A prestação jurisdicional efetiva e o dano moral: análise de casos e a valoração das condenações nas negativas de procedimentos cirúrgicos bucomaxilofacial no âmbito do TJDFT
A recusa da solicitação de um serviço de saúde pelas operadoras privadas abre ao consumidor a possibilidade de uma prestação jurisdicional para o cumprimento da obrigação contratual, bem como a possibilidade de arbitramento de quantia a ser paga em razão do dano moral sofrido pelo segurado. Muito se discute a respeito das balizas norteadores para a fixação do dano moral, quando existentes, diante da ausência de ato normativo que disciplina tal instituto. O prejuÃzo da negativa de cobertura dos planos de saúde afetam não só o patrimônio da pessoa, como também os direitos da personalidade. Por esta razão, é muito importante o papel do juiz na interpretação jurÃdica para o conceito e adequação do dano moral, para que seja confirmado a prestação jurisdicional efetiva com o devido cumprimento da finalidade do instituto, atendendo a duração razoável da demanda, bem como os meios processuais aptos a proporcionar os objetivos do processo. Contudo, diante das peculiaridades de cada caso, os órgãos julgadores adotam critérios nas ações de obrigação de fazer combinadas com pedido de dano moral, que necessitam ser aperfeiçoadas, especialmente nos casos que envolvem a prestação do serviço de saúde em cirurgias bucomaxilofacial, levando em consideração o crescente número de pedidos dessa natureza no âmbito forense
Pregnancy and perinatal outcomes in women with renal transplantation
PURPOSE: to evaluate the relationship between renal transplantation and pregnancy through the analysis of clinical and obstetric intercurrent events and perinatal outcomes. METHODS: a retrospective series of 39 cases of pregnancy in 37 women with renal transplantation from January 1997 to December 2003 was evaluated. A control group consisted of 66 pregnant women with no previous clinical pathologies. This group received prenatal care and these patients delivered during 2002 and 2003. Preeclampsia, premature rupture of membranes, premature delivery, and intrauterine growth restriction were used to compare these variables. Demographic characteristics of these groups were related to the mean age at conception, ethnic characteristics and obstetric past. Regarding renal transplantation the type of donator and used immunosuppressive drugs were evaluated. The studied clinical variables were chronic hypertension, anemia and urinary tract infection. The interval between the surgery and conception, occurrence of dysfunction, rejection and loss of the allograft were characteristcs related to the allograft. Obstetric variables were related to the type of delivery, incidence of preeclampsia and premature rupture of membranes. Perinatal outcomes were premature delivery and intrauterine growth restriction and these results were compared with renal function. The used statistical methods were the chi2 and Fisher's exact tests. The significance level was fixed always as less than or equal to 0.05 (5%). RESULTS: the mean age at conception was 27 years. The live donator was the most frequent among the patients. Among the immunosuppressive drugs, cyclosporine was the most used. Chronic hypertension occurred in 82% of the cases, anemia in 77% and urinary tract infection in 38.5%. The incidence of renal dysfunction was 47.4% and preeclampsia was the main cause. The loss of the renal transplantation occurred in 10.2%. Delivery by cesarean section was performed in 53.8% of the patients, and the main causes were hypertensive syndromes. Preeclampsia occurred in 28.2%. Among the perinatal outcomes, premature delivery occurred in 46.1% of the cases, with a significant relation to creatinine level greater than or equal to 1.5 mg/dL at the start of prenatal care. Another observed intercurrent event was intrauterine growth restriction, which occurred in 41.0%, and here we found no relation between this event and creatinine levels. CONCLUSIONS: young patients constituted the study group. Chronic hypertension, anemia and urinary tract infection were very common. Renal dysfunction was frequent and must be investigated during prenatal care. There were four cases of loss of the transplant due to clinical or obstetric causes. Cesarean delivery had the highest incidence, but vaginal delivery should be the first choice in these cases. Preeclampsia occurred very frequently and this complication should be considered as a high risk. Preterm delivery and intrauterine growth restriction were the main perinatal complications. Premature deliveries before 37 weeks of gestation were related to allograft function.OBJETIVO: avaliar as inter-relações recÃprocas entre o transplante renal e a gravidez por meio da análise das intercorrências clÃnicas e obstétricas, bem como da investigação do desfecho perinatal. MÉTODOS: foi analisada série retrospectiva de 39 casos de gestação em 37 portadoras de transplante renal no perÃodo de janeiro de 1997 a dezembro de 2003. Foi criado um grupo controle composto por 66 grávidas sem doenças clÃnicas prévias, que freqüentaram pré-natal e deram à luz em 2002 e 2003. Esse grupo foi utilizado para possÃveis comparações para as variáveis pré-eclâmpsia, ruptura prematura de membranas, prematuridade e crescimento intra-uterino restrito. Como caracterÃsticas demográficas dos dois grupos foram relatados média de idade no momento da concepção, raça e os antecedentes obstétricos. Quanto à s caracterÃsticas do transplante relatamos o tipo de doador e o esquema imunossupressor utilizado. As variáveis clÃnicas estudadas foram hipertensão arterial crônica, anemia e infecção do trato urinário. As variáveis relativas ao transplante foram o intervalo entre a cirurgia e a concepção, a ocorrência de disfunção, rejeição e perda do enxerto. Quanto à s variáveis obstétricas, analisamos a via de parto, a incidência de pré-eclâmpsia e a ruptura prematura de membranas. Entre os resultados perinatais consideramos a incidência de prematuridade e crescimento intra-uterino restrito. Relacionamos estes resultados aos nÃveis de creatinina das transplantadas renais no inÃcio do pré-natal. Para avaliação estatÃstica foram utilizados os testes de chi2 e exato de Fisher. Em todos os casos, o nÃvel de rejeição para a hipótese de nulidade foi sempre fixado em valor menor ou igual a 0,05 (5%). RESULTADOS: a média de idade das pacientes no momento da concepção foi de 27 anos. O doador vivo foi o tipo mais freqüente. Entre as drogas imunossupressoras, a ciclosporina foi a mais utilizada. Hipertensão arterial crônica foi observada em 82% dos casos, anemia em 77% e infecção do trato urinário em 38,5%. A incidência de disfunção do enxerto foi de 47,4%, tendo sido a pré-eclampsia a sua principal causa. Perda do transplante ocorreu em 10,2% dos casos. Quanto à via de parto, a cesariana foi realizada em 53,8%, tendo como principais indicações as sÃndromes hipertensivas. Pré-eclampsia ocorreu em 28,2% das transplantadas. Quanto aos resultados perinatais, prematuridade ocorreu em 46,1% dos casos, apresentando relação significativa com os nÃveis de creatinina maiores ou iguais a 1,5 mg/dL no primeiro trimestre. Outra intercorrência observada foi restrição de crescimento intra-uterino, verificada em 41,0% das gestações. A mesma não apresentou, entretanto, relação com os nÃveis séricos de creatinina. CONCLUSÕES: o grupo de estudo foi constituÃdo por pacientes jovens. Hipertensão arterial crônica, anemia e infecção do trato urinário foram intercorrências clÃnicas bastante freqüentes. Disfunção do enxerto ocorreu em quase metade dos casos, devendo ser rastreada durante o pré-natal. Essas pacientes podem ainda evoluir para a perda do transplante, cujas causas podem ser obstétricas ou não. Quanto à via de parto, a cesariana teve incidência elevada, entretanto lembramos que a via de parto deve ser sempre de indicação obstétrica. Pré-eclampsia ocorreu de forma significativamente maior, devendo ser essas pacientes consideradas como condição de risco para essa complicação. Autophagy in Preeclampsia
Autophagy may be involved in gestation complicated by preeclampsia (PE) due to the presence of placental lesions caused by hypoxia at fetomaternal interphase. Autophagy is a lysosomal degradation pathway, removing protein aggregates and organelles damaged and thereby maintaining cell integrity. In preeclampsia, deficient myometrial penetration by extravillous cytotrophoblast occurs during the first trimester of pregnancy, leading to placental insufficiency. Several placental functions, like nutrient and oxygen input to the fetus during pregnancy, might benefit or even rely on autophagy and related material recycling within the cell. Deficiency in autophagy mechanism has been correlated to inflammatory responses. Autophagy is regulated during placentation and appears to be a possible factor in the development of preeclampsia. In this chapter, we intend to discuss evidence on autophagy pathway in pregnancy and the crosstalk between autophagy and inflammation in preeclampsia
Influence of curing time on the fire performance of solid reinforced concrete plates
When reinforced concrete elements are subjected to high temperatures, such as in a fire, they are susceptible to physical and chemical changes that cause spalling, thereby undermining their performance under such conditions. It is known that the age and the internal moisture content of concrete are factors that contribute to this event, but the intensity of spalling is not yet a consensus. This study aimed to assess the influence of age and internal moisture on the performance of concrete walls at high temperatures. Therefore, 6 real-scale walls were built with dimensions of 3.15 × 3.00 m, with the same composition of concrete, for tests in a vertical furnace under the ISO 834 curve, for ages of 7, 14, 28, 56, 84 and 830 days. Moisture was measured as per the electrical resistivity of concrete. It was noted that walls with ages above 84 days showed no spalling whatsoever, due to the internal moisture of concrete. The most severe spalling took place at 14 days, thus evidencing that pore interconnectivity and hydrated cement crystallization can contribute as well

CaracterÃsticas do trabalho e estratégias de cuidado em saúde mental com o usuário de crack
Objective: To know work characteristics and care strategies in mental health with crack users, from the daily life of a Psychosocial Care Center for Alcohol and Other Drugs (CAPS AD). Method: Qualitative and evaluative study, case study, developed in a CAPS AD, Rio Grande do Sul, Brazil. It was used as theoretical and methodological framework, the Fourth Generation Evaluation. Data collection occurred from January to March 2013. There were 36 interviews with workers, users, family members and managers. Results: The service daily provides flexible spaces that stimulate creativity and centrality in the user. Prioritizes bonding and listening to strengthen the relationship with the user and weaken their relationship with the drug. Final considerations: It is considered the importance of substitutive services in the consolidation of diversified care strategies that can reframe the centrality of drug and rescue user's protagonism.Objetivo: Conocer caracterÃsticas del trabajo y estrategias de atención en salud mental con los consumidores de crack, en un Centro de Atención Psicosocial para alcohol y otras drogas (CAPS AD). Método: Estudio de caso cualitativo, evaluativo, desarrollado en un CAPS AD de Rio Grande do Sul, Brasil. Se utilizó, como referente teórico-metodológico, la Evaluación de Cuarta Generación. La recolecta de datos fue de enero a marzo de 2013. Se realizaron 36 entrevistas con trabajadores, usuarios, familiares y coordinadores. Resultados: El cotidiano del servicio permite espacios flexibles que incentivan la creatividad y la centralidad en el usuario. Prioriza el vÃnculo y la escucha para fortalecer la relación con el usuario y fragilizar la relación con la droga. Consideraciones finales: Se consideró la importancia de los servicios sustitutivos en la consolidación de estrategias de cuidado diversificadas, que repiensen la centralidad en la droga y rescaten el protagonismo del usuario.Objetivo: Conhecer caracterÃsticas do trabalho e estratégias de cuidado em saúde mental com o usuário de crack, a partir do cotidiano de um Centro de Atenção Psicossocial para álcool e outras drogas (CAPS AD). A coleta de dados ocorreu de janeiro a março de 2013. Realizaram-se 36 entrevistas com trabalhadores, usuários, familiares e gestores. Resultados: O cotidiano do serviço propicia espaços flexÃveis que estimulam a criatividade e a centralidade no usuário. Prioriza o vÃnculo e a escuta para fortalecer a relação com o usuário e enfraquecer sua relação com a droga. Adsorptive decontamination of wastewater containing methylene blue dye using golden trumpet tree bark (Handroanthus albus)
The golden trumpet tree bark (GTB), a wood-processing residue, was tested as adsorbent material for decontamination of wastewaters containing methylene blue dye (MB). The powdered material was preponderantly amorphous, containing an irregular surface with the presence of lignin and holocellulose. The adsorption was favorable at basic pH of 10 and adsorbent dosage of 0.5 g L−1. The kinetics has finished in only 30 min and fitted by the general order model (GO). The isotherm behaviors were successfully represented by the Langmuir model. The value found for the maximum adsorption capacity was 232.25 mg g−1, being obtained at 328 K. The standard variation of Gibbs free energy (ΔG0) ranged from − 10.77 to − 8.09 kJ mol−1, indicating a spontaneous and favorable adsorption. A variation of standard enthalpy (ΔH0) of 18.58 kJ mol−1 revealed an endothermic adsorption. A sloped forward curve was found in the continuous operation, with breakthrough time (tb) of 325 min. The stoichiometry capacity of the column (qeq) and the length of mass transfer zone (Zm) were, respectively, 23.57 mg g−1 and 11.28 cm. The GTB was efficient in the treatment of a simulated effluent, obtaining color removal of 96%. These results show that GTB can be applied as adsorbent for decontamination of wastewaters containing methylene blue
