Social influences on drivers in China

    Get PDF
China is one of Asia’s many rapidly-motorising nations and recent increases in private-vehicle ownership have been coupled with an escalation in novice drivers. Several pieces of road safety legislation have been introduced in recent decades in China. While managing the legal aspects of road use is important, social influences on driver behaviour may offer alternative avenues to alter behaviour, particularly in a culture where such factors carry high importance. This paper reports qualitative research with Beijing drivers to investigate social influence factors that have, to date, received little attention in the literature. Findings indicated that family members, friends, and driving instructors appear influential on driver behaviour and that some newly licensed drivers seek additional assistance to facilitate the transition from learning to drive in a controlled environment to driving on the road in complex conditions. Strategies to avoid detection and penalties for inappropriate road use were described, many of which involved the use of a third person. These findings indicate potential barriers to implementing effective traffic enforcement and highlight the importance of understanding culturally-specific social factors relating to driver behaviour

The Criminal Corporation: Is Ohio Prepared for Corporate Criminal Prosecutions for Workplace Fatalities

    Get PDF
Although the public perception of the meaning of the term corporate crime includes white collar crimes such as embezzlement and insider trading, today corporate crime encompasses another meaning in American jurisprudence-violent corporate crime. Corporations charged with such violent crimes generally fall into two categories: (1) those that manufacture or market consumer products which cause death within the general public, and (2) those whose employees are killed due to fatal accidents within the workplace. The usual legal recourse against a corporation responsible for the death of a person, in either of the above categories, is the filing of a civil wrongful death suit. A brief look at the number of workplace deaths per year demonstrates the need to increase measures ensuring the safety of America\u27s workers. This Note first traces the history of corporate criminal liability in American jurisprudence. It then discusses the trend toward corporate criminal liability for homicide arising from workplace deaths by examining several notable cases. While the focus of this Note is corporate criminal liability for workplace death, this author will also discuss cases involving non-workplace fatalities since the legal issues involved are similar to all corporate criminal prosecutions. This Note next addresses the federal preemption defense to state corporate criminal prosecutions and the need for federal legislation barring this defense. Finally, this Note proposes several statutory provisions to expand corporate criminal liability for workplace deaths in Ohio

The analysis of responsibilities utilized Mackenzie\u27s management model. The study also compared and contrasted the roles and responsibilities of the administrators in the study; As a result of the analysis of the data, conclusions were made about the responsibilities of the chief unit administrator that could be used for job descriptions, performance evaluations, and in the future planning of the roles and responsibilities of the chief unit administrator. The findings could also be used to increase the understanding of multiunit districts and their administration by sharing the information with university classes and professional organizations; It was evident that the position of chief unit administrators within a multiunit district was one of status and one that impacted both the college/campus and district operations. The management function of directing, which involved facilitating, motivating, delegating, coordinating, and managing change was selected by the chief unit administrators as the one that occupied most of their time. The planning function ranked second. Community involvement and public relations were additional responsibilities identified; The chief unit administrators in the study had positive feelings about the degree of autonomy and authority each of them had to run their campuses, the relationships they had with the other chief administrators in their district, and the status they had as a chief unit administrator
