philosophers continue to grapple with deep puzzles of time—Is time a fundamental quantity, independent of human actions or observations or is it an emergent property of our perception? This installation projected time using two sundials: a horizontal dial which swept time out across the desert floor and an equatorial dial located on one face of the pyramidal structure. A platform at the peak of the pyramid allowed observers to become the sundial’s apex and to experience 360° views of the landscape. A side doorway invited visitors inside, where they found interchangeable disks of pictographs and words that created shadows with shafts of light by day, and projected a fiery glow of LEDs at night. Exchanging the disks gave visitors control over the space and over time the installation evolved, altering the experience of subsequent visitors. At the end of the installation the piece was burned, a testament to the unidirectional march of entropy and time, underscoring the fleeting nature of the present moment
