The agreement on the transfer of ownership of real estate for security debts

Instytucja prawnych form zabezpieczeń wierzytelności od dawna odgrywa dużą rolę w obrocie cywilnoprawnym, jednak nie jest to wprost uregulowane w obowiązującym prawie. Dlatego też tematem pracy magisterskiej jest problematyka powierniczego przeniesienia własności nieruchomości na zabezpieczenie wierzytelności. Opisano w niej rozwój instytucji przewłaszczenia oraz aktualny stan prawny, włącznie z nowym przepisem art. 387 (1). Zestawiono również poglądy doktryny prawa cywilnego o dopuszczalności stosowania przewłaszczenia wraz ze stanowiskiem sądów polskich. Następnie zaprezentowano propozycje postanowień umownych. W ostatnim rozdziale przedstawiono postulaty de lege ferenda. W niniejszej rozprawie opowiedziano się za poglądem o dopuszczalności stosowania tego typu umów.The institution of legal forms of collateral that has long played a significant role in the practice of civil law transactions, however this legal structure is not strictly adressed by the applicable state law. Therefore, the topic of this master thesis is the issue of fiduciary transfer of title property by way of security. It describes the historical and legal development of the institution of the property transfer and the current legal status, including the new provision of Article 387(1) of Polish Civil Code. Opinions of the doctrine of civil law on the admissibility of application of this institution are presented together with the position of Polish courts. Proposed contractual provisions were then presented. The last chapter presents de lege ferenda postulates. In this thesis, the opinion on the admissibility of using this type of agreement was advocated

Zagadnienie rozwoju i oceny kompetencji architektów w firmach informatycznych

The study shows a systematic approach to the development and assessment of IT architects’ competences, which could be leveraged at software development companies. Another issue is the definition of the process of career paths development as well as the definition of organizational structure supporting this process. The proposed approach was verified at an IT company, where it had been implemented by means of the ORRCA architectural governance methodology.W firmach informatycznych strategiczną rolę w rozwoju oprogramowania i w oferowaniu wartościowej palety produktów odgrywają architekci IT. Powyższe stwierdzenie stawia zasadnicze pytania: jakie kompetencje powinni mieć architekci i jakie powinno być umiejscowienie architektów w strukturach decyzyjnych przedsiębiorstw? W artykule przedstawiono systematyczne podejście do rozwoju i oceny kompetencji architektonicznych możliwe do zaadaptowania w firmach informatycznych. Kolejnym zagadnieniem było zdefiniowanie procesu rozwoju ścieżek kariery oraz scharakteryzowanie rozwiązań organizacyjnych, wspierających proces rozwoju i oceny kompetencji. Uczelnie kształcące w ogólnie pojętym obszarze informatyki powinny przeanalizować ścieżki rozwoju architektów w firmach w celu uwzględnienia zapotrzebowania przemysłu w programach studiów. Przedstawiono weryfikację zaproponowanego podejścia na przykładzie firmy informatycznej, w której takie podejście było wdrażane, przy zastosowaniu metodyki utrzymania ładu architektonicznego ORRCA

Modular Ceramic-Polymeric Device for Analysis of Selected Elements in Liquid Using Microplasma

Miniaturization of devices for analysis of chemical composition is being still developed. In this article we present a portable device with a microplasma excitation source. The microdischarge is ignited inside a ceramic structure between a solid anode and a liquid cathode. As a result of cathode sputtering of the solution, it is possible to determine its chemical specimens by analysis of emission spectra of the microdischarge. We fabricated cathodes with a microfluidic compartment and two types of anodes. Devices were tested experimentally. Spectroscopic properties of the microdischarge and its analytical performance depended on the used ceramic structure, the surface area of the cathode aperture and the flow rate of the solution
