    Going Rogue: \u3cem\u3eStop the Beach Renourishment\u3c/em\u3e as an Object of Morbid Fascination

    Scholarly response to the Supreme Court\u27s decision in Stop the Beach Renourishment, Inc. v. Florida Department of Environmental Protection has focused on the plurality\u27s strong advocacy of a judicial takings doctrine. We take a different tack. While the concept of judicial takings is worthy of serious attention, it is wrong to treat the plurality opinion as an ordinary object of analysis. It is, instead, the emanation of a Court going rogue. Three basic symptoms of the pathology stand out. First, sleight of hand. The plurality opinion purports to be about an institutional issue-can a state court commit a taking? - while slipping in a major rewrite of takings law that would undermine the Court\u27s recent, unanimous effort to clarify it. Second, feigned obliviousness: The plurality opinion conveniently overlooks the Court\u27s federalism jurisprudence even as it would expand the federal courts\u27 power over state law. Third, knowing artlessness: Despite being written as a virtuoso performance -identifying a case the Florida Supreme Court overlooked - the plurality\u27s treatment of state law betrays surprising naïveté as to how state law is made, though, as it turns out, this seeming naïveté serves the purpose of shifting power within states from legislatures to courts. While the history and tone of Justice Scalia\u27s close attention to beach access issues makes pique a surprisingly strong candidate for why the plurality went rogue, the more worrying explanation is the willingness of the Court\u27s more conservative members to expand their own power into new areas of state law without the slightest sign of support from the political branches. There is a danger that conservative attacks on courts over decisions on controversial social issues will distract from a more basic problem: If the Court\u27s enforcement of federalism rests on what Justice O\u27Connor called Congress\u27s underdeveloped capacity for self-restraint, we suggest that commentary should focus on the Court\u27s own similarly underdeveloped capacity

    Endogenous cross-talk of fungal metabolites

    Non-ribosomal peptide (NRP) synthesis in fungi requires a ready supply of proteogenic and non-proteogenic amino acids which are subsequently incorporated into the nascent NRP via a thiotemplate mechanism catalyzed by NRP synthetases. Substrate amino acids can be modified prior to or during incorporation into the NRP, or following incorporation into an early stage amino acid-containing biosynthetic intermediate. These post-incorporation modifications involve a range of additional enzymatic activities including but not exclusively, monooxygenases, methyltransferases, epimerases, oxidoreductases, and glutathione S-transferases which are essential to effect biosynthesis of the final NRP. Likewise, polyketide biosynthesis is directly by polyketide synthase megaenzymes and cluster-encoded ancillary decorating enzymes. Additionally, a suite of additional primary metabolites, for example: coenzyme A (CoA), acetyl CoA, S-adenosylmethionine, glutathione (GSH), NADPH, malonyl CoA, and molecular oxygen, amongst others are required for NRP and polyketide synthesis (PKS). Clearly these processes must involve exquisite orchestration to facilitate the simultaneous biosynthesis of different types of NRPs, polyketides, and related metabolites requiring identical or similar biosynthetic precursors or co-factors. Moreover, the near identical structures of many natural products within a given family (e.g., ergot alkaloids), along with localization to similar regions within fungi (e.g., conidia) suggests that cross-talk may exist, in terms of biosynthesis and functionality. Finally, we speculate if certain biosynthetic steps involved in NRP and PKS play a role in cellular protection or environmental adaptation, and wonder if these enzymatic reactions are of equivalent importance to the actual biosynthesis of the final metabolite

    X-Ray Evidence for Flare Density Variations and Continual Chromospheric Evaporation in Proxima Centauri

    Using the XMM-Newton X-ray observatory to monitor the nearest star to the Sun, Proxima Centauri, we recorded the weakest X-ray flares on a magnetically active star ever observed. Correlated X-ray and optical variability provide strong support for coronal energy and mass supply by a nearly continuous sequence of rapid explosive energy releases. Variable emission line fluxes were observed in the He-like triplets of OVII and NeIX during a giant flare. They give direct X-ray evidence for density variations, implying densities between 2x10^{10} - 4x10^{11} cm^{-3} and providing estimates of the mass and the volume of the line-emitting plasma.     Eliminating stray radiation inside large area imaging arrays

    With increasing array size, it is increasingly important to control stray radiation inside the detector chips themselves. We demonstrate this effect with focal plane arrays of absorber coupled Lumped Element microwave Kinetic Inductance Detectors (LEKIDs) and lens-antenna coupled distributed quarter wavelength Microwave Kinetic Inductance Detectors (MKIDs). In these arrays the response from a point source at the pixel position is at a similar level to the stray response integrated over the entire chip area. For the antenna coupled arrays, we show that this effect can be suppressed by incorporating an on-chip stray light absorber. A similar method should be possible with the LEKID array, especially when they are lens coupled.Comment: arXiv admin note: substantial text overlap with arXiv:1707.0214

    High Fidelity Collision Probabilities Estimated Using Brute Force Monte Carlo Simulations

    The NASA Conjunction Assessment Risk Analysis team has implemented new software to estimate the probability of collision (P (sub c)) for Earth-orbiting satellites. The algorithm employs a brute force Monte Carlo (BFMC) method which differs from most other methods because it uses orbital states and covariances propagated from their orbit determination epoch times using the full set of Astrodynamics Support Workstation higher order theory models, including the High Accuracy Satellite Drag Model. This paper de-scribes the BFMC algorithm, presents comparisons of BFMC P (sub c) estimates to those calculated using other methods, and discusses the implications for conjunction risk assessment

    Optical Light Curve of the Type Ia Supernova 1998bu in M96 and the Supernova Calibration of the Hubble Constant

    We present the UBVRI light curves of the Type Ia supernova SN 1998bu which appeared in the nearby galaxy M96 (NGC 3368). M96 is a spiral galaxy in the Leo I group which has a Cepheid-based distance. Our photometry allows us to calculate the absolute magnitude and reddening of this supernova. These data, when combined with measurements of the four other well-observed supernovae with Cepheid based distances, allow us to calculate the Hubble constant with respect to the Hubble flow defined by the distant Calan/Tololo Type Ia sample. We find a Hubble constant of 64.0 +/- 2.2(internal) +/- 3.5(external) km/s/Mpc, consistent with most previous estimates based on Type Ia supernovae. We note that the two well-observed Type Ia supernovae in Fornax, if placed at the Cepheid distance to the possible Fornax spiral NGC 1365, are apparently too faint with respect to the Calan/Tololo sample calibrated with the five Type Ia supernovae with Cepheid distances to the host galaxies.Comment: AAS LaTeX, 20 pages, 4 figures, 6 tables, accepted for publication in the Astronomical Journal.
