Formal and informal rules of doing business in Poland in the context of accession to the European Union : an analysis of the institutional changes

Przedmiotem artykułu są reguły prowadzenia biznesu w Polsce w kontekście przystąpienia do Unii Europejskiej, ujęte z perspektywy nowego instytucjonalizmu. Punktem wyjścia artykułu jest założenie, że wzajemne oddziaływania pomiędzy instytucjami formalnymi i nieformalnymi, prowadząc do równowagi względnie nierównowagi instytucjonalnej, decydują ostatecznie o kształcie gospodarki i jej efektywności. Zgodnie z tym założeniem, Autorzy analizują cztery rodzaje relacji zachodzących pomiędzy formalnymi i nieformalnymi regułami prowadzenia biznesu w Polsce: (1) wpływu restrykcyjności przepisów na nieformalne powiązania pomiędzy administracją a biznesem; (2) zależności pomiędzy niską efektywnością prawa w zakresie prowadzenia biznesu a nieformalnymi reakcjami dostosowawczymi; (3) oddziaływania prawa unijnego na strategie prowadzenia biznesu; (4) oddziaływań globalnej gospodarki na zakres i formy współpracy pomiędzy administracją a biznesem. Analiza materiału empirycznego dostarcza podstaw do budowy czterech modeli instytucjonalnych, opisujących reguły prowadzenia biznesu w Polsce: „antagonistycznego”, w którym administracja i biznes dążą do wzajemnie sprzecznych celów, „równoległego”, w ramach którego instytucje formalne i nieformalne tworzą odrębne porządki, „alternatywnego”, w którym pojawiają się nowe, unijne rozwiązania formalne, oraz „zintegrowanego”, zachęcającego aktorów do realizacji wspólnych celów.From the perspective of ‘new institutionalism’, this article studies the rules of doing business in Poland in the context of the country’s accession to the European Union. The article's starting point is the premise that interaction between formal and informal institutions leads to an institutional balance or imbalance and determines the final shape of the economy and its effectiveness. Accordingly, the authors analyze four types of relations occurring between the formal and informal rules of doing business in Poland: (1) the influence of the restrictiveness of regulations on informal relations between the public administration and business; (2) the relation between the low effectiveness of the law in regards to running a business and informal adaptive reactions; (3) the effects of EU law on business strategies; (4) the effects of the global economy on the extent and forms of cooperation between the public administration and business. Analysis of empirical material provides a basis for constructing four institutional models of the rules of doing business in Poland: the ‘antagonistic’ model, in which the administration and business are striving for mutually exclusive goals; the ‘parallel’ model, where formal and informal institutions create separate orders; the ‘alternative’ model, in which formal, new, EU solutions are created; and the ‘integrated’ model, where actors are encouraged to realize common aims

Publikacja powstała w ramach projektu badawczego „Miejsca pamięci i zapomnienia. Interdyscyplinarne badania północnych terenów Jury Krakowsko-Częstochowskiej”.Publikacja jest pierwszym tomem serii raportów, wydanych w formie elektronicznej, prezentujących rezultaty działań podjętych w projekcie badawczym „Miejsca pamięci i zapomnienia. Badania interdyscyplinarne północnych terenów Jury Krakowsko-Częstochowskiej”, realizowanym na Wydziale Filozoficzno-Historycznym Uniwersytetu Łódzkiego w latach 2014–2019 w ramach Narodowego Programu Rozwoju Humanistyki Ministerstwa Nauki i Szkolnictwa Wyższego. Tom zawiera propozycję interdyscyplinarnej metodologii oraz zestawu etnograficznych i archeologicznych procedur badawczych powiązanych z ustaleniami z zakresu historii i historii sztuki. W kolejnych raportach zaprezentowane zostaną wyniki badań przeprowadzonych w pięciu gminach powiatu częstochowskiego: Mstów (tom 2), Olsztyn (tom 3), Janów (tom 4), Lelów (tom 5) i Przyrów (tom 6). Political corruption in Poland

Der Beitrag über die politische Korruption in Polen gliedert sich in zwei Untersuchungsgegenstände: Die erste Studie befasst sich mit den Ursprüngen der Korruption im post-kommunistischen Polen. Dabei gliedern sich die Ausführungen bzw. das Datenmaterial von 1991 bis 2004 in folgende Punkte zum aktuellen Ausmaß der Korruption: (1) Indikatoren der Korruption - Wahrnehmung, Korruptionspraktiken, strukturelle Korruption; (2) korruptionsfördernde Faktoren - Privatisierungstempo, Handhabung des öffentlichen Beschaffungswesens, Rolle des Geheimdienstes im polnischen Transformationsprozess. Die zweite Studie beleuchtet in einer Fallstudie den Klientelismus in der schlesischen Bergbauindustrie seit Beginn des Transformationsprozesses 1990 bis 2003. Die Befunde basieren auf Netzwerkanalysen, Befragungen sowie Inhaltsanalysen von Wirtschaftsprogrammen zur Restrukturierung dieses Industriezweiges, Artikeln und Inspektionsberichten. Nach einer Darstellung der Organisationsstruktur der Bergbauindustrie werden die Untersuchungsergebnisse in Angaben (1) zum Massenklientelismus im Kontext der Beschäftigungssituation der Bergleute und (2) zum individuellen Klientelismus bzw. Vetternwirtschaft (zusätzliche Einkommensquellen durch die Verbindung der Bergbaugesellschaften zu der Privatwirtschaft) unterteilt. Ferner werden Ausprägung und Ausmaß des Klientelismus anhand der 'Umdrehungen des Positionenkarussells' verdeutlicht, also dem Netzwerk der Machtzirkel in Bergbau und Politik. Abschließend werden in einer Zusammenfassung die Hauptgründe und Konsequenzen für das Auftreten von Netzwerken mit klientelistischen Verbindungen im Bergbau genannt. (ICG2

In this progressing virtualization, time has come also for the realm of death, which in a natural way joined the cyber-reality, shaping a new dimension of commemorative-funeral practices present in the funeral culture. The internet has become not only a vehicle for memory, but also a place for creating its new forms. The article attempts to identify and general characteristics of the activities of Polish Facebook users connected with the memory of loved ones, in the context of the possibilities provided by the portal itself. Stratification of the cemetery’s space reflects the social structure of the city, revealing an internal hierarchy, the worldview and the tastes of the inhabitants. The message that a headstone conveys is a resultant of the communication intended by those who commissioned it and the historical context. The means of visual expression, as well as the nature of the embellishments are the necessary tools for its reading. W kwietniu 2004 roku obroniła na Wydziale Filozoficzno-Historycznym UŁ pracę doktorską dotyczącą środowiska żydowskich artystów w Łodzi w latach 1880–1918, napisaną pod kierunkiem prof. dr. hab. A. K. Olszewskiego. Zainteresowania naukowe: sztuka żydowska, środowisko łódzkich artystów żydowskich, sztuka i kultura XIX wieku.
