    The background and history of the Federal Tort Claims Act are well known. Stemming in part from the medieval political theory that the King could do no wrong, a doctrine evolved in English law that the Crown was, in the absence of its consent, immune to suit. This concept became a part of the American common law, and in the main was enforced as rigorously on this side of the Atlantic as in the mother country. The oft-times inequitable consequences of sovereign immunity in the United States were at first sought to be ameliorated through the device of private legislative enactments which appropriated monies for the relief of persons injured by the negligence of Government servants. With the constant increase and diversification of Governmental activity and the concomitant inevitable rise in the volume of injuries inflicted upon members of the public by Governmental employees, the machinery of the private bill system began to break down. At best such a system had been cumbersome and unsatisfactory. Congress had no adequate investigatory facilities to ascertain the facts in a particular case, and the compensating of a claimant would often depend not on the merits of his cause but on the extent of the political and personal pressure he was able to exert. Therefore in 1946 Congress, which had already waived the immunity of the United States in connection with contract claims, extended the waiver to tort actions

    Nickel: A micronutrient element for hydrogen-dependent growth of \u3ci\u3eRhizobium japonicum\u3c/i\u3e and for expression of urease activity in soybean leaves

    Soybean plants and Rhizobium japonicum 122 DES, a hydrogen uptake-positive strain, were cultured in media purified to remove Ni. Supplemental Ni had no significant effect on the dry matter or total N content of plants. However, the addition of Ni to both nitrate-grown and symbiotically grown plants resulted in a 7- to 10-fold increase in urease activity (urea amidohydrolase, EC 3.5.1.5) in leaves and significantly increased the hydrogenase activity (EC 1.18.3.1) in isolated nodule bacteroids. When cultured under chemolithotrophic conditions, free-living R. japonicum required Ni for growth and for the expression of hydrogenase activity. Hydrogenase activity was minimal or not detectable in cells incubated either without Ni or with Ni and chloramphenicol. Ni is required for derepression of hydrogenase activity and apparently protein synthesis is necessary for the participation of Ni in hydrogenase expression. The addition of Cr, V, Sn, and Pb in place of Ni failed to stimulate the activity of hydrogenase in R. japonicum and urease in soybean leaves. The evidence indicates that Ni is an important micronutrient element in the biology of the soybean plant and R. japonicum

    Geometric Design of Scroll Expanders Optimized for Small Organic Rankine Cycles

    The application of organic Rankine cycles (ORCs) for small scale power generation is inhibited by a lack of suitable expansion devices. Thermodynamic and mechanistic considerations suggest that scroll machines are advantageous in kilowatt-scale ORC equipment, however, a method of independently selecting a geometric design optimized for high-volume-ratio ORC scroll expanders is needed. The generalized 8-dimensional planar curve framework (Gravesen and Henriksen, 2001, “The Geometry of the Scroll Compressor,” Soc. Ind. Appl. Math., 43, pp. 113–126), previously developed for scroll compressors, is applied to the expansion scroll and its useful domain limits are defined. The set of workable scroll geometries is: (1) established using a generate-and-test algorithm with inclusion based on theoretical viability and engineering criteria, and (2) the corresponding parameter space is related to thermodynamically relevant metrics through an analytic ranking quantity fc (“compactness factor”) equal to the volume ratio divided by the normalized scroll diameter. This method for selecting optimal scroll geometry is described and demonstrated using a 3 kWe ORC specification as an example. Workable scroll geometry identification is achieved at a rate greater than 3 s⁻¹ with standard desktop computing, whereas the originally undefined 8-D parameter space yields an arbitrarily low success rate for determining valid scroll mating pairs. For the test case, a maximum isentropic expansion efficiency of 85% is found by examining a subset of candidates selected the for compactness factor (volume expansion ratio per diameter), which is shown to correlate with the modeled isentropic efficiency (R² = 0.88). The rapid computationally efficient generation and selection of complex validated scroll geometries ranked by physically meaningful properties is demonstrated. This procedure represents an essential preliminary qualification for intensive modeling and prototyping efforts necessary to generate new high performance scroll expander designs for kilowatt scale ORC systems.United States.     The differential cross sections for πpγn\pi^- p \to \gamma n and π+nγp\pi^+ n \to \gamma p are computed up to O(p3)O(p^3) in heavy baryon chiral perturbation theory (HBChPT). The expressions at O(p)O(p) and O(p2)O(p^2) have no free parameters. There are three unknown parameters at O(p3)O(p^3), low energy constants of the HBChPT Lagrangian, which are determined by fitting to experimental data. Two acceptable fits are obtained, which can be separated by comparing with earlier dispersion relation calculations of the inverse process. Expressions for the multipoles, with emphasis on the p-wave multipoles, are obtained and evaluated at threshold.     Morphology And Behavior Of The Early Stages Of The Skipper, Urbanus Esmeraldus, On Urera Baccifera, An Ant-visited Host Plant.

    The Neotropical genus Urbanus (Hübner) (Lepidoptera: Hesperiidae) contains around 34 described species, and is widely distributed from the extreme southern United States to Argentina. Here, we describe the larval morphology and behavior of Urbanus esmeraldus (Hübner)(Hesperiidae) in Urera baccifera (Urticaceae), a plant producing food rewards and fleshy fruits that attract ants (including predacious species) in a Brazilian forest. Larvae pass through five instars and construct two kinds of leaf shelters. Experiments with ejected fecal pellets showed that these can serve as cues to ground-dwelling ants that climb onto host plants and potentially attack the larvae. Manipulation with pellets placed at different distances suggests that ejection behavior decreases larval vulnerability to ant predation. Larval preference for mature leaves may be related with increased predation risk at ant-visited young leaves. The study shows that a combination of natural history and experimental data can help understand the life history of a butterfly using a plant with high predation risk.125
