    Kepailitan Badan Hukum Bum Desa Dalam Peraturan Perundang-Undangan Di Indonesia

    Abstract: The Village Autonomy Provides the widest possible authority to the village to explore and manage the economic potensial of the village, including by forming village owned enterprises (BUM Desa). After the issuance of government Regulation of Law No. 2 of 2022 concerning job creation which recently Received validation as a law, there has been a charge in the institutional aspect of village Owned Enterprises (BUM Desa). BUM Desa, which previously only existed as a business entity, has now transformed into a legal entity. The legal entity form of BUM Desa is different from other legal entity forms in Indonesia, such as Limited Liability Company, State-Owned Enterpries, and Cooperatives. The Transformation from a more business entity to a legal entity has legal implications not only institutionally, but also in term of legal relationships with other parties. As s legal entity, BUM Desa is also granted authority to establish legal entity based business units. These legal implications may lead to bankruptcy Of BUM Desa if not managed properly. However, there is currently no adequate legal framework that regulates in detail the mechanism for filing bankruptcy petition to the commercial court to declare BUM Desa Bankrupt, and the legal consequences of BUM Desa being declared bankrupt, including related to its assets, wealth, and organizational structure. This research uses a doctrinal and theoretical legal research method with an approach to legislation and conceptual concepts. The Conclusion of this research is that more detailed regulations are needed regarding the legal entity form of BUM Desa, especially concerning bankruptcy of BUM Desa. Keywords: BUM Desa, legal Entity, Bankruptcy.  Abstrak: Otonomi Desa memberikan kewenangan seluas-luasnya kepada Desa untuk menggali dan mengelola potensi ekonomi desa, salah satunya dengan membentuk Badan Usaha Milik Desa (BUM Desa). Pasca terbitnya Peraturan Pemerintah Pengganti Undang-Undang No. 2 Tahun 2022 Tentang Cipta Kerja yang beberapa waktu yang lalu mendapatkan pengesahan menjadi undang-undang, terjadi perubahan secara kelembagaan mengenai BUM Desa. BUM Desa yang sebelumnya hanya berbentuk badan usaha, sudah berganti menjadi badan hukum. Bentuk badan hukum BUM Desa berbeda dengan badan usaha yang berbentuk badan hukum yang sudah terdapat di Indonesia seperti Perseroan Terbatas, Perusahaan Umum dan Koperasi. Perubahan bentuk dari hanya Badan Usaha menjadi Badan Hukum memiliki implikasi yuridis tidak hanya secara kelembagaan, tetapi juga hubungan hukum dengan pihak lain. BUM Desa sebagai badan hukum juga diberikan kewenangan untuk membentuk unit usaha yang berbadan hukum. Implikasi yuridis ini dapat berujung terhadap kepailitan BUM Desa apabila tidak dikelola dengan baik. Namun, belum terdapat pranata hukum yang memadai yang mengatur secara terperinci mengenai mekanisme permohonan kepada pengadilan niaga agar BUM Desa dinyatakan pailit dan akibat hukum BUM Desa dinyatakan pailit, baik terkait mengenai aset, kekayaaan maupun organ BUM Desa. Penelitian ini menggunakan metode penelitian hukum doktrinal dan teoritis dengan pendekatan peraturan perundang-undangan dan konseptual. Kesimpulan dari penelitian ini adalah diperlukan peraturan yang lebih terperinci mengenai bentuk badan hukum BUM Desa, terutama mengenai kepailitan BUM Desa.     Versatile regularisation toolkit for iterative image reconstruction with proximal splitting algorithms

    Ill-posed image recovery requires regularisation to ensure stability. The presented open-source regularisation toolkit consists of state-of-the-art variational algorithms which can be embedded in a plug-and-play fashion into the general framework of proximal splitting methods. The packaged regularisers aim to satisfy various prior expectations of the investigated objects, e.g., their structural characteristics, smooth or non-smooth surface morphology. The flexibility of the toolkit helps with the design of more advanced model-based iterative reconstruction methods for different imaging modalities while operating with simpler building blocks. The toolkit is written for CPU and GPU architectures and wrapped for Python/MATLAB. We demonstrate the functionality of the toolkit in application to Positron Emission Tomography (PET) and X-ray synchrotron computed tomography (CT)

    Common activation of canonical Wnt signaling in pancreatic adenocarcinoma.

    Pancreatic ductal adenocarcinoma (PDA) is an extremely aggressive malignancy, which carries a dismal prognosis. Activating mutations of the Kras gene are common to the vast majority of human PDA. In addition, recent studies have demonstrated that embryonic signaling pathway such as Hedgehog and Notch are inappropriately upregulated in this disease. The role of another embryonic signaling pathway, namely the canonical Wnt cascade, is still controversial. Here, we use gene array analysis as a platform to demonstrate general activation of the canonical arm of the Wnt pathway in human PDA. Furthermore, we provide evidence for Wnt activation in mouse models of pancreatic cancer. Our results also indicate that Wnt signaling might be activated downstream of Hedgehog signaling, which is an early event in PDA evolution. Wnt inhibition blocked proliferation and induced apoptosis of cultured adenocarcinoma cells, thereby providing evidence to support the development of novel therapeutical strategies for Wnt inhibition in pancreatic adenocarcinoma

Consequently, significant research efforts have been dedicated to understanding and mitigating vibrations in timber structures, while scientific committees strive to establish suitable design regulations. This study aims to classify and identify the main research themes related to timber structure vibrations and highlight future research needs and directions. A bibliometricbased selection process briefly introduces each research topic, presenting the latest findings and proposals for vibration design in timber structures. The paper emphasizes the key outcomes and significant contributions to understanding and addressing vibration issues in timber structures. These findings serve as valuable guidance for researchers, designers, and regulatory bodies involved in designing and assessing timber structures subjected to vibrations

    Assessing Measurable Residual Disease in Chronic Myeloid Leukemia. BCR-ABL1 IS in the Avant-Garde of Molecular Hematology

    Chronic myelogenous leukemia (CML) is a malignancy of the myeloid cell lineage characterized by a recurrent chromosomal abnormality: the Philadelphia chromosome, which results from the reciprocal translocation of the chromosomes 9 and 22. The Philadelphia chromosome contains a fusion gene called BCR-ABL1. The BCR-ABL1 codes for an aberrantly functioning tyrosine kinase that drives the malignant proliferation of the founding clone. The advent of tyrosine kinase inhibitors (TKI) represents a landmark in the treatment of CML, that has led to tremendous improvement in the remission and survival rates. Since the introduction of imatinib, the first TKI, several other TKI have been approved that further broadened the arsenal against CML. Patients treated with TKIs require sensitive monitoring of BCR-ABL1 transcripts with quantitative real-time polymerase chain reaction (qRT-PCT), which has become an essential part of managing patients with CML. In this review, we discuss the importance of the BCR-ABL1 assay, and we highlight the growing importance of BCR-ABL1 dynamics. We also introduce a mathematical correction for the BCR-ABL1 assay that could help homogenizing the use of the ABL1 as a control gene. Finally, we discuss the growing body of evidence concerning treatment-free remission. Along with the continuous improvement in the therapeutic arsenal against CML, the molecular monitoring of CML represents the avant-garde in the struggle to make CML a curable disease

    Characterization of speech and language phenotype in GLUT1DS

    Background: To analyze the oral motor, speech and language phenotype in a sample of pediatric patients with GLUT 1 transporter deficiency syndrome (GLUT1DS). Methods: eight Italian-speaking children with GLUT1DS (aged 4.6–15.4 years) in stable treatment with ketogenic diet from a variable time underwent a specific and standardized speech and language assessment battery. Results: All patients showed deficits with different degrees of impairment in multiple speech and language areas. In particular, orofacial praxis, parallel and total movements were the most impaired in the oromotor domain; in the speech domain patients obtained a poor performance in the diadochokinesis rate and in the repetition of words that resulted as severely deficient in seven out of eight patients; in the language domain the most affected abilities were semantic/phonological fluency and receptive grammar. Conclusions: GLUT1DS is associated to different levels of speech and language impairment, which should guide diagnostic and therapeutic intervention. Larger population data are needed to identify more precisely a speech and language profile in GLUT1DS patients

    Rv0579 Is Involved in the Resistance to the TP053 Antitubercular Prodrug

    Tuberculosis remains one of the leading causes of death from a single pathogen globally. It is estimated that 1/4 of the world’s population harbors latent tuberculosis, but only a 5–10% of patients will develop active disease. During latent infection, Mycobacterium tuberculosis can persist unaffected by drugs for years in a non-replicating state with low metabolic activity. The rate of the successful tuberculosis treatment is curbed by the presence of these non-replicating bacilli that can resuscitate after decades and also by the spread of M. tuberculosis drug-resistant strains. International agencies, including the World Health Organization, urge the international community to combat this global health emergency. The thienopyrimidine TP053 is a promising new antitubercular lead compound highly active against both replicating and non-replicating M. tuberculosis cells, with an in vitro MIC of 0.125 mg/ml. TP053 is a prodrug activated by the reduced form of the mycothiol-dependent reductase Mrx2, encoded by Rv2466c gene. After its activation, TP053 releases nitric oxide and a highly reactive metabolite, explaining its activity also against M. tuberculosis non-replicating cells. In this work, a new mechanism of TP053 resistance was discovered. M. tuberculosis spontaneous mutants resistant to TP053 were isolated harboring the mutation L240V in Rv0579, a protein with unknown function, but without mutation in Rv2466c gene. Recombineering method demonstrated that this mutation is linked to TP053 resistance. To better characterize Rv0579, the protein was recombinantly produced in Escherichia coli and a direct interaction between the Mrx2 activated TP053 and Rv0579 was shown by an innovative target-fishing experiment based on click chemistry. Thanks to achieved results, a possible contribution of Rv0579 in M. tuberculosis RNA metabolism was hypothesized, linked to toxin antitoxin system. Overall, these data confirm the role of Rv0579 in TP053 resistance and consequently in the metabolism of this prodrug

    Long-Term Resveratrol Supplementation as a Secondary Prophylaxis for Stroke

    Stroke is a leading cause of mortality worldwide, as well as a source of long-term disabilities and huge socioeconomic costs. This study investigates the effects of resveratrol, an antioxidant supplement, on blood pressure, weight status, glucose, and lipid profile in patients who had a stroke in the last 12 months. Two hundred and twenty-eight patients were divided into three groups: group I received only allopathic treatment (control group), while groups II and III received allopathic treatment with a daily supplementation of oral resveratrol (100 and 200 mg, resp.) for 12 months. In all groups, the changes of the studied parameters were monitored at 6 and 12 months from the initial evaluation. In groups II and III, resveratrol induced significant changes (p<0.05) in the blood pressure, body mass index, as well as all parameters of the lipid profile, and glucose (in nondiabetic patients), compared to the control group. The supplementation of the allopathic treatment with resveratrol had a beneficial effect on all monitored parameters, which serve as major risk factors for stroke

    A New Limit on the Neutrinoless DBD of 130Te

    We report the present results of CUORICINO a cryogenic experiment on neutrinoless double beta decay (DBD) of 130Te consisting of an array of 62 crystals of TeO2 with a total active mass of 40.7 kg. The array is framed inside of a dilution refrigerator, heavily shielded against environmental radioactivity and high-energy neutrons, and operated at a temperature of ~8 mK in the Gran Sasso Underground Laboratory. Temperature pulses induced by particle interacting in the crystals are recorded and measured by means of Neutron Transmutation Doped thermistors. The gain of each bolometer is stabilized with voltage pulses developed by a high stability pulse generator across heater resistors put in thermal contact with the absorber. The calibration is performed by means of two thoriated wires routinely inserted in the set-up. No evidence for a peak indicating neutrinoless DBD of 130Te is detected and a 90% C.L. lower limit of 1.8E24 years is set for the lifetime of this process. Taking largely into account the uncertainties in the theoretical values of nuclear matrix elements, this implies an upper boud on the effective mass of the electron neutrino ranging from 0.2 to 1.1 eV. This sensitivity is similar to those of the 76Ge experiments.Comment: 4 pages, 2 figure
