Es ist für mich eine große Freude, Ihre Einladung zu diesen 7. Petersberger Tagen anzunehmen, um mit der gebotenen Kürze über das Rechtsinstitut der „conformidad“ in Spanien zu sprechen, auf das ich mich in der Folge aufgrund fehlender Übereinstimmung mit der deutschen Absprache oder Verstän- digung mit dem Begriff „Einverständnis“ beziehen werde. Es handelt sich hierbei um eine schon seit langem gesetzlich vorgesehene Möglichkeit, das mündliche Strafverfahren zu vermeiden, die sowohl öffentliche als auch private Interessen zu wahren bestimmt ist, denn zum einen begünstigt die Unter- drückung von Verfahrensschritten die Vereinfachung des Ver- fahrens und damit die Prozessökonomie, zum anderen wird der Angeklagte mit einer zum Teil merklichen Herabsetzung der Strafe belohnt. Sobre los derechos de las víctimas del crimen y la mejora de su posición jurídica

El presente artículo analiza de forma exhaustiva el catálogo general de derechos que recoge el futuro nuevo Estatuto Jurídico de la Víctima, actualmente en fase de tramitación parlamentaria, y a través del cual nuestro ordenamiento da debido cumplimiento a la Directiva 2012/29/ UE del Parlamento Europeo y del Consejo, de 25 de octubre de 2012, por la que se establecen Normas Mínimas sobre los Derechos, el Apoyo y la Protección de las Víctimas de Delitos. Para ello se parte de la diferenciación entre derechos no procesales y derechos procesales de la víctima, tanto sea como no parte en el proceso, al ser en este aspecto en donde radica el núcleo principal de la futura Ley. A todo lo anterior se une el análisis del papel protagónico de la víctima a lo largo del proceso penal en todas sus fases, incluidas las primeras diligencias y la ejecución, en aspectos tales como servicios de apoyo, justicia reparadora, derecho a la información o derecho a participar activamente en el proceso penal.This paper analyzes in detail the general catalog of duty in the future new Legal Status of Victim, currently before Parliament, and through which our system gives proper implementatíon of Directive 2012/29 / EU of the European Parliament and of the Council of 25 October 2012 laying down minimum standards on the Rights, Support and Protection of Victims of Crime was established. For it is part of the differentiation between non-procedural rights and procedural rights of the victim, both either as part of the process, being in this aspect lies the core of the future law. To the aboye it mixes analysis of the leading role of the victim throughout the criminal proceedings at all stages, including the initial investigation and enforcement in areas such as support services, restorative justice, right to information and right to participate in criminal proceedings

Prohibited and admissible proof: changes in the judicial safeguard (garantismo) motivated by the fight against organized crime in present spanish jurisprudence

En este artículo se revisa la evolución del tratamiento de la institución de la prueba prohibida en España y, en particular, en la jurisprudencia del Tribunal Constitucional, destacando el reduccionismo garantista de la misma en una etapa motivada por la lucha contra el crimen organizado. Se critica que la prohibición probatoria, que anteriormente se fundaba en sus efectos para disuadir a la policía de actuar contra la ley o en la protección constitucional de los derechos de los ciudadanos imputados o acusados frente al poder intervencionista del Estado en la esfera individual, hoy ha pasado a justificarse puramente en consideraciones utilitaristas de castigar como sea a quien “evidentemente” es culpable de un crimen horrendo.In this paper the author reviews the evolution of the treatment of forbidden evidence in Spain and, in particular, in the jurisprudence of the Constitutional Court, emphasizing the guarantor reductionism in a stage marked by the fight against organized crime. Un trabajo de Geografía: La penillanura trujillano cacereña drenada por el río Almonte

En la provincia de Cáceres, Extremadura, España, al sur del río Tajo, tiene su ámbito territorial la cuenca hidrológica del río Almonte, afluente del Tajo por su margen izquierda. Encajada en el zócalo paleozoico primigenio, que hiende y disecciona, drena la Penillanura trujillano cacereña con su red de afluentes, con sus masas de agua en un buen estado de conservación. Estos suelos, con su clima seco, de influencias atlánticas, veranos secos y amplitud térmica acusada, más la acción del hombre durante milenios, con su uso agroganadero, han modelado el originario bosque de encinas, con manchas de alcornoques y acebuches, en extensas dehesas, pseudoestepas, pastizales, riberos, y formaciones riparias características, que albergan, además, una importantísima avifauna de interés mundial, protegidas ambas, en la actualidad, por diversas Directivas de la Unión Europea. Pero, junto a esos hábitats y especies, ese prolongado uso del territorio por el hombre ha configurado también un patrimonio cultural, histórico-artístico y etnológico, de primer orden, que también debe ser conservado, junto al patrimonio natural, de forma integrada por su importancia para el conjunto de la humanidad. Componen el patrimonio territorial de un trozo de Extremadura demográficamente envejecido, quizás económicamente poco relevante, pero en cuya conservación y uso pueden encontrar estos extremeños su razón de ser y pervivir.In the province of Caceres, Extremadura, Spain, at the south of Tagus river, the basin of river Almonte, which is an affluent of Tagus river by its left side, has its territorial scope. Located in the primitive Paleozoic bedrock, which splits and dissects, drains the peneplain from Caceres and Trujillo with its number of affluents, which have well-preserved masses of water. These soils, with their dry climate, of Atlantic influences, dry summers and thermal amplitude, together with human action overtime, by agriculture and livestock farming, have shaped the native holm oak forest, with cork oak and wild olive, into extensive meadows, pseudo steppes, grasslands and riparian areas. But favoured by these plants formations, there exists also a very important range of birdlife and they are both protected by European Union Directives. In addition, together with these habitats and species, this wide use of territory by man have configured also a cultural, historical-artistic and ethnologic heritage, which has to be preserved together with the natural heritage due to its importance for humanity. They both compose the territorial heritage of a part of Caceres which is demographically aged, and despite being economically irrelevant, its preservation and use might be the reason for being and live of local people.Universidad de Sevilla. Numerical evaluation of the Green's functions for arbitrarily shaped cylindrical enclosures and their optimization by a new spatial images method

IIn this paper, a spatial image technique is used to efficiently calculate the mixed potential Green’s functions associated with electric sources, when they are placed inside arbitrarily shaped cylindrical cavities. The technique is based on placing electric dipole images and charges outside the cavity region. Their strength and orientation are thencalculated by imposing the appropriate boundary conditions for the fields at discrete points on the metallic wall. A method for the assessment of the potentials accuracy is proposed, and several optimization techniques are presented. Three cavities are analyzed to demonstrate the usefulness of the techniques. The cutoff frequencies and potentials patterns are compared to those obtained by a standard finite elements technique, showing excellent agreement. Psychophysical Determination of the Relevant Colours That Describe the Colour Palette of Paintings

In an early study, the so-called “relevant colour” in a painting was heuristically introduced as a term to describe the number of colours that would stand out for an observer when just glancing at a painting. The purpose of this study is to analyse how observers determine the relevant colours by describing observers’ subjective impressions of the most representative colours in paintings and to provide a psychophysical backing for a related computational model we proposed in a previous work. This subjective impression is elicited by an efficient and optimal processing of the most representative colour instances in painting images. Our results suggest an average number of 21 subjective colours. This number is in close agreement with the computational number of relevant colours previously obtained and allows a reliable segmentation of colour images using a small number of colours without introducing any colour categorization. In addition, our results are in good agreement with the directions of colour preferences derived from an independent component analysis. We show that independent component analysis of the painting images yields directions of colour preference aligned with the relevant colours of these images. Following on from this analysis, the results suggest that hue colour components are efficiently distributed throughout a discrete number of directions and could be relevant instances to a priori describe the most representative colours that make up the colour palette of paintings.FEDER Funds by the Spanish Ministry of Science Innovation and Universities (MICINN, grant number RTI2018-094738-B-I00

Heuristic usability evaluation on games: a modular approach

Heuristic evaluation is the preferred method to assess usability in games when experts conduct this evaluation. Many heuristics guidelines have been proposed attending to specificities of games but they only focus on specific subsets of games or platforms. In fact, to date the most used guideline to evaluate games usability is still Nielsen’s proposal, which is focused on generic software. As a result, most evaluations do not cover important aspects in games such as mobility, multiplayer interactions, enjoyability and playability, etc. To promote the usage of new heuristics adapted to different game and platform aspects we propose a modular approach based on the classification of existing game heuristics using metadata and a tool, MUSE (Meta-heUristics uSability Evaluation tool) for games, which allows a rebuild of heuristic guidelines based on metadata selection in order to obtain a customized list for every real evaluation case. The usage of these new rebuilt heuristic guidelines allows an explicit attendance to a wide range of usability aspects in games and a better detection of usability issues. We preliminarily evaluate MUSE with an analysis of two different games, using both the Nielsen’s heuristics and the customized heuristic lists generated by our tool.Unión Europea PI055-15/E0
