In the interpretation of any statute, there are at least three sources of understanding one can look to: the text, the legislators who penned it, and the judges who interpret it. The methodological problem for lawyers is how to make use of each source of knowledge in attempting to know the law. Defending Defenders: Remarks on Nichol and Pierce

Both Nichol and Pierce, as devotees of grand theory, are interested in analyzing Scalia\u27s agenda, however described. They view Defenders as a fundamental change in the Court\u27s standing jurisprudence, in part because of the symbolism they and their fellow detractors impart to the decision. In contrast, the author is apparently a miniaturist, at least when it comes to the possibility of grand theories and broader agendas. Like Justice Kennedy, the author does not read Justice Scalia\u27s opinion to hold that Congress cannot confer standing by defining an injury and relating it to a class of persons entitled to sue

The Academy of Dental Materials: Providing roots and wings.

ObjectivesThe long history of the Academy of Dental Materials (ADM) is documented with its strategies (a) to rapidly communicate science among its members, (b) to establish special awards to stimulate new science, and (c) to develop new dental materials scientists.MethodsWe searched the history of the last 35 years of the ADM newsletters, transactions, journals, and officer notes. We document the (a) presidents, (b) meeting history, (c) membership growth, and (d) development of special awards through 2019 with the recent creation of the ADM Marshall Post-Doctoral Award.ResultsThere are 36 years of recent ADM history, 42 international meetings, membership growth to 400 individuals from 15 countries, service of 19 presidents, Paffenbarger annual Awardees since 1989, induction of >200 fellows, and recognition of the first winner of Marshall Post-Doctoral Award in 2018. New directions for recruiting members are suggested. Three potential new thrusts for the organization are presented: artificial intelligence, genetic engineering, and intensive member mentoring.SignificanceThese suggestions for the ADM provide a path for the ADM to continue to adapt to the ever changing scientific landscape

Developmental trends in voice onset time: some evidence for sex differences

This study reports on an investigation into the voice onset time (VOT) patterns of the plosives /p b t d/ in a group of 30 children aged 7 (n = 10), 9 (n = 10) and 11 (n = 10) years. Equal numbers of girls and boys participated in the study. Each child named a series of letter objects to elicit /p b t d/ in a syllable onset position with a fixed vowel context. VOT data were examined for age, sex and plosive differences with the following hypotheses: Firstly, that there would be sex differences in the VOT patterns of preadolescent children. Secondly, that the sex differences in VOT patterns would be linked to age and development, and that these would eventually become marked by the age of 11 years, by which time adult-like VOT values should have been achieved. Finally, that the extent of sex and age differences would be dependent upon the plosive being investigated. Results indicated patterns of decrease with age in the VOT values of /p b/ for the boys, with some evidence of increases in the VOT values of /t/ for the girls. In addition, 'voiced' and 'voiceless' cognates showed a more marked bimodal distribution in the girls' VOT patterns. This bimodal distribution was investigated by examining the degree of difference between the VOT values of voiced and voiceless cognate pairs /p b/ and /t d/, and examining the effects of age, sex and cognate pair. These results indicated that more marked sex differences in the 'voiced'/'voiceless' contrast emerged between the data of the 9- and 11-year-olds, a pattern, which was more marked for the alveolar plosives. These preliminary results confirmed all three hypotheses. The findings are presented and discussed both within a developmental and sociophonetic framework

The use and function of gestures in word-finding difficulties in aphasia

Background: Gestures are spontaneous hand and arm movements that are part of everyday communication. The roles of gestures in communication are disputed. Most agree that they augment the information conveyed in speech. More contentiously, some argue that they facilitate speech, particularly when word-finding difficulties (WFD) occur. Exploring gestures in aphasia may further illuminate their role. Aims: This study explored the spontaneous use of gestures in the conversation of participants with aphasia (PWA) and neurologically healthy participants (NHP). It aimed to examine the facilitative role of gesture by determining whether gestures particularly accompanied WFD and whether those difficulties were resolved. Methods & Procedures: Spontaneous conversation data were collected from 20 PWA and 21 NHP. Video samples were analysed for gesture production, speech production, and WFD. Analysis 1 examined whether the production of semantically rich gestures in these conversations was affected by whether the person had aphasia, and/or whether there were difficulties in the accompanying speech. Analysis 2 identified all WFD in the data and examined whether these were more likely to be resolved if accompanied by a gesture, again for both groups of participants. Outcomes & Results: Semantically rich gestures were frequently employed by both groups of participants, but with no effect of group. There was an effect of the accompanying speech, with gestures occurring most commonly alongside resolved WFD. An interaction showed that this was particularly the case for PWA. NHP, on the other hand, employed semantically rich gestures most frequently alongside fluent speech. Analysis 2 showed that WFD were common in both groups of participants. Unsurprisingly, these were more likely to be resolved for NHP than PWA. For both groups, resolution was more likely if a WFD was accompanied by a gesture. Conclusions: These findings shed light on the different functions of gesture within conversation. They highlight the importance of gesture during WFD, both in aphasic and neurologically healthy language, and suggest that gesture may facilitate word retrieval

Automated pre-processing strategies for species occurrence data used in biodiversity modelling

To construct Biodiversity richness maps from Environmental Niche Models (ENMs) of thousands of species is time consuming. A separate species occurrence data pre-processing phase enables the experimenter to control test AUC score variance due to species dataset size. Besides, removing duplicate occurrences and points with missing environmental data, we discuss the need for coordinate precision, wide dispersion, temporal and synonymity filters. After species data filtering, the final task of a pre-processing phase should be the automatic generation of species occurrence datasets which can then be directly ’plugged-in’ to the ENM. A software application capable of carrying out all these tasks will be a valuable time-saver particularly for large scale biodiversity studies

Infinite-Dimensional Lie Algebras of Generalized Block Type

This paper investigates a class of infinite-dimensional Lie algebras over a field of characteristic 0 which are called here Lie algebras of generalized Block type, and which generalize a class of Lie algebras originally defined by Richard Block. Under certain natural restrictions, this class of Lie algebras is shown to break into five subclasses. One of these subclasses contains all generalized Cartan type K Lie algebras and some Lie algebras of generalized Cartan type H, and a second one is the class of Lie algebras type L, which were previously defined and studied elsewhere by the authors.
