    CONCEPTUAL DEFINITION OF VICTIM AND THE RELATIONSHIP OF INTERNATIONAL LAW TO VICTIMS

    The victim is not interested in the theory of criminal law. The examination of the reasons should begin with a functional analysis of the aims of criminal law. The remark that victimology was conceived as a criminological category, which in one sense leads to the conclusion that the position of the victim is necessarily measured by the goals of criminal law in terms of special and general prevention, narrows the interest of classical criminal law theory to the victim. In this scientific paper, the author talks about the concept of victim, both from the criminal and criminal law aspect, as well as from the linguistic one. Emphasis was also placed on the types of victims, as well as the notion of the same in domestic and comparative law, with special reference to International law

    Among the key obligations that must be fulfilled by the world states that aspire to become members of the World Trade Organization is to provide the holders of subjective intellectual property rights with an adequate form of judicial protection. With criminal offenses in the field of protection of intellectual property rights, criminal law protects both moral and property rights of authors and performers, rights of producers of sound recordings and rights related to radio broadcasts, ie rights of authorized distributors of encrypted satellite signals. The incriminations are also in line with the provisions of domestic law, primarily withthe law on copyright and related rights in Bosnia and Herzegovina. The object of protection in these criminal offenses are copyright and other related rights from the power of intellectual property. The aim of the paper is to consider the incriminations in the positive legal regulations in Bosnia and Herzegovina that protect these rights

    Autor opisuje kamenolome na otoku Visu od kojih se jedan nalazio na jugoistočnoj strani otoka u uvali Srebrena. Drugi najstariji viški kamenolom nalazio se na mjestu podizanja antičke Isse gdje se prije izgradnje insula morao terasasto isplanirati teren. Terase su se ukopavale u padinu uzvisine, a kamen koji se tom prilikom dobio mogao se koristiti za izgradnju bedema i kuća. Tako se građevinski materijal dobivao na najlakši mogući način, dok se iz sedam milja udaljene uvale Srebrena kamen transportirao brodovima.The first quarries on our coast were opened during the 4th century BC, during the foundation of the Greek colonies of Issa and Pharos. The construction of poleis demanded plenty of building material especially for the town walls made of stone blocks, which were heavy for manipulation and transport. Issa was built on the slope of Gradina hill which additionally complicated the job of planning the regular orthogonal raster of the city, but at the same time it was an opportunity to get the stone during the forming of the terraces on which insulae, i.e. set of houses were formed. The stone that was dug up during the burial of the terraces into the hill slope could also be used for building houses and city walls. The first ‘quarry’ was formed in that way and it was opened during the founding of the polis. The other quarry was in Srebrena bay on the south-east side of the island of Vis. We found Hellenistic materials from the 3rd century BC there, so it is obvious that it was the quarry that existed long after Issa was built. The stone from this quarry could be exported in other parts of the Mediterranean which is a matter that should be researched at some point

    Pojava međunarodnih otmica djece nije novijeg vijeka, iako je termin „otmica“ relativno novijeg datuma. Proučavanjem antičkih pravnih izvora (rimsko pravo, prava u antičkoj Grčkoj, prava u Mesopotamiji, itd.) mogu se pronaći pravni fragmenti koji govore o roditeljima koji svoje dijete „odvedu“, roditeljima koji svoje dijete „zadrže“, roditeljima kojima dijete „pripadne“ i sl. Međunarodne otmice djece, odnosno protivpravno odvođenje djeteta iz jedne države u drugu, predstavlja problem kojiza sobom povlači niz otvorenih pitanja blisko povezanih sa ličnošću djetata, dok pravno gledano, takva pojava dovodi do sukoba zakona i nadležnosti između različith država, odnosno države djetetovog uobičajnog boravišta i države u koju je dijete nezakonito odvedeno. Države kroz prizmu instituta međunarodnog privatnog prava, uključujući i dostignuća Haške konvencije o građansko-pravnim aspektima međunarodnih otmica djece, nastoje doći do najboljih rješenja kojima se reguliše sukob zakona i nadležnosti između država

Autor uradu daje istorijski pregled pojma istrage na našim prostorima, te daje pojmovno određenje igovori o karakteristikama istrage u tužilačkom konceptu, a potom govori o reformi krivičnogpravosuđa u Bosni i Hercegovini, te o karakteristikama istrage u sudijskom modelu koji jeprije 2003. godine važio u Bosni i Hercegovini

    The topic of this paper are victims of rape as the act on the basis of the criminal offense of the crime against humanity, that is rights and needs of victims and problems and drawbacks of exercising these rights. Therefore, besides normative regulation of a criminal offense and definition of a victim itself and consequences of committing the abovementioned criminal offense for a victim, special attention is paid to state obligations of compensation and integral reparation to victims of rape or other forms of sexual violence during war, as well as drawbacks and lack of adequate compensation and integral reparation to those victims
