    Judges as Bullies

    It can’t be easy being a judge. The responsibility is enormous: to protect and maintain the rule of law; determine facts and law; resolve disputes large and small; and, in criminal matters, decide whether a fellow citizen remains free or not. In essence, we look to judges to articulate the meaning of “justice”—no doubt knowing all the while, as Clarence Darrow famously noted, “There is no such thing as justice, in or out of court.” I like and respect some judges, but not as many as I should. While some judges have the requisite ability and temperament for the bench—knowledge of the law, independence, fairness, patience, courage, compassion, and humility—too many do not. Too many are mean-spirited and arrogant, going out of their way to insult, ridicule, and demean those who come before them. In short, they are bullies. Bullies on the bench may be an inevitable result of our politicized process of judicial selection, especially on the state level, where most judges are elected. Politics doesn’t usually bring out the best judges or the best in judges. Becoming a bully may also be an occupational hazard. When your daily life consists of sitting in an elevated position in judicial robes, with people bowing and scraping before you, it likely goes to your head. As Steven Lubet says, judges are the “maximum boss” and “[e]veryone else is a supplicant.” This Essay is not about the judges I like and respect, but the ones who have become (or perhaps always were) bullies. Because I am a criminal defense lawyer who has practiced almost entirely in state criminal courts, my stories tend to come from those courts. It might also be that judges are at their worst when they preside over criminal matters

    Metamaterial superlenses operating at visible wavelength for imaging applications

The proposed superlens consist of a gallium phosphide (GaP) dielectric slab waveguide with a hexagonal array of silver rods embedded within the GaP dielectric. In-house 2DFDTD numerical method is used to design and optimize the proposed superlens. Several superlenses are designed and integrated within a same dielectric platform, promoting the proof-of-concept (POC) of possible construction of an array of superlenses (or sub-lenses to create an M-Lens) for light field imaging applications. It is shown that the concavity of the superlens and positioning of each sub-lens within the array strongly affects the performances of the image in terms of resolution. Defects and various geometrical shapes are introduced to construct and optimize the proposed superlenses and increase the quality of the image resolution. It is shown that the orientation of the active region (ellipse) along x and y axis has tremendous influence on the quality of image resolution. In order to investigate the performance characteristics of the superlenses, transmitted power is calculated using 2D FDTD for image projections at various distances (in x and y plane). It is also shown, how the proposed superlens structures could be fabricated using standard micro fabrication techniques such as electron beam lithography, inductively coupled Reactive ion etching, and glancing angle evaporation methods. To the best of our knowledge, these are the first reported POC of superlenses, integrated in a monolithic platform suitable for high imaging resolution that can be used for light field imaging applications at visible wavelength. The proposed superlenses (integrated in a single platform M-Lens) will have tremendous impact on imaging applications

    Effect of β-glucan and black tea in a functional bread on short chain fatty acid production by the gut microbiota in a gut digestion/fermentation model

    β-Glucan and black tea are fermented by the colonic microbiota producing short chain fatty acids (SCFA) and phenolic acids (PA). We hypothesized that the addition of β-glucan, a dietary fiber, and tea polyphenols to a food matrix like bread will also affect starch digestion in the upper gut and thus further influence colonic fermentation and SCFA production. This study investigated SCFA and PA production from locally developed breads: white bread (WB), black tea bread (BT), β-glucan bread (βG), β-glucan plus black tea bread (βGBT). Each bread was incubated in an in vitro system mimicking human digestion and colonic fermentation. Digestion with α-amylase significantly (p = 0.0001) increased total polyphenol and polyphenolic metabolites from BT bread compared with WB, βG, and βGBT. Total polyphenols in βGBT remained higher (p = 0.016; 1.3-fold) after digestion with pepsin and pancreatin compared with WB. Fermentations containing βG and βGBT produced similar propionate concentrations ranging from 17.5 to 18.6 mmol/L and total SCFA from 46.0 to 48.9 mmol/L compared with control WB (14.0 and 37.4 mmol/L, respectively). This study suggests that combination of black tea with β-glucan in this functional bread did not impact on SCFA production. A higher dose of black tea and β-glucan or in combination with other fibers may be needed to increase SCFA production

    Investigating how the attributes of live theatre productions influence consumption choices using conjoint analysis : the example of the National Arts Festival, South Africa

    While there is a fair amount of work on determinants of demand for the live performing arts, results have often been contradictory with little explanatory power. This may be because of the difficulty in describing the attributes of a performance, particularly in terms of its quality, and the heterogeneity of consumer preferences. This article uses conjoint analysis, also called choice experiments, to investigate the impact of the attributes of live theatre performances on demand, using data collected from 483 randomly chosen attenders at live theatre performances at the 2008 South African National Arts Festival. Attributes include the type of cast (professional, semi-professional or amateur), reputation of the producer/director, the context or setting, production type and ticket price of the show. Results largely support the a priori expectations based on the results of other demand studies. For example, it is found that the age of consumers affects the type of show chosen, that utility and willingness to pay increase for shows with professional and semi-professional casts and that 93% of the potential audience prefer shows with a South African context. It is concluded that the method could prove useful to both event organisers and policy makers, especially where the goal is to broaden access to the arts

    Examination of Pre-pandemic Measures on Youth Well-being During Early Stages of the COVID-19 Pandemic

    BACKGROUND: The COVID-19 pandemic has affected our lives in numerous ways. How youth have been impacted by the pandemic and which preexisting factors best relate to COVID-19 responses are of high importance for effective identification and treatment of those most vulnerable. Youth with pre-pandemic mental health difficulties such as attention-deficit/hyperactivity disorder (ADHD) could be at risk for worse well-being during and after the pandemic. METHODS: The current study tested potential risk factors (i.e., pre-pandemic mental health, age, and parental education) and their relationship to family experiences during early months of the COVID-19 pandemic. Participants were previously enrolled in an ongoing, yearly longitudinal study examining the relationship between mental health and executive functions in youth. Families with 1-4 annual pre-pandemic lab visits filled out an online COVID-19 survey in May-July 2020 to assess how the pandemic impacted their well-being (n = 135 youth). RESULTS: Youth pre-pandemic mental health difficulties, especially ADHD symptoms, related to worse well-being during the early pandemic. Trajectories of recent ADHD symptoms over time also predicted cognitive difficulties during the pandemic. We found that youth age was a strong predictor of pandemic response, with younger youth showing fewer negative responses. Parental education level buffered family economic impact during early COVID-19. Families showed synchrony in their pandemic responses. CONCLUSIONS: Pre-pandemic ADHD severity and slope, youth age, and parental education (a proxy for socioeconomic status) were risk factors that influenced youth or family well-being early in the COVID-19 pandemic; this information can help identify those who may need more community and educational support
