La sécurité du consommateur au Québec… deux solitudes : mesures préventives et sanctions civiles des atteintes à la sécurité
La sécurité de la personne et des biens du consommateur constitue un corollaire incontournable du développement des produits et services qui lui sont offerts. Dans le présent article, les auteures veulent démontrer que, tout en suscitant un intérêt marqué de la part du législateur et des tribunaux, la sécurité des consommateurs soulève des difficultés importantes du point de vue de la cohérence, en mettant en parallèle les règles préventives et celles qui sont propres aux sanctions civiles. Cette analyse croisée fait ressortir non seulement des différences fondamentales entre ces deux registres d’intervention, mais également des incohérences notables à l’intérieur de chacun d’eux. Dans le contexte des règles préventives, les différents paliers législatifs privilégient l’énoncé de règles précises et bien délimitées, plutôt qu’un principe général de sécurité des usagers. Les sanctions civiles, quant à elles, sont marquées par une multiplicité de règles qui résulte de la coexistence du régime contractuel (de droit commun ou issu de la Loi sur la protection du consommateur) et du régime extracontractuel. Ce déficit de cohérence, de façon plus globale, se présente comme un obstacle à l’objectif de protection de la sécurité auquel le consommateur devrait pouvoir légitimement aspirer.As new products and services continue to be developed and offered to consumers, it is essential to protect the personal safety of consumers and the security of their property. This paper attempts to demonstrate that while this issue is considered important by legislators and judges, significant difficulties remain, owing to a lack of coherency in the law, which becomes apparent when one analyses the preventive rules set in place concomitantly with applicable civil sanctions. Not only does this comparative analysis emphasize the fundamental differences underlying both sets of rules, it also illustrates the important inconsistencies found in each of them. With regard to preventive rules, the various legislatures prefer the drafting of strict and well demarcated rules rather than adopting a general principle respecting consumer safety. As for civil sanctions, they are characterized by a multiplicity of rules resulting from the coexistence of contract law (emanating from the general law or the Consumer Protection Act) and extracontractual liability. Generally speaking, this lack of consistency proves to be an obstacle hindering the objective of protecting the security to which consumers should legitimately be entitled
L'encadrement juridique des nanotechnologies au Canada et dans l'Union européenne
Les nanotechnologies ont, depuis quelques années, envahi le marché et chaque jour, de nouveaux produits nano-technologiques, décrits comme plus robustes, plus pratiques et plus performants, sont offerts aux consommateurs. La mise sur le marché de produits de consommation nano-technologiques interpelle pourtant à plus d'un titre et pose de nombreux défis à la société et aux citoyens, parmi lesquels la question des risques éventuels pour la santé des consommateurs et pour l'environnement. Les dangers posés par certaines nanoparticules et l'insuffisance des connaissances permettant d'évaluer leur toxicité réelle sont confirmés par de nombreuses études scientifiques. La situation est à ce point préoccupante que les compagnies d'assurance placent les risques liés aux nanotechnologies dans la catégorie des risques les plus graves parmi l'ensemble des risques émergents. Ce mémoire porte sur une analyse comparative des cadres politiques et juridiques mis en place au Canada et dans l'Union européenne en vue de prévenir les risques liés à l'usage de nanotechnologies dans les produits de consommation. L'intervention politique dans ce domaine, tant au Canada qu'en Europe, est dominée par la volonté de soutenir massivement le développement des nanotechnologies et par des impératifs de compétitivité. Au-delà des proclamations d'intention, l'Union européenne et le Canada n'ont cessé de reporter à plus tard les initiatives visant à réglementer les nanotechnologies. Ni le Canada, ni l'Union européenne, si l'on excepte, pour cette dernière, le secteur des cosmétiques, ne disposent, à l'heure actuelle, de réglementation spécifique aux nanotechnologies. Par ailleurs, les législations existantes visant à assurer la sécurité des consommateurs et la protection de l'environnement, s'avèrent non adaptées aux caractéristiques des nanomatériaux et ne permettent pas de prévenir adéquatement les risques posés par les nanoparticules. Les experts s'entendent pourtant sur les questions prioritaires à régler pour protéger la santé des citoyens et l'environnement. La politique du laissez-faire menée actuellement est d'autant moins acceptable que tant le Canada que les institutions européennes clament leur souhait de garantir un niveau élevé de protection des personnes et de l'environnement. Dans l'attente d'un cadre législatif approprié, la présente recherche explore les voies possibles d'un encadrement adéquat des nanotechnologies et d'une meilleure prise en compte, au plan juridique, des risques que le recours à ces technologies nouvelles pose pour la santé des consommateurs et l'environnement. \ud

The Clinical Utility of a Precision Medicine Blood Test Incorporating Age, Sex, and Gene Expression for Evaluating Women with Stable Symptoms Suggestive of Obstructive Coronary Artery Disease: Analysis from the PRESET Registry.
Background: Evaluating women with symptoms suggestive of coronary artery disease (CAD) remains challenging. A blood-based precision medicine test yielding an age/sex/gene expression score (ASGES) has shown clinical validity in the diagnosis of obstructive CAD. We assessed the effect of the ASGES on the management of women with suspected obstructive CAD in a community-based registry. Materials and Methods: The prospective PRESET (A Registry to Evaluate Patterns of Care Associated with the Use of Corus® CAD in Real World Clinical Care Settings) Registry (NCT01677156) enrolled 566 patients presenting with symptoms suggestive of stable obstructive CAD from 21 United States primary care practices from 2012 to 2014. Demographics, clinical characteristics, and referrals to cardiology or further functional and/or anatomical cardiac studies after ASGES testing were collected for this subgroup analysis of women from the PRESET Registry. Patients were followed for 1-year post-ASGES testing. Results: This study cohort included 288 women with a median age 57 years. The median body mass index was 29.2, with hyperlipidemia and hypertension present in 48% and 43% of patients, respectively. Median ASGES was 8.5 (range 1-40), with 218 (76%) patients having low (≤15) ASGES. Clinicians referred 9% (20/218) low ASGES versus 44% (31/70) elevated ASGES women for further cardiac evaluation (odds ratio 0.14, p < 0.0001, adjusted for patient demographics and clinical covariates). Across the score range, higher ASGES were associated with a higher likelihood of posttest cardiac referral. At 1-year follow-up, low ASGES women experienced fewer major adverse cardiac events than elevated ASGES women (1.3% vs. 4.2% respectively, p = 0.16). Conclusions: Incorporation of ASGES into the diagnostic workup demonstrated clinical utility by helping clinicians identify women less likely to benefit from further cardiac evaluation
A novel hybrid organosolv: steam explosion method for the efficient fractionation and pretreatment of birch biomass
Background:
The main role of pretreatment is to reduce the natural biomass recalcitrance and thus enhance sac-
charification yield. A further prerequisite for efficient utilization of all biomass components is their efficient fractiona-
tion into well-defined process streams. Currently available pretreatment methods only partially fulfill these criteria.
Steam explosion, for example, excels as a pretreatment method but has limited potential for fractionation, whereas
organosolv is excellent for delignification but offers poor biomass deconstruction.
Results:
In this article, a hybrid method combining the cooking and fractionation of conventional organosolv pre
-
treatment with the implementation of an explosive discharge of the cooking mixture at the end of pretreatment was
developed. The effects of various pretreatment parameters (ethanol content, duration, and addition of sulfuric acid)
were evaluated. Pretreatment of birch at 200
°C with 60%
v/v ethanol and 1%
w/w
biomass
H
2
SO
4
was proven to be the
most efficient pretreatment condition yielding pretreated solids with 77.9%
w/w cellulose, 8.9%
w/w hemicellulose,
and 7.0
w/w lignin content. Under these conditions, high delignification of 86.2% was demonstrated. The recovered
lignin was of high purity, with cellulose and hemicellulose contents not exceeding 0.31 and 3.25%
w/w, respectively,
and ash to be <
0.17%
w/w in all cases, making it suitable for various applications. The pretreated solids presented
high saccharification yields, reaching 68% at low enzyme load (6
FPU/g) and complete saccharification at high
enzyme load (22.5
FPU/g). Finally, simultaneous saccharification and fermentation (SSF) at 20%
w/w solids yielded an
ethanol titer of 80
g/L after 192
h, corresponding to 90% of the theoretical maximum.
Conclusions:
The novel hybrid method developed in this study allowed for the efficient fractionation of birch
biomass and production of pretreated solids with high cellulose and low lignin contents. Moreover, the explosive dis-
charge at the end of pretreatment had a positive effect on enzymatic saccharification, resulting in high hydrolyzability
of the
pretreated solids and elevated ethanol titers in the
following high-gravity SSF. To the best of our knowledge,
the ethanol concentration obtained with this method is the highest so far for birch biomass
