Analysis of polygamy provision under the Islamic Family Law (Federal Territories) Act 1984; with referrence to the Qur’an and Sunnah

Islam permits polygamy to preserve woman's dignity and cares for the social moral and economic well-being of wives and orphans. Unfortunately, a number polygamous marriage among Muslims in Malaysia is dramatically misleading from both Islamic theories as well as principles. Hence, it has become a very controversial issue among its critics and supporters which resulting in serious criticism on the credibility of Islamic Family Law Act 1984.(ILLA) As a short term measure, a reform the IFLA has been suggested to focus more on specific legal mechanisms in curbing abuse of polygamy. In this paper the author attempts to analyze the synchronization of the IFLA in the light of Qur’an and Sunnah in order to suggest more effective, practical, and acceptable solutions in overcoming the issues and complying with the requirements by ‘following the real teaching in the revelation.

Benchmarking standards of future Islamic elderly care centers

Malaysia, as reported by the Department of Statistics Malaysia, will be an ageing nation by 2035. Yet, the rapid increasing population of the elderly in tandem with the decreasing fertility and morbidity rate causes imbalance in the society’s structure. The elderly is often perceived negatively because of the stereotype, and it affects their physical and mental health. This study is an attempt to provide the conceptual framework as a guidelines to improve the standard of elderly care centers as well as its hospitality. This research hypothesized that the current caretaking system is progressing, but more drastic initiatives is needed to achieve a wholesome objective for elderly well-being from Islamic perspective

منهج الوسطية في السياسة والعقيدة، دراسة تحليلية في ضوء رسائل النور للإمام بديع الزمان سعيد النورسي

يهدف هذا البحث إلى دراسة المنهج الوسطي في السياسة والعقيدة في ضوء رسائل النور للإمام بديع الزمان النورسي، حيث بدأت هذه الدراسة بالترجمة والتعريف بالإمام بديع الزمان النورسي، والتعريف برسائل النور ومضامينها، ثم بيان وتعريف الوسطية وتوضيح المفاهيم والمصطلحات المتعلقة بمفهوم الوسطية كالاستقامة والاعتدال والتطرف وغيرها، ثم بيان منهج الإمام النورسي وتوضيح وسطيته وبيانها من خلال العقيدة والفكر وكذلك اجتهاداته، ثم ستوضح الدراسة وتبيّن منهج الإمام النورسي وسياسته الوسطية في التعامل مع العباد والبلاد، من خلال توضيح تعريف السياسة والمصطلحات المتعلقة بها، وبيان الفرق بين السياسة الشرعية والسياسة الوضعية، موضحاً أدلة السياسة الشرعية وشروط العمل بها، وإبراز دور الإمام النورسي ومنهجه وأثره في المجتمع وكيفية تطور منهج الإمام النورسي من خلال المقارنة بين سعيد القديم وسعيد الحديث والتي توضح كيفية إعمال السياسة مع مراعاة فقه الواقع، وسيتَّبع الباحث المنهج الاستقرائيَّ في بيان وسطية سياسة الإمام النورسي، كما سيتَّبع الباحث المنهج التَّحليليَّ لدراسة الواقع وفقا لسياسة الإمام النورسي ومدى إمكانية تطبيقها في الواقع بشكل عام، وقد توصل الباحث بشكل مبدئيٍ أن منهج الإمام النورسي الوسطي هو منهج ملائم لهذا العصر ومقبول عقلا وروحا عند المعاصرين لأنه مُستنبط من القرآن مع مراعاة الجوانب الإنسانية من الروح والعقل والجسد معا، فهو منهج يدمج بين المدرسة القديمة مع مدرسة العلوم الحديثة، وخلص الباحث إلى جملة من التوصيات، أهمها: لا ضير في تجربة هذا المنهج الوسطي وإعمال سياسته الوسطية في الحياة الواقعية لنرقى بديننا ومجتمعاتنا

Educational philosophy in Islam in the curriculum design of integrated Islamic education in Malaysia

This article discusses the dichotomy in Islamic education which is the basic problem facing Islamic education today. To overcome these problems, one of them is by organizing an educational model that integrates the science of religion with the knowledge that is based on the philosophy of Islamic education. By employing qualitative method of research, this article strives to identify the philosophy of education in Islam and challenges in the current integrated educational system, which is currently implemented in Malaysian primary and secondary schools. The results of this study, concluded that in overcoming the problem in the preaching of Islamic education, Malaysia implemented integrative Islamic education that integrates religion and science with the Ulul al-Bab model and the KAFFAH curriculum. The concept of Ulul al-Bab is taken from the Qur'an as the basis of the curriculum, while in the KAFFAH curriculum each subject taught is associated with Islamic values and beliefs. ************************************************************************************ Artikel ini membahas dikotomi dalam pendidikan Islam yang merupakan masalah mendasar yang dihadapi pendidikan Islam saat ini. Untuk mengatasi masalah tersebut, salah satunya adalah dengan menyelenggarakan model pendidikan yang mengintegrasikan ilmu agama dengan ilmu pengetahuan yang landasi oleh filosofi pendidikan Islam. Dengan menggunakan metode penelitian kualitatif, artikel ini berupaya mengidentifikasi filosofi pendidikan dalam Islam dan tantangan dalam sistem pendidikan terintegrasi yang saat ini diterapkan di sekolah dasar dan menengah di Malaysia. Hasil penelitian ini, diperoleh kesimpulan bahwa dalam mengatasi masalah dikhotomi pendidikan Islam, Malaysia menerapkan pendidikan Islam integratif yang mengintegrasikan antara agama dan ilmu pengetahuan dengan model Ulul al-Bab dan kurikulum KAFFAH. Konsep Ulul al-Bab diambil dari Al-Qur'an sebagai dasar kurikulum, sedangkan dalam kurikulum KAFFAH setiap mata pelajaran yang diajarkan dikaitkan dengan nilai-nilai dan keyakinan Islam

Balu sering dibeban tanggungjawab mendidik, menafkah dan memberi kasih-sayang kepada anak-anaknya yang berstatus yatim secara bersendirian. Ini adalah isu agama dan kemanusiaan yang perlu diberi perhatian serius. Justeru kajian ini bertujuan bagi mengenal pasti mekanisme perlindungan ibu tunggal dan anak yatim menurut syariat Islam. Data dikumpul dari sumber pustaka denganmemberifokus terhadaphukum-hakam berkaitan nafaqatyang dianalisis semula secara holistik; iaitu dengan mengaitkannya dengan bab-bab lain seperti wilayat al-nikah danfaraid, selain melihat kepada tafsīr ayat-ayat berkenaan dan hadis-hadis lain yang menyentuh perihal ibu tunggal dan anak yatim pada zaman Nabi SAW sama ada dalam bentuk instruktif atau diskriptif. Hasil kajian mendapati ibu tunggal yang mengalami situasi tersebut sepatutnya dikecualikan daripada beban nafkah. Nafkah anak-anaknya hendaklah ditanggung oleh walinya atau penerima harta pusaka ayahnya menurut turutanasabah. Selain itu, Islam juga menggalakkan masyarakat membantu menjaga golongan ibu tunggal dan anak yatim ini dengan beberapa cara lain

Islamic education: The philosophy, aim, and main features

Islam has put greater emphasis on the importance of acquisition and dissemination of knowledge (‘ilm) than any other human activities. In fact, it makes it compulsory (farḍ) upon its adherents, regardless of gender, to learn and disseminate knowledge. The obligation of seeking out knowledge is binding upon every Muslim by the command of the Qur’an and Sunnah of the Prophet (PBUH). Education from Islamic perspective is often defined by Muslim scholars from three different dimensions which are reflected in different concepts introduced, important among them are; tarbiyyah – the process of education that gives emphasis on physical and intellectual development of an individual; ta’dīb – the process of education that gives emphasis on nurturing good human beings with noble codes of conduct/ethics approved by Islam, so that he may conduct and position himself in society with justice; and taʿlīm – the process of education that is based on teaching and learning. The concept of education in Islam must take into consideration of all the dimensions stated above. No matter which one of the above concepts is preferable to scholars, it should not be used as a pretext for controversy and intellectual acrimony among scholars, because what does it matter is not the concept, but the practice, methodology and its objectives. Education occupies a significant position in Islamic civilization. The first revelation to Prophet Muḥammad (PBUH) in Sūrah al-‘Alaq (verses 1-4) is about the divine instruction to “reading by the name of God”, thus underscores the tawḥīd philosophy that education in its essence is not purely a mundane activity, but an integral part of faith. Recently, the concept of education in Islam has been influenced by secularism since the time of colonization and the collapse of the Ottoman Empire, which consequently resulted in the failure of the Muslim Ummah in its quest for nation building and development according to Islamic perspective. The purpose of education in Islam is to produce a good human being (al-insān al-ṣāliḥ), who is capable of delivering his/her duties as a servant of Allāh (ʿabdullāh) and His vicegerent (khalīfah) on earth. This paper is aimed at highlighting the main features of Islamic education, its methodology and objectives in comparison with the current system of education, which is predominantly secular in its philosophy and methodology. Objektif pelancongan dalam al-Qur'an

Pelancongan Islam merupakan satu cabang industri yang berkembang pesat di seluruh dunia namun dalam masa yang sama menghadapi cabaran besar untuk menjadinya kompetatif atau bahkan pilihan utama dalam persekitaran pasaran pelancongan moden yang terbuka. Dalam meraih peluang yang lebih baik, produk-produk pelancongan Islam perlu dipelbagaikan. Dengan menggunakan metode kajian literasi terhadap teks ayat-ayat al-Qur’an dan al-Sunnah, didapati terdapat banyak objektif pelancongan yang dituntut untuk dilaksanakan oleh kaum Muslimin dan yang seterusnya berpotensi diadaptasikan sebagai produk pelancongan yang boleh dimanfaatkan semua. Jenis-jenis produk yang telah dikenal pasti ialah seperti pelancongan kesedaran, keagamaan, motivasi, pendidikan, perniagaan, politik, perubatan, alam semula jadi, geografi dan kemasyarakatan. Setiap elemen yang ditemui disenaraikan di dalam kajian ini sambil diperkuatkan dengan nas dan perbincangan yang mendukung fakta bahawa setiap daripadanya adalah merupakan tuntutan agama dan keperluan setiap jiwa
