La STS 246/2017 de 23 de marzo, o cómo el Tribunal Supremo anula de un plumazo la jurisprudencia de la audiencia nacional sobre el control de la jornada laboral y las horas extraordinarias

[Resumen] El artículo analiza la novedad que ha supuesto el reciente fallo de la STS 246/2017, de 23 de marzo, que anula la acción fiscalizadora de la Dirección General de Inspección de Trabajo que se llevaba a cabo a partir de dos sentencias de la Sala de lo Social de la Audiencia Nacional. La decisión del Supremo invalida la obligación de las empresas de llevanza de registros obligatorios en aras a la cuantificación de horas mensuales realizadas por sus trabajadores –y no sólo de las horas extraordinarias-. Se estudian los métodos de control usados habitualmente por los empresarios; se trata el sempiterno conflicto entre el poder de dirección del empleador y la posible colisión con los derechos fundamentales de los trabajadores; se examina la doctrina jurisprudencial más reciente al respecto; la particular cuestión del control presencial de los trabajadores y cómo se lleva a cabo en la actualidad con los más avanzados sistemas biométricos. Para finalizar, se entra en el examen jurídico de las dos sentencias de la Audiencia Nacional (207/2015 y 25/2016) y la sentencia 246/2017 del T.S. En último término, se ponen de manifiesto las conclusiones a las que hemos llegado, vertiendo nuestras humildes opiniones tras el estudio de los aspectos anteriormente referenciados[Abstract] The article analyzes the changes brought about by a March 23, 2017 decision of the Tribunal Supremo (246/2017) that invalidates inspections performed by the Dirección General de Inspección de Trabajo pursuant to two earlier decisions issued by the Audiencia Nacional. The decision of the Tribunal Supremo invalidates the obligation of companies to maintain mandatory records of the monthly hours worked by its employees -and not merely of overtime hours worked-. The article studies the control methods habitually used by business owners; considers the conflict between a managers’ power to direct the activities of his employees and the fundamental rights of those employees; examines the most recent jurisprudence in this respect; and considers issues related to the continued need for managers to monitor employees in the face of more advanced biometric systems. The article also discusses the effects and consequences resulting from the inconsistent legal conclusions articulated in the decisions of the Audiencia Nacional (207/2015 and 25/2016) and the decision 246/2017 of the Tribunal Supremo. Finally, we express our conclusions and opinions in light of the referenced issue

Gestión Administrativa en la Atención de los Pacientes Asegurados Al SIS. CLAS Santa Elena-Ayacucho. 2018

La tesis tuvo como objetivo: determinar la relación entre la gestión administrativa y la satisfacción de los pacientes asegurados al SIS. Clas Santa Elena-Ayacucho. 2018; para ello se realizó una investigación de nivel descriptiva, correlacional, diseño no experimental de corte transversal. La población estuvo conformada por los pacientes asegurados al SIS que asisten al Clas Santa Elena, de la que se obtuvo una muestra aleatoria conformada por 58 pacientes que acudieron durante la semana del 16 al 21 de julio de 2018, ascendiendo a 58 pacientes. Se empleó como técnica la encuesta y como instrumento el cuestionario; cuya validez de Pearson fue de 0.47 para la variable gestión administrativa y 0.52 para satisfacción de la atención; en tanto que el alfa de Cronbach fue 0,931 y 0,767, respectivamente. Los resultados indican una relación significativa directa fuert (Tau B=0,877; p=0,000) entre la gestión administrativa y la satisfacción de los pacientes asegurados al SIS. Clas Santa Elena-Ayacucho. 2018; llegando a las conclusiones que existe una relación significativa directa entre la eficiencia del recurso humano con la satisfacción de los pacientes asegurados al SIS. Clas Santa Elena-Ayacucho. 2018 (Tau B=0,892), afirmando que la eficiencia del recurso humano influye en la satisfacción de los pacientes asegurados al SIS; la correlación entre el trabajo en equipo con la satisfacción de los pacientes asegurados al SIS. Clas Santa Elena-Ayacucho. 2018; es significativa directa (Tau B=0,741), afirmando que hay influencia del trabajo en equipo en la satisfacción de los pacientes, aceptando la hipótesis alterna (p=0.000). Se determinó que la correlación entre la respuesta al cliente con la satisfacción de los pacientes asegurados al SIS. Nurses and treaties of paediatrics at Madrid of the eighteenth century

Throughout the eighteenth century the debate between mother breastfeeding and mercenary breastfeeding is spread. The figure of the nurse happens to be questioned by the medical science. The physiological discoveries about the female body are fixed in their reproductive function exclusively.
