European Works Councils during the financial and economic crisis: Activation, stagnation or disintegration?
The article compares changes in the European Works Councils (EWCs) at Ford and General Motors Europe during the financial and economic crisis. Previously, both were highly active and effective. Although both otherwise displayed quite different characteristics before the crisis, their reactions were quite similar. At both companies, competition and mistrust among representatives increased, resulting in a decline of integration and effectiveness. We explore the importance of personal relations as preconditions for stability and effectiveness in EWCs
'Kollegiale ArbeitnehmerĂŒberlassung': Chancen und Probleme des zwischenbetrieblichen Personaltransfers auf Basis von TarifvertrĂ€gen
"Angesichts der Ausweitung des Leiharbeitseinsatzes, der zum Teil mit negativen Folgen fĂŒr die Arbeitnehmer verbunden sein kann, suchen Gewerkschaften nach Möglichkeiten zur 'Humanisierung' der Leiharbeit. Eine bislang wenig beachtete Alternative zur Leiharbeit stellt dabei die sog. 'kollegiale ArbeitnehmerĂŒberlassung' dar, die auf Basis eines Tarifvertrages den Austausch von Personal zwischen Unternehmen ermöglicht. Anhand von zwei Fallbeispielen wird untersucht, unter welchen Bedingungen kollegiale ArbeitnehmerĂŒberlassung funktioniert und welche Folgen diese Form des Personaltransfers fĂŒr Betriebe und BeschĂ€ftigte besitzen kann. Die Ergebnisse zeigen, dass kollegiale ArbeitnehmerĂŒberlassung eine gewerkschaftliche Strategie gegen die möglichen negativen Folgen gewerblicher Leiharbeit und gleichzeitig ein (zusĂ€tzliches) Instrument fĂŒr Unternehmen sein kann, um die PersonalflexibilitĂ€t zu erhöhen." Because of the sometimes negative consequences concerning the working conditions of employees, trade unions seek options for a humanization' of temporary work. However, alternatives of traditional temporary work have so far not been discussed or analyzed adequately. One legal alternative is temporary work, which is based on collective agreements. The paper examines this relatively new instrument of external flexibility on the basis of two case studies. The structures and processes as well as the working conditions and the benefits for firms are analyzed. The results demonstrate that personal leasing based on collective agreements can be a reasonable strategy for trade unions and for companies to enhance flexibility and cope with some problems of traditional temporary work." "Kollektive betriebliche Interessenregulierung findet in vielen privatwirtschaftlichen Betrieben in Form sog. 'Anderer Vertretungsorgane' (AVOs) statt. Diese Interessenvertretung 'jenseits des Betriebsrats' erlangt in jĂŒngerer Zeit vermehrt Beachtung in der Arbeits- und Industriesoziologie. Die empirische Forschung fokussierte dabei einerseits auf die Interessenregulierungsstrukturen in Sektoren mit hochqualifizierter BeschĂ€ftigung wie der New Economy, anderseits wurden mit Hilfe von Breitenerhebungen Fragen der Verbreitung, Kontextbedingungen und internen Strukturen dieser Gremien untersucht. Kaum systematische Beachtung fand dabei die Tatsache, dass AVOs keine homogene Gruppe von Interessenvertretungsorganen darstellen. This form of employee representation outside the legal system of Works Councils has been attracting attention in industrial relations research in recent years. Some empirical studies have focussed on patterns of interest regulation in sectors of qualified labor and the 'New Economy'; other research has used survey methods to analyze the distribution, contextual factors, and internal structures of alternative representation bodies. Until now, the diversity of form and function of these bodies has not been sufficiently recognized. In this respect, they are unlike works councils which are founded and act according to the Works Constitution Act (Betriebsverfassungsgesetz) - an exclusive model of interest representation. BetriebsrÀte und 'Andere Vertretungsorgane': Verbreitung und Kontext betrieblicher BeschÀftigtenvertretungen in der deutschen Privatwirtschaft
"Ăber die Verbreitung und Kontextbedingungen von BetriebsrĂ€ten und betriebsverfassungsrechtlich nicht abgesicherten 'Anderen Vertretungsorganen' (AVOs) liegen nur wenige durch empirische Breitenerhebungen gesicherte Informationen vor. Der Beitrag untersucht diese Aspekte auf Basis einer fĂŒr Deutschland reprĂ€sentativen Erhebung von rund 3.200 Betrieben der Privatwirtschaft. Mit Hilfe theoretischer VorĂŒberlegungen werden mögliche Einflussfaktoren in verschiedenen Konzepten der Industrial Relations- und Organisationsforschung verortet und systematisiert. Die Untersuchung zeigt, dass jeweils unterschiedliche Kontextfaktoren die Betriebrats- und AVO-Existenz erklĂ€ren: WĂ€hrend BetriebsrĂ€te vor allem Ausdruck von BetriebsgröĂen- und Branchendifferenzen, betrieblichen Entwicklungspfaden und berufskulturellen Orientierungen der BeschĂ€ftigten sind, stehen AVOs in engem Zusammenhang mit der Beteiligungsstrategie des Managements und betriebskulturellen Faktoren." (Autorenreferat)"There is little empirically validated knowledge about the coverage and contextual factors of workplace level employee representation - works councils (WC) and other representation bodies (ORBs) which are not legally based on the German Works Constitution Act. This article analyses both aspects by exploiting a representative survey data of approximately 3.200 workplaces in the German private sector. Coverage and contextual factors of employee representation structures are examined from the perspective of various theoretical models derived from industrial relations and organisational research. The article concludes that contextual factors differ considerably between WCs and ORBs: While the incidence of WCs depends mainly on firm size, industry, path dependence and employee related factors, the existence of ORBs is first of all related to the participation strategy of management and aspects of company culture." Kampf um Mitbestimmung: Antworten auf "Union Busting" und die Behinderung von BetriebsrÀten
Wenn Arbeitgeber*innen systematisch gegen BetriebsrĂ€te und Gewerkschaften vorgehen und damit grundlegendes Arbeitsrecht unter Druck gerĂ€t, stellt sich die Frage, wie Belegschaften und Interessenvertretungen auf diese Angriffe noch reagieren können. Entlang von betrieblichen Fallstudien dokumentieren die Autor*innen exemplarische FĂ€lle und arbeiten Potenziale und Herausforderungen der Mitbestimmung heraus. Dabei wird u.a. erörtert, was mit einer möglichen Einleitung rechtlicher Schritte einhergeht, wie ĂŒber eine forcierte Ăffentlichkeitsarbeit erfolgreich SolidaritĂ€t organisiert werden kann und wie wichtig die aktive Einbeziehung der Belegschaft im Kampf um Mitbestimmung ist
(Ent-)Demokratisierung der Betriebe â Union Busting und der Kampf um die Mitbestimmung
Der Beitrag untersucht sogenannte âUnion Busting-Methodenâ, bei denen Arbeitgeber*innen BeschĂ€ftigte von der Wahl eines Betriebsrates abzuhalten versuchen, die Arbeit eines vorhandenen Betriebsrats erschweren oder die gewerkschaftliche Organisierung behindern, indem sie â im weitesten Sinne â systematisch und wiederholt gesetzliche Regelungen missachten oder sogar bewusst ĂŒberschreiten. ZunĂ€chst wird der gesellschaftspolitische Kontext erörtert und anschlieĂend Befunde vorhandener Studien vorgestellt und diskutiert. Der Beitrag schlieĂt mit einem Vorschlag fĂŒr erste Systematisierungen, die im Rahmen eines laufenden Forschungsprojekts zur Anwendung kommen
NormierungslĂŒcken in der hybriden Arbeit: Postpandemische Arbeitszeitkulturen und die Repersonalisierung von Kontrolle am Beispiel der öffentlichen Verwaltung
Der Beitrag beleuchtet den durch hybride Arbeitsformen induzierten Wandel von Normen und Praktiken der Arbeitszeit, Anwesenheit und VerfĂŒgbarkeit innerhalb eines Landesministeriums. Die untersuchte Behörde hatte bereits vor der Pandemie mit der Umsetzung einer umfangreichen Digitalisierungsstrategie begonnen. Allerdings zeigt sich, dass sowohl formelle Vorgaben als auch informelle, organisationsĂŒbergreifende Verhaltenserwartungen eine nur lose Orientierungsgrundlage fĂŒr das Arbeitszeit- und Kontrollhandeln der BeschĂ€ftigten bereitstellen. Diese NormierungslĂŒcken fĂŒhren im Ergebnis zu einer hohen Varianz der Arbeitszeitkulturen innerhalb der Organisation. WĂ€hrend zwar Autonomiepotenziale im hybriden Arbeiten liegen, stĂ€rkt die Repersonalisierung der Arbeitsbeziehungen in diesem Fall vielmehr die Machtposition der Vorgesetzten und fĂŒhrt zu einem gesteigerten Stress-, Unsicherheits- und Ungerechtigkeitsempfinden.This paper examines the change of practices and norms of working time, workplace attendance and online availability resulting from the establishment of hybrid forms of work, within a state ministry. The examined authority had already begun implementing a wide-ranging digiti(li)zation strategy prior to the pandemic. However, established formal regulations as well as overarching informal behavioral expectations provide only loose guidance for memberâs time and control practices. These gaps of normalization result in a high variance of working time cultures within the organization. While hybrid work opens up potentials for autonomy, in this case it strengthens foremost the power position of superiors and evokes a growing sense of stress, insecurity and injustice among subordinates
Single Femtosecond Laser-Pulse-Induced Superficial Amorphization and Re-Crystallization of Silicon
21 pags., 9 figs., 1 tab. -- This article belongs to the Special Issue Advanced Pulse Laser Machining TechnologySuperficial amorphization and re-crystallization of silicon in and orientation after irradiation by femtosecond laser pulses (790 nm, 30 fs) are studied using optical imaging and transmission electron microscopy. Spectroscopic imaging ellipsometry (SIE) allows fast data acquisition at multiple wavelengths and provides experimental data for calculating nanometric amorphous layer thickness profiles with micrometric lateral resolution based on a thin-film layer model. For a radially Gaussian laser beam and at moderate peak fluences above the melting and below the ablation thresholds, laterally parabolic amorphous layer profiles with maximum thicknesses of several tens of nanometers were quantitatively attained. The accuracy of the calculations is verified experimentally by high-resolution transmission electron microscopy (HRTEM) and energy dispersive X-ray spectroscopy (STEM-EDX). The Logic of Collective Participation in Establishments without a Works Council. Patterns and Influence Opportunities of Non-statutory Employee Representation in Germany
Einige Breitenerhebungen und Fallstudien haben grundlegende Erkenntnisse ĂŒber Formen, Funktionen und Entstehungskontexte kollektiver Interessenvertretungsorgane auf Betriebsebene, die keine BetriebsrĂ€te sind und oftmals als âAndere Vertretungsorganeâ (AVOs) bezeichnet werden, generiert. Der vorliegende Beitrag möchte zur Debatte beitragen, indem dezidiert Unterschiede in den Partizipationsmustern verschiedener AVO-Typen untersucht werden. Auf diese Weise soll ein genaueres VerstĂ€ndnis divergenter âLogikenâ kollektiver Interessenvertretung ermöglicht werden. Ausgangspunkt ist eine Typologie unterschiedlicher Funktionen von AVOs: Der erste Typ umfasst von der GeschĂ€ftsleitung initiierte âInstrumente im Leistungsprozessâ, die auf die Steigerung der betrieblichen Effizienz abzielen. Der zweite Typus wird als âBeteiligungsorganâ tituliert, in dessen Zentrum die Interessenvertretung der abhĂ€ngig BeschĂ€ftigten steht. Es wird argumentiert, dass die Interessenvertretungschancen von AVOs wesentlich mit dem AVO-Typus, der Kultur der Austauschbeziehungen und den Haltungen und Strategien der beteiligten Akteure variieren. WĂ€hrend die âInstrumente im Leistungsprozessâ hinsichtlich ihrer Beteiligungspraxis einer Logik von durch die GeschĂ€ftsleitung âangeordneter Partizipationâ folgen, handelt es sich bei den âBeteiligungsorganenâ um (von den BeschĂ€ftigten) âerkĂ€mpfteâ bzw. (von der GeschĂ€ftsleitung) âtolerierteâ Partizipation.Surveys and case studies have provided a basic understanding of patterns, functions and context conditions of collective employee representation bodies at firm level in Germany which are not works councils, but non-statutory forms of employee representation (NSRs). This paper aims to contribute to the literature by analyzing differences in the participation patterns of different NSRtypes. The starting point is a typology of different functions of NSRs: The first type comprises management-initiated âpersonnel management instrumentsâ aimed at increasing operational efficiency. The second type is called âparticipation bodiesâ, which represent the interests of employees. It is argued that the influence opportunities of NSRs vary significantly depending on NSR type, company culture, and attitudes and strategies of key the actors involved. While âpersonnel management instrumentsâ follow a logic of âmandatory participationâ, âparticipation bodiesâ are characterized by participation which has been âhard wonâ by employees and is âtoleratedâ by management
