    Holdings as Hypotheses: Teaching Contextual Understanding and Enhancing Engagement

    When the Pinball Wizard asked his well-timed question, he not only lit up the 1L classroom with a cacophony of opinions but also illuminated deep confusion about the meaning of, and distinctions between, “rules” and “holdings.”The practice of both oversimplifying and conflating the parts of a judicial opinion, particularly rules and holdings, is common among law professors, law school success materials, and, to an extent, even legal writing texts. Coupled with the novice law student’s search for right answers and found meaning, 1Ls often find themselves understandably frustrated and confused. This Article argues that the resulting confusion about rules and holdings is an opportunity ripe for introducing contextual understanding and for modeling this metacognitive approach to reading legal texts. Further, it demonstrates how to persuade 1Ls, even the doubters, that contextual understanding will enable their early fluency in the logic of judicial opinions.With buy-in for contextual understanding achieved, this Article next proposes teaching holdings as hypotheses and offers two detailed examples for doing so. Finally, it explains how teaching holdings as hypotheses—itself an example of contextual understanding—will achieve at least three classroom objectives: (1) focusing 1L attention on constructed meaning and the malleability of law; (2) emphasizing the evolution of law, including how holdings themselves can be fundamentally altered without being overruled or criticized; and (3) enhancing classroom engagement, particularly among Gen-Z students who may otherwise be reticent to participate

    The reward value of infant facial cuteness tracks within-subject changes in women’s salivary testosterone

    “Baby schema” refers to infant characteristics, such as facial cues, that positively influence cuteness perceptions and trigger caregiving and protective behaviors in adults. Current models of hormonal regulation of parenting behaviors address how hormones may modulate protective behaviors and nurturance, but not how hormones may modulate responses to infant cuteness. To explore this issue, we investigated possible relationships between the reward value of infant facial cuteness and within-woman changes in testosterone, estradiol, and progesterone levels. Multilevel modeling of these data showed that infant cuteness was more rewarding when women’s salivary testosterone levels were high. Moreover, this within-woman effect of testosterone was independent of the possible effects of estradiol and progesterone and was not simply a consequence of changes in women’s cuteness perceptions. These results suggest that testosterone may modulate differential responses to infant facial cuteness, potentially revealing a new route through which testosterone shapes selective allocation of parental resources

    New interactions in the dark sector mediated by dark energy

    Cosmological observations have revealed the existence of a dark matter sector, which is commonly assumed to be made up of one particle species only. However, this sector might be more complicated than we currently believe: there might be more than one dark matter species (for example, two components of cold dark matter or a mixture of hot and cold dark matter) and there may be new interactions between these particles. In this paper we study the possibility of multiple dark matter species and interactions mediated by a dark energy field. We study both the background and the perturbation evolution in these scenarios. We find that the background evolution of a system of multiple dark matter particles (with constant couplings) mimics a single fluid with a time-varying coupling parameter. However, this is no longer true on the perturbative level. We study the case of attractive and repulsive forces as well as a mixture of cold and hot dark matter particles

    Galaxy Orientations in the Coma Cluster

    We have examined the orientations of early-type galaxies in the Coma cluster to see whether the well-established tendency for brightest cluster galaxies to share the same major axis orientation as their host cluster also extends to the rest of the galaxy population. We find no evidence of any preferential orientations of galaxies within Coma or its surroundings. The implications of this result for theories of the formation of clusters and galaxies (particularly the first-ranked members) are discussed.Comment: Accepted for publication in the Astrophysical Journal Letters. 4 pages, 4 figure

    Slow roll inflation in the presence of a dark energy coupling

    In models of coupled dark energy, in which a dark energy scalar field couples to other matter components, it is natural to expect a coupling to the inflaton as well. We explore the consequences of such a coupling in the context of single-field slow-roll inflation. Assuming an exponential potential for the quintessence field we show that the coupling to the inflaton causes the quintessence field to be attracted toward the minimum of the effective potential. If the coupling is large enough, the field is heavy and is located at the minimum. We show how this affects the expansion rate and the slow-roll of the inflaton field, and therefore the primordial perturbations generated during inflation. We further show that the coupling has an important impact on the processes of reheating and preheating

    Native rodent species are unlikely sources of infection for Leishmania (Viannia) braziliensis along the Transoceanic Highway in Madre de Dios, Peru.

    An estimated 2.3 million disability-adjusted life years are lost globally from leishmaniasis. In Peru's Amazon region, the department of Madre de Dios (MDD) rises above the rest of the country in terms of the annual incidence rates of human leishmaniasis. Leishmania (Viannia) braziliensis is the species most frequently responsible for the form of disease that results in tissue destruction of the nose and mouth. However, essentially nothing is known regarding the reservoirs of this vector-borne, zoonotic parasite in MDD. Wild rodents have been suspected, or proven, to be reservoirs of several Leishmania spp. in various ecosystems and countries. Additionally, people who live or work in forested terrain, especially those who are not regionally local and whose immune systems are thus naĂŻve to the parasite, are at most risk for contracting L. (V.) braziliensis. Hence, the objective of this study was to collect tissues from wild rodents captured at several study sites along the Amazonian segment of the newly constructed Transoceanic Highway and to use molecular laboratory techniques to analyze samples for the presence of Leishmania parasites. Liver tissues were tested via polymerase chain reaction from a total of 217 rodents; bone marrow and skin biopsies (ear and tail) were also tested from a subset of these same animals. The most numerous rodent species captured and tested were Oligoryzomys microtis (40.7%), Hylaeamys perenensis (15.7%), and Proechimys spp. (12%). All samples were negative for Leishmania, implying that although incidental infections may occur, these abundant rodent species are unlikely to serve as primary reservoirs of L. (V.) braziliensis along the Transoceanic Highway in MDD. Therefore, although these rodent species may persist and even thrive in moderately altered landscapes, we did not find any evidence to suggest they pose a risk for L. (V.) braziliensis transmission to human inhabitants in this highly prevalent region

    ESG in the financial industry: What matters for rating analysts?

    This paper examines ESG rating analysts' views from Sustainalytics in order to highlight the main ESG features discussed across 11 sectors. We perform a topic modeling and a sentiment analysis to identify the content of analysts' opinions on the companies' ESG performance and to uncover the embedded sentiment associated with each ESG feature. The results of the topic modeling consist of 13 topics with a sector driven distribution. The analysis suggests that the best ESG performing financial institutions show to be actively committed to the code of best practice in governance and disclosure transparency. Whereas penalized financial entities seem to manifest less attention to ethical conduct and mis-selling. Furthermore, data privacy and security attract analysts' attention and should be closely monitored by financial entities. Finally, it is important to actively disclose ESG activities as the more information is available the better ESG commitment is reflected in analysts' views
