    Multidimensionality of Entrepreneurial Firm-level Processes: Do the Dimensions Covary?

    Covariance (or not) among the first-order dimensions of firm-level entrepreneurial processes underpins a fundamental and non-trivial difference between the entrepreneurial orientation and entrepreneurial posture constructs. Utilizing a typology developed for multi-dimensional constructs, we operationalized each construct according to its specific conceptualization (relationships among the dimensions) and compared and contrasted each construct in an identical nomological network. Although we found support for both theories, the entrepreneurial orientation construct was more robust in explaining additional variance in growth. Additionally, our findings suggest that the means through which the first-order dimensions are operationalized—latent vs. summates— significantly affect the analysis

    Resale Price Maintenance and the Private Antitrust Plaintiff

    How does the law reconcile the per se illegality of an economically ambiguous practice with enforcement doctrines that permit only those directly suffering anticompetitive harm to sue and require them to prove damages coherently? The question is critical in resale price maintenance (“RPM”) cases because the practice, though illegal per se, may produce no anticompetitive harm, injure parties more proximate to the violation than the plaintiffs, or cause damages resistant to reasonable estimation. One purpose of this Article is to apply economic theory to identify antitrust injuries caused by RPM in various settings. In addition, antitrust law has long required plaintiffs to estimate reasonably if not precisely the magnitude of the harm they suffered as a result of the violation, and we apply this mandate to claims of injury caused by RPM. We demonstrate that plaintiffs will often be hard-pressed—if not unable—to prove damages in an economically coherent fashion. We also explore the implications of the prohibition against indirect purchaser suits in the context of RPM. In all, the Article provides a comprehensive examination of the major issues involved in private actions to obtain damages for illegal RPM agreements. We begin in the next Part with an overview of the legal requirements for plaintiffs to establish antitrust injury and antitrust standing. We briefly survey the history of RPM law in Part III, demonstrating that the Court’s failure to provide a coherent economic case for per se condemnation creates nearly insurmountable problems for private plaintiffs in proving antitrust injury and damages. We illustrate these problems in Part IV through an examination of various business motivations for using RPM—some with anticompetitive effects, some with procompetitive effects, and some with confounding effects. Sorting out the competitive effects of a particular RPM plan is no mean feat. Consequently, the private plaintiff faces a substantial, if not insurmountable, barrier in proving antitrust injury and damages. Because of the formidable impediments faced by private antitrust plaintiffs, one might expect that a defendant would be reluctant to pay anything to settle a private RPM action. But a large number of RPM cases do settle, and Part V addresses the possible reasons for this surprising outcome. We offer some final thoughts in Part VI

    Altered Ecosystem Nitrogen Dynamics as a Consequence of Land Cover Change in Tallgrass Prairie

    ABSTRACT.-Inre cent decades, substantial areas of North American tallgrass prairie have been lost to the establishment and expansion of woodlands and forests, including those dominated by eastern redcedar (Juniperus virginiana). This shift in dominant plant life form, from C4 grasses to coniferous trees, may be accompanied by changes in productivity, standing stocks of biomass and nutrients and biogeochemical cycles. The goal of this study was to quantify and compare major pools and fluxes of nitrogen in recently established (5 80 y) redcedar forests and adjacent native grasslands. Three former grassland sites in the Flint Hills region of Kansas that developed closed-canopy redcedar forests in the recent past were paired with adjacent grassland sites on similar soil type and topographic position (n = 3 sites/land cover type), and selected soil and plant nitrogen pools and fluxes were measured in replicate plots (n = 6/site) along transects in each forest or grassland site over a 20-mo period. We found few significant differences in median soil inorganic N pools or net N mineralization rates between the forest and grassland sites, though there was a trend for greater concentrations of inorganic N in grassland sites on most sample dates, and cumulative growing season net N mineralization averaged 15% less in forest sites (14.3 kg N-ha-1\u27yr-1) than in grassland sites (16.9 kg N-ha-\u27.yr-1). Mean aboveground plant productivity of forest sites (9162 kg ha-1 yr-1) was about 2.5X greater than that of comparable grasslands (similar soils and topographic position), in spite of similar levels of soil N availability. This resulted in an ecosystem-level nitrogen use efficiency (ANPP:litterfall N) in forests that was more than double that of the grasslands they replaced. Additional changes in N cycling associated with redcedar forest development included large accumulations of N in aboveground biomass and transfer to the forest floor via litterfall; redcedar aboveground biomass contained 617 kg N/ ha, forest floor litter N was 253 kg N/ha, and litterfall N flux was 41 kg ha-l\u27yr-1. These are substantial increases in aboveground biomass N accumulation, surface litter N inputs, and surface litter N accumulation compared to the native grasslands characteristic of this region. These fundamental shifts in ecosystem patterns and processes have the potential to alter regional biogeochemistry and both nitrogen and carbon storage throughout areas of the eastern Central Plains where coverage of redcedars is increasing

    Strategic Cognitive Maps of Small Business Leaders

    Cognitive maps influence organizational strategic behaviors by guiding the perceptions of key decisions makers. This paper empirically examines these maps in small business leaders who have the ability to strongly influence an organization's attributes and actions. Results demonstrate that two distinct and polar orientations develop from small business leaders' self-identity with their organization, overall assessments of external stakeholders, and general perceptions of the environment. The strategic implications of these findings suggest that small business leaders should be mindful of their own viewpoints and biases since they can greatly influence organizational behaviors and subsequent performance

    Hypoxia alters the epigenetic profile in cultured human placental trophoblasts

    The mechanisms by which the placenta adapts to exogenous stimuli to create a stable and healthy environment for the growing fetus are not well known. Low oxygen tension influences placental function, and is associated with preeclampsia, a condition displaying altered development of placental trophoblast. We hypothesized that oxygen tension affects villous trophoblast by modulation of gene expression through DNA methylation. We used the Infinium HumanMethylation450 BeadChip array to compare the DNA methylation profile of primary cultures of human cytotrophoblasts and syncytiotrophoblasts under < 1%, 8% and 20% oxygen levels. We found no effect of oxygen tension on average DNA methylation for either cell phenotype, but a set of loci became hypermethylated in cytotrophoblasts exposed for 24 h to < 1% oxygen, as compared with those exposed to 8% or 20% oxygen. Hypermethylation with low oxygen tension was independently confirmed by bisulfite-pyrosequencing in a subset of functionally relevant genes including CD59, CFB, GRAM3 and ZNF217. Intriguingly, 70 out of the 147 CpGs that became hypermethylated in < 1% oxygen overlapped with CpG sites that became hypomethylated upon differentiation of cytotrophoblasts into syncytiotrophoblasts. Furthermore, the preponderance of altered sites was located at AP-1 binding sites. We suggest that AP-1 expression is triggered by hypoxia and interacts with DNA methyltransferases (DNMTs) to target methylation at specific sites in the genome, thus causing suppression of the associated genes that are responsible for differentiation of villous cytotrophoblast to syncytiotrophoblast

    Water-Moderated and -Reflected Slabs of Uranium Oxyfluoride

    A series of ten experiments were conducted at the Oak Ridge National Laboratory Critical Experiment Facility in December 1955, and January 1956, in an attempt to determine critical conditions for a slab of aqueous uranium oxyfluoride (UO2F2). These experiments were recorded in an Oak Ridge Critical Experiments Logbook and results were published in a journal of the American Nuclear Society, Nuclear Science and Engineering, by J. K. Fox, L. W. Gilley, and J. H. Marable (Reference 1). The purpose of these experiments was to obtain the minimum critical thickness of an effectively infinite slab of UO2F2 solution by extrapolation of experimental data. To do this the slab thickness was varied and critical solution and water-reflector heights were measured using two different fuel solutions. Of the ten conducted experiments eight of the experiments reached critical conditions but the results of only six of the experiments were published in Reference 1. All ten experiments were evaluated from which five critical configurations were judged as acceptable criticality safety benchmarks. The total uncertainty in the acceptable benchmarks is between 0.25 and 0.33 % ?k/keff. UO2F2 fuel is also evaluated in HEU-SOL-THERM-043, HEU-SOL-THERM-011, and HEU-SOL-THERM-012, but these those evaluation reports are for large reflected and unreflected spheres.
