Torts - Invasion of Privacy - Conduct of a Debt Collector
In an action for the balance due on account for merchandise purchased defendants counterclaimed for damages alleging that an agent of the plaintiff, on three separate days, went to the restaurant where the defendant-wife worked as a waitress and in a loud and degrading manner made demands that defendants pay the account. On each occasion many customers were present. Plaintiff\u27s agent accused the defendants of being dead beats and of never intending to pay for the merchandise when it was purchased. The trial court sustained plaintiff\u27s demurrer to this counterclaim. On appeal, held, reversed and remanded. Conduct of a debt collector which degrades and humiliates the debtor in public and which would be deemed offensive to persons of ordinary sensibilities gives rise to a cause of action for invasion of privacy. Electrophoresis of a polyelectrolyte through a nanopore
A hydrodynamic model for determining the electrophoretic speed of a
polyelectrolyte through a nanopore is presented. It is assumed that the speed
is determined by a balance of electrical and viscous forces arising from within
the pore and that classical continuum electrostatics and hydrodynamics may be
considered applicable. An explicit formula for the translocation speed as a
function of the pore geometry and other physical parameters is obtained and is
shown to be consistent with experimental measurements on DNA translocation
through nanopores in silicon membranes. Experiments also show a weak dependence
of the translocation speed on polymer length that is not accounted for by the
present model. It is hypothesized that this is due to secondary effects that

Integrated active and passive control design methodology for the LaRC CSI evolutionary model
A general design methodology to integrate active control with passive damping was demonstrated on the NASA LaRC CSI Evolutionary Model (CEM), a ground testbed for future large, flexible spacecraft. Vibration suppression controllers designed for Line-of Sight (LOS) minimization were successfully implemented on the CEM. A frequency-shaped H2 methodology was developed, allowing the designer to specify the roll-off of the MIMO compensator. A closed loop bandwidth of 4 Hz, including the six rigid body modes and the first three dominant elastic modes of the CEM was achieved. Good agreement was demonstrated between experimental data and analytical predictions for the closed loop frequency response and random tests. Using the Modal Strain Energy (MSE) method, a passive damping treatment consisting of 60 viscoelastically damped struts was designed, fabricated and implemented on the CEM. Damping levels for the targeted modes were more than an order of magnitude larger than for the undamped structure. Using measured loss and stiffness data for the individual damped struts, analytical predictions of the damping levels were very close to the experimental values in the (1-10) Hz frequency range where the open loop model matched the experimental data. An integrated active/passive controller was successfully implemented on the CEM and was evaluated against an active-only controller. A two-fold increase in the effective control bandwidth and further reductions of 30 percent to 50 percent in the LOS RMS outputs were achieved compared to an active-only controller. Superior performance was also obtained compared to a High-Authority/Low-Authority (HAC/LAC) controller
Can the evolution of music be analyzed in a quantitative manner?
We propose a methodology to study music development by applying multivariate
statistics on composers characteristics. Seven representative composers were
considered in terms of eight main musical features. Grades were assigned to
each characteristic and their correlations were analyzed. A bootstrap method
was applied to simulate hundreds of artificial composers influenced by the
seven representatives chosen. Afterwards we quantify non-numeric relations like
dialectics, opposition and innovation. Composers differences on style and
technique were represented as geometrical distances in the feature space,
making it possible to quantify, for example, how much Bach and Stockhausen
differ from other composers or how much Beethoven influenced Brahms. In
addition, we compared the results with a prior investigation on philosophy.
Opposition, strong on philosophy, was not remarkable on music. Supporting an
observation already considered by music theorists, strong influences were
identified between composers by the quantification of dialectics, implying
inheritance and suggesting a stronger master-disciple evolution when compared

Cellular immune responses in amniotic fluid of women with preterm labor and intraâ amniotic infection or intraâ amniotic inflammation
ProblemPreterm birth is commonly preceded by preterm labor, a syndrome that is causally linked to both intraâ amniotic infection and intraâ amniotic inflammation. However, the stereotypical cellular immune responses in these two clinical conditions are poorly understood.Method of studyAmniotic fluid samples (n = 26) were collected from women diagnosed with preterm labor and intraâ amniotic infection (amniotic fluid ILâ 6 concentrations â ¥2.6 ng/mL and culturable microorganisms, n = 10) or intraâ amniotic inflammation (amniotic fluid ILâ 6 concentrations â ¥2.6 ng/mL without culturable microorganisms, n = 16). Flow cytometry was performed to evaluate the phenotype and number of amniotic fluid leukocytes. Amniotic fluid concentrations of classical proâ inflammatory cytokines, type 1 and type 2 cytokines, and Tâ cell chemokines were determined using immunoassays.ResultsWomen with spontaneous preterm labor and intraâ amniotic infection had (a) a greater number of total leukocytes, including neutrophils and monocytes/macrophages, in amniotic fluid; (b) a higher number of total T cells and CD4+ T cells, but not CD8+ T cells or B cells, in amniotic fluid; and (c) increased amniotic fluid concentrations of ILâ 6, ILâ 1β, and ILâ 10, compared to those with intraâ amniotic inflammation. However, no differences in amniotic fluid concentrations of Tâ cell cytokines and chemokines were observed between these two clinical conditions.ConclusionThe cellular immune responses observed in women with preterm labor and intraâ amniotic infection are more severe than in those with intraâ amniotic inflammation, and neutrophils, monocytes/macrophages, and CD4+ T cells are the main immune cells responding to microorganisms that invade the amniotic cavity.
