    Values as Variables in Judicial Decision-Making: Notes Toward a Theory

    The concept of values is central to the explanation of judicial decision-making. Indeed, Clark L. Hull has gone so far as to say that any fairly detailed and sound dynamic theory of behavior must contain an empirical theory of values. Although students of judicial behavior have used values, or some equivalent concept, in their studies, there has been as yet no thorough, systematic exploration of values with a view toward using it as the central concept in building an empirical theory of judicial decision-making. This paper is a modest step in that direction. It is not, however, a presentation of the empirical theory of values to which Hull referred. Rather, it is a presentation of some notes toward such a theory in the hope that they will be useful in the eventual development of a fairly detailed and sound dynamic theory of judicial decision-making

    Aufbauend auf im Rahmen eines Delphi-Verfahrens erhobenen Daten und Erkenntnissen werden ökonomische Verwertungs- und Geschäftsmodelloptionen für ein Blockchain-basiertes Gesundheitsdatenmanagement- und Zugriff-/Rechteverwaltungssystem zur Einbettung in den ersten deutschen Gesundheitsmarkt diskutiert und reflektiert. Im Fokus steht hierbei die im Rahmen eines BMBF-geförderten Verbundprojekts entwickelte und im Entlassmanagement für onkologische Patientinnen prototypisch umgesetzte BloG³-Lösung. Eine reibungslose sektorenübergreifende, interdisziplinäre Versorgung im Behandlungsprozess von Onkologie-Patientinnen ist als Anwendungsfall von besonderer Relevanz, da hier zahlreiche sowohl stationäre als auch ambulante Versorgungsanbieter eingebunden sind und es hier bei der Überleitung oft noch zu Versorgungs-, Medien- und Informationsbrüchen kommt. In dem Diskussionsbeitrag beschreiben und analysieren wir sowohl den aktuellen und zukünftig zu erwartenden Stand der digitalen Transformation des Gesundheitswesens, als auch die Besonderheiten des deutschen Gesundheitswesens mit Fokus auf die Möglichkeiten für digitale Innovationen profitabel in den regulierten ersten Gesundheitsmarkt in Form von erstattungsfähigen Gesundheitsleistungen zu gelangen. Unter Berücksichtigung der aktuellen und absehbaren zukünftigen Rahmenbedingungen werden mithilfe der Expertinnenmeinungen aus dem Delphi-Verfahren mögliche Szenarien für die Verwertung der BloG³-Lösung für verschiedene Zeithorizonte (kurz-, mittel-, langfristig) reflektiert und diskutiert

    Towards a Reference Architecture for Female-Sensitive Drug Management

    Due to various biological factors, males and females differ in their response to drug treatment. However, there is still a lack of knowledge of the effects resulting from sex-differences in the medical field, especially due to the issue of underrepresentation of females in clinical studies. Considering severe diseases that are related to the cardiovascular system, which are likely to be perilous, counteracting this lack and emphasizing the need for sex-dependent drug treatment is of high importance. Thus, this research-in-progress paper aims at strengthening the female perspective in drug management by proposing design considerations on IS regarding recommender systems in healthcare for reinforcing shared decision-making and person-centered care. The resulting artefact presented will be a reference architecture with a mobile application as the interface to patients and healthcare professionals as well as a data- driven backend to collect and process data on sex specificity in the medical treatment of cardiovascular diseases (CVD)

    Judicial leadership on the UK Supreme Court

    This paper examines judicial leadership on the UK Supreme Court. It does not confine itself to the formal roles of the President and Deputy President. Rather, building on existing categories of judicial leadership, including administrative, jurisprudential and community leadership, it considers the contributions of all 12 Justices. In so doing, it provides a significant compilation of quantitative data on the activities of the Justices of the Supreme Court both on and off the bench from the the Court's inception in 2009 to the end of the 2014-2015 legal year. From this, we suggest that while a number of the Justices engaged in one or two broad forms of leadership-with Lady Hale in particular demonstrating a substantial degree of leadership across all three dimensions- A t the other end of the spectrum, at least on the measures used in this paper, a significant minority did not. In the light of this, and the significant number of recent and forthcoming retirements from the Court, the paper concludes by considering the implications of our findings for the future of the Court. We argue that these retirements will result in gaps in both formal and informal judicial leadership, and it is vital that these gaps are filled by appointees who are capable of, and prepared to step up to, diverse and varied forms of judicial leadership
