Właściwość miejscowa rzecznika dyscyplinarnego uczelni w postępowaniu w sprawie deliktu dyscyplinarnego popełnionego przez byłego nauczyciela akademickiego
Podstawę odpowiedzialności dyscyplinarnej nauczycieli akademickich stanowią przepisy
Ustawy z dnia 20 lipca 2018 r. Prawo o szkolnictwie wyższym i nauce. Zgodnie
z art. 275 § 1 Ustawy nauczyciel akademicki podlega odpowiedzialności dyscyplinarnej
za przewinienie dyscyplinarne stanowiące czyn uchybiający obowiązkom nauczyciela
akademickiego lub godności zawodu nauczyciela akademickiego. Z kolei zgodnie
z art. 275 § 2 ustawy ustanie zatrudnienia w uczelni nie wyłącza odpowiedzialności dyscyplinarnej za przewinienie dyscyplinarne popełnione w trakcie tego zatrudnienia.
Wykładnia tego przepisu prowadzi do wniosku, że odpowiedzialności dyscyplinarnej
podlegać może zarówno osoba zatrudniona w uczelni i posiadająca w dacie wszczęcia
postępowania w sprawie dyscyplinarnej status nauczyciela akademickiego, jak i osoba
niezatrudniona w uczelni, która status nauczyciela akademickiego posiadała w przeszłości
i utraciła go na skutek ustania zatrudnienia w szkolnictwie wyższym. Przedmiotem
niniejszego artykułu jest problematyka właściwości miejscowej rzecznika dyscyplinarnego
uczelni prowadzącego postępowanie wyjaśniające w przedmiocie odpowiedzialności
dyscyplinarnej byłego nauczyciela akademickiego. Na podstawie wykładni językowej
§ 2 ust. 2 Rozporządzenia Ministra Nauki i Szkolnictwa Wyższego z dnia 25 września
2018 r. w sprawie szczegółowego trybu prowadzenia mediacji, postępowania wyjaśniającego
i postępowania dyscyplinarnego w sprawach odpowiedzialności dyscyplinarnej
nauczycieli akademickich należy przyjąć, że postępowanie wyjaśniające i postępowanie
dyscyplinarne w pierwszej instancji wobec byłego nauczyciela akademickiego prowadzi
się w uczelni, która w przeszłości zatrudniała nauczyciela akademickiego podejrzewanego
o delikt dyscyplinarny, a której rektor lub rzecznik dyscyplinarny powziął wiadomość
o popełnieniu czynu mającego znamiona przewinienia dyscyplinarnego.The basis for disciplinary liability of academic teachers lies in the provisions of the
Higher Education and Science Act of July 20, 2018. According to Article 275 § 1 of
the Act, an academic teacher is subject to disciplinary liability for a disciplinary offense
constituting an act that infringes the duties of an academic teacher or the dignity of the
academic teacher’s profession. In turn, according to Article 275 § 2 of the Act, termination
of employment at the university does not exclude disciplinary liability for a disciplinary
misconduct committed in the course of that employment. The interpretation
of this provision leads to the conclusion that both a person employed at the university
and having the status of an academic teacher on the date of instituting disciplinary
proceedings, and a person not employed at the university who had the status of an academic
teacher in the past and lost it as a result of termination of their employment in
higher education may be subject to disciplinary liability. The subject of this article are
issues concerning the jurisdiction of the local disciplinary proceedings representative
of the university conducting an inquiry into the disciplinary responsibility of a former
academic teacher. On the basis of the linguistic interpretation of § 2 sec. 2 of the Regulation
of the Minister of Science and Higher Education of 25 September 2018 on the
detailed mode of mediation, explanatory proceedings and disciplinary proceedings in
matters of disciplinary liability of academic teachers, it should be assumed that the firstinstance
explanatory proceedings and disciplinary proceedings against a former academic
teacher are conducted at a university which in the past employed the academic
teacher suspected of a disciplinary offense, and whose rector or disciplinary proceedings
representative became aware of an act constituting a disciplinary offense

Spoczywanie terminu przedawnienia w prawie karnym
La suspension du terme de la prescription dans le droit pénal polonais, autant
que dans la plupart des législations à l'étranger, consiste en l'apparition d'un
obstacle — défini par la loi — causant un délai dans le cours du terme de prescription
sur qui au moment, où l'obstacle cesse d'agir le terme de la prescription
reprend son cours, mais le temps de la durée de cette circonstance ne peut être
inclu dans la période nécessaire à l'apparition de la prescription.
Le droit polonais reconnaît le terme de la prescription par rapport à l'intentation
de la procédure pénale et de la presciption ou rémission du terme de
prescription par rapport à l'exécution de la pénalité.
En vue du règlement de l'art. 88 du code pénal la rémission du terme de la
prescription par rapport à l'intentation de la procédure pénale et de la prescription
du jugement forment des circonstances qui, d'après la loi ne permettent pas
d'intenter ni de continuer la procédure pénale. Ceci n'inclu pas, néanmoins, le
manque de pétition ou plainte privée. Il en résulte le problème si l'apparition
de circonstances de fait qui effectuent la suspension du procès pénal (art. 4 du
code pénal) arrête le cours du terme en appui à l'art. 87 du code pénal, ou bien
si par contre ceci n'a pas lieu. Ce problème doit être résolu de la manière
suivante: le règlement de l'art. 88 du code pénal sous-entend uniquement des
circonstances juridiques, et non de circonstances de fait prévues dans l'art. 4
du code pénal. L'obstacle à caractère de fait peut causer la rémission du terme
de prescription de l'art. 86 ou 87 du code pénal uniquement dans les cas, où un
règlement exprès et spécial en décide (par example l'art. 65 ou 66 du c. p. W. P.).
La rémission des termes ci-dessus mentionnés est effectuée par: l'immunité des
députés (art. 16, règlements 3 de la Constitution de la République Polonaise
Populaire), l'immunité des juges (art. 49 du règlement concernant le régime des
cours judiciaires générales), l'immunité des employés de la Chambre Suprême
de Contrôle (art. 21 du règl, du 13 12 1957 concernant la Chambre Suprême de
Contrôle). La rémission cesse d'agir du moment que l'immunité a été abolie par
une autorité compétente. Cette sorte de permission de poursuivre l'imputé
doit être sollicitée par l'accusateur (art. 2 § 2 du c. p.).
La suspension du terme de la prescription concernant l'exécution de la pénalité,
défini par l'art. 89 du c. p. est effectuée par: un délai et une interruption de
l'exécution de la pénalité, une suspension conditionnelle de l'exécution de la
pénalité, l'exécution de la pénalité, et l'application d'une mesure d'assurance. ■
Le décret du 22 4 1964 concernant l'introduction de la suspension du terme de
la prescription en rapport aux grands criminels hitlériens (Dz. U. nr 15, pos. 86)
constitue un cas exceptionnel. Conformément à ce décret la prescription prévue
dans les règlements art. 86 et 87 du c. p. n'est pas en vigueur pour les crimes
définis par l'art. 1, règl. 1 du décret du 31 8 1944 concernant l'application de la
pénalité aux criminels fascistes hitlériens fautifs de meutres ou de cruautés
exercées sur la population civile et les prisonniers de guerre, ainsi qu'aux traîtres
envers la nation polonaise, si le procès ne fut pas intenté ou poursuivit par
suite de ce que le criminel, se trouvant à l'étranger, ne fut pas révèle, ou bien

Commencing a private prosecution and the grounds for dismissing a lay judge from his function
Instytucja udziału czynnika społecznego w sprawowaniu wymiaru sprawiedliwości ma w Polsce długą i ugruntowaną tradycję. Zgodnie z art. 4 ustawy Prawo o ustroju sądów powszechnych obywatele biorą udział w sprawowaniu wymiaru sprawiedliwości poprzez uczestnictwo ławników w rozpoznawaniu spraw przed sądami w pierwszej instancji. Ławników wybierają rady gminy na czteroletnią kadencję. Odwołanie ławnika przed upływem kadencji jest możliwe w przypadkach enumeratywnie wymienionych w ustawie. W niniejszym artykule podjęto próbę analizy zagadnienia wpływu okoliczności wszczęcia przeciwko ławnikowi postępowania karnego z oskarżenia prywatnego na możliwość odwołania ławnika z pełnionej funkcji na wniosek prezesa sądu. W artykule postawiono następujące problemy i zagadnienia: czy wszczęcie przeciwko ławnikowi sądu powszechnego postępowania karnego o przestępstwo ścigane z oskarżenia prywatnego stanowi podstawę do odwołania ławnika przez radę gminy?; czy wszczęcie przeciwko osobie postępowania karnego o przestępstwo ścigane z oskarżenia prywatnego uniemożliwia tej osobie kandydowanie na funkcję ławnika sądu powszechnego?; czy osoba kandydująca na funkcję ławnika sądu powszechnego ma obowiązek ujawnienia w toku procedury wyboru ławników (przed dokonaniem wyboru przez radę gminy), że toczy się przeciwko niej postępowanie karne z oskarżenia prywatnego? Poczynione przez autorów ustalenia prowadzą do konkluzji, iż w przypadku wszczęcia przeciwko ławnikowi postępowania karnego o charakterze prywatnoskargowym przepis art. 166 § 2 pkt 3 ustawy Prawo o ustroju sądów powszechnych nie ma zastosowania, a okoliczność postawienia ławnika w stan oskarżenia wskutek wniesienia do sądu prywatnego aktu oskarżenia nie powinna stanowić podstawy wniosku prezesa sądu do rady gminy o odwołanie ławnika z pełnionej funkcji.The institution of the participation of the social factor in the justice in Poland
has a long and well-established tradition. In accordance with Art. 4 of the Law on the System
of Common Courts, citizens take part in administering justice through the participation of
lay judges in hearing cases before courts in the first instance. The jurors are elected by the
borough councils for a four-year term. Dismissal of a lay judge before the end of his term of
office is possible in the cases enumerated in the Act. This article attempts to analyse the issue
of the impact of the circumstances of instituting private indictment against a lay judge on
the possibility of dismissing a lay judge from his function at the request of the president of
the court. The article presents the following problems and issues: is the initiation of a general criminal procedure against a lay judge for an offense prosecuted on a private indictment
basis for the dismissal of a lay judge by the municipal council?; Does instituting criminal
proceedings against a person for an offense prosecuted by private indictment prevent that
person from standing for the post of a common court lay judge? Is a person running for the
post of a common court lay judge obliged to disclose in the course of the procedure of electing lay judges (before being elected by the borough council) that there are private criminal
proceedings against that person? The findings made by the authors lead to the conclusion
that in the event of instituting private criminal proceedings against a lay judge, the provision
of Art. 166 § 2 point 3 of the Act on the System of Common Courts does not apply, and the
fact of prosecuting a lay judge as a result of bringing a private indictment to a court should
not constitute the basis for a motion by the president of the court to the municipal council
to dismiss a lay judge from his function
