The Reach of the SEC Under Rule 10b-5 Is Further Restricted: Negligent Conduct Is Insufficient to Warrant Commission Instigated Injunctive Relief

In a recent decision the United States District Court for the Sourthern District of New York seemingly broke with Second Circuit precedent to hold that the SEC must prove scienter to get an injunction under Rule lOb-5. The author suggests that the district court\u27s decision is reconcilable with recent second Circuit decisions and presents reasons why the district court\u27s holding should be adopted by the Second Circuit

Photoinduced Fano-resonance of coherent phonons in zinc

Utilizing femtosecond optical pump-probe technique, we have studied transient Fano-resonance in zinc. At high excitation levels the Fourier spectrum of the coherent E$_{2g}$ phonon exhibits strongly asymmetric line shape, which is well modeled by the Fano function. The Fano parameter (1/Q) was found to be strongly excitation fluence dependent while depending weakly on the initial lattice temperature. We attribute the origin of the Fano-resonance to the coupling of coherent phonon to the electronic continuum, with their transition probabilities strongly renormalized in the vicinity of the photoinduced structural transition.Comment: 5 pages, 3 figures, to be published in Physical Review

Distributed computing system with dual independent communications paths between computers and employing split tokens

This is a distributed computing system providing flexible fault tolerance; ease of software design and concurrency specification; and dynamic balance of the loads. The system comprises a plurality of computers each having a first input/output interface and a second input/output interface for interfacing to communications networks each second input/output interface including a bypass for bypassing the associated computer. A global communications network interconnects the first input/output interfaces for providing each computer the ability to broadcast messages simultaneously to the remainder of the computers. A meshwork communications network interconnects the second input/output interfaces providing each computer with the ability to establish a communications link with another of the computers bypassing the remainder of computers. Each computer is controlled by a resident copy of a common operating system. Communications between respective ones of computers is by means of split tokens each having a moving first portion which is sent from computer to computer and a resident second portion which is disposed in the memory of at least one of computer and wherein the location of the second portion is part of the first portion. The split tokens represent both functions to be executed by the computers and data to be employed in the execution of the functions. The first input/output interfaces each include logic for detecting a collision between messages and for terminating the broadcasting of a message whereby collisions between messages are detected and avoided

A Note on the Toda Criterion for Interacting Dipole-Quadrupole Vibrations

Free Field Dynamics in the Generalized AdS (Super)Space

Pure gauge representation for general vacuum background fields (Cartan forms) in the generalized $AdS$ superspace identified with $OSp(L,M)$ is found. This allows us to formulate dynamics of free massless fields in the generalized $AdS$ space-time and to find their (generalized) conformal and higher spin field transformation laws. Generic solution of the field equations is also constructed explicitly.
