Hästen - individ eller egendom? - En analys av djurskyddet för häst i Sverige

I rättsväsendet är djur att betrakta som saker och egendom. Detta medför att djur, när de är brottsoffer, inte får samma skydd som människor i samma situation. Syftet med denna uppsats har varit att undersöka djurskyddet för häst i Sverige samt den samhälleliga synen på hästen för att se hur väl dessa överensstämmer med det faktum att hästen är att betrakta som en sak i vårt rättssystem. Djurplågeristadgandet återfinns i 16 kap. 13 § brottsbalken och förbjuder att djur otillbörligen utsätts för lidande. Djurskyddslagen innehåller bestämmelser kring hur djur ska tas om hand för att behandlas väl. Det finns alltså relativt omfattande regleringar för att skydda hästen. För tävlingshästen finns också regler kring hur hästar ska behandlas i samband med träning och tävling. I takt med att synen på djuren i samhället har utvecklats har även lagarna förändrats i en riktning som syftar till att tillvarata hästens intressen. Hästen har gått från att vara ett arbetsdjur till att vara en kamrat och tävlingskompanjon. Rättsfall vittnar om att brott mot hästar tas på stort allvar och ofta används experter för att utvärdera hästens tillstånd. Samtidigt finns rättsfall som avslöjar att hästen ibland ses om en egendom vars intressen inte är lika viktiga som människans. Min utredning visar att synen på hästen i samhället, lagen och i de flesta rättsfall är att betrakta som en kännande individ och inte som en sak. För att denna syn ska speglas i vårt rättsväsende hade ett lagligt erkännande av hästen som en individ kunnat lösa många problem vid tillfällen då människans intressen ska vägas mot hästens.In our judicial system animals are accounted as objects and property. This results in that animals, when victims of crime, do not get the same protection as humans in the same position. The purpose of this essay is to examine the animal protection for horses in Sweden and the view our community has on horses to see how this conforms to the fact that horses are accounted as objects in our judicial system. The crime animal cruelty is in the 16th chapter 13th § of the Penal Code and forbids that animals are inadmissibly put through suffering. The law of animal protection contains directions regarding the care of animals. There are relatively extensive regulations to protect horses. For horses in competition there are also regulations regarding their caretaking in relation to training and competition. In step with the change of the view on animals in our community, the regulations have shifted with time towards protecting the horse’s interests more and more. The horse has gone from being a working animal to a friend and competition companion. Cases show that crimes against horses are taken very seriously and expert’s opinions are often used by the courts to evaluate the horse´s condition. Despite this there are cases that show that horses sometimes are considered as objects. My studies show that people’s view on horses and the regulations and most case law regarding animal protection tend to consider the horse as a feeling individual and not as property. For this common opinion to reflect in our judicial system a legal recognition of the horse as an individual could solve problems in weighing human interests against the best interests of the horse

Propionibacterium acnes and acne vulgaris: new insights from the integration of population genetic, multi-omic, biochemical and host-microbe studies.

The anaerobic bacterium Propionibacterium acnes is believed to play an important role in the pathophysiology of the common skin disease acne vulgaris. Over the last 10 years our understanding of the taxonomic and intraspecies diversity of this bacterium has increased tremendously, and with it the realisation that particular strains are associated with skin health while others appear related to disease. This extensive review will cover our current knowledge regarding the association of P. acnes phylogroups, clonal complexes and sequence types with acne vulgaris based on multilocus sequence typing of isolates, and direct ribotyping of the P. acnes strain population in skin microbiome samples based on 16S rDNA metagenomic data. We will also consider how multi-omic and biochemical studies have facilitated our understanding of P. acnes pathogenicity and interactions with the host, thus providing insights into why certain lineages appear to have a heightened capacity to contribute to acne vulgaris development, while others are positively associated with skin health. We conclude with a discussion of new therapeutic strategies that are currently under investigation for acne vulgaris, including vaccination, and consider the potential of these treatments to also perturb beneficial lineages of P. acnes on the skin
