    Pacifism in Japan is very old, with roots going back a number of centuries. After the demise of militarism, the immediate post-war period saw it rise phoenix-like from the ashes. For the last 30 years, the pacifist movement has kept alive the opposition to the rebirth of militarism and has opposed the liberal party's policy of collaboration with the US. In fact, Japan has agreed to an increasingly tighter integration into the US defence strategy in the Pacific, even to the point of accepting the storage of nuclear weapons on her territory. Furthermore, as time has passed and Japan's power as an economic giant has increased, a certain number of Japanese intellectuals have developed the idea that a truly sovereign state must be armed. And this is mirrored in the ever-widening public acceptance of the build-up of the Self-Defence Forces. Nevertheless, a recent accident involving a nuclear submarine and a trawler demonstrated how delicate the whole matter remains, and that pacifism remains a sentiment firmly rooted in the Japanese psyche

    Global standards of Constitutional law : epistemology and methodology

    Just as it led the philosophy of science to gravitate around scientific practice, the abandonment of all foundationalist aspirations has already begun making political philosophy into an attentive observer of the new ways in which constitutional law is practiced. Yet paradoxically, lawyers and legal scholars are not those who understand this the most clearly. Beyond analyzing the jurisprudence that has emerged from the expansion of constitutional justice, and taking into account the development of international and regional law, the ongoing globalization of constitutional law requires comparing the constitutional laws of individual nations. Following Waldron, the product of this new legal science can be considered as ius gentium. This legal science is not as well established as one might like to think. But it can be developed on the grounds of the practice that consists in ascertaining standards. As abstract types of best “practices” (and especially norms) of constitutional law from around the world, these are only a source of law in a substantive, not a formal, sense. They thus belong to what I should like to call a “second order legal positivity.” In this article I will undertake, both at a methodological and an epistemological level, the development of a model for ascertaining global standards of constitutional law

    The Tokyo War Crimes Trial's French Justice Bernard and his Dissenting Judgment, Jean Esmein. Justice Röling of The Nederlands, who had been sitting in the judgment tribune close to Henri Bernard at the IMTFE, has said in his interviews, when The Tokyo Trial and Beyond was written, that thinking the Memorandum of Dissent of the Honourable Mr Justice Bernard over in the forty years after the trial, he had corne to esteem more and more his insight. Yet the french Indictment in Tokyo has not been much analysed until now, and the personality of the french representative at the IMTFE is still less known.
