    The limited scope of seaborne cargo liability regime: new political–economic environments in the 21st Century

    The scope of uniformity of seaborne cargo regimes under the UN’s conventional approach seems to be more extensive than is desirable. The new business pattern of shipping subsectors, the rising influence of developing countries, and containerisation, are creating new shipping environments. These environments show that imperfect competition is only found in parts of the shipping markets nowadays, unlike that in/under the conventional approach to uniformity. Thus, these new economic and political realities call for innovative modifications to the conventional approach and a refocusing of international uniformity towards a limited degree of restriction [limited number of restrictions] of freedom of contract in legal shipping regimes

    Foundational stigma: place‐based stigma in the age before advanced marginality.

    This paper joins the debate on the formation of territorial stigma by uncovering the existence of a form of “foundational stigma” that preceded place-based stigma of the era of advanced marginality. I show that not only were the traces of stigma present prior to the era of advanced marginality but that these early traces facilitate later forms of stigma by providing the necessary foundations upon which adhesive and detrimental stigma was operationalized. Following a critical discourse analysis approach, this paper examines coverage in the British press of Toxteth, Liverpool between 1900 and 1981 as a paradigmatic case study to show that this primitive stigma existed in three key ways: relating to inter-community strife, to crime, and to substandard housing conditions. These traces of stigma laid the foundations for later forms of stigma based on the presence of the poor, violent, deviant other that would be operationalized by dominant voices during the era of advanced marginality

    Do mergers and alliances influence European shipping and port competition?

    New horizontal and vertical integration agreements among the previously separate players in the international shipping and logistics industries are changing the characteristics of services and the structure of the industries. This paper reviews the types of agreements being entered into; examples given are within or affecting Europe. The paper notes that greater integration in the industries may enable improved quality and efficiency of services for shippers. It also notes that the integration changes the amount, nature and incidence of competition in the industries. Particular attention is given to the strategic implications of the changes for ports. The presence of a large fixed infrastructure in the costs and the increased role of the private sector and commercial objectives make the appropriate response of ports uncertain. With the ultimate results of the shifts in market power uncertain, more research is needed on the effects of greater integration in the industry on efficiency, conflicts of interest and on the possible effects of market dominance
