Part II describes the first sale doctrine as it has traditionally been applied to non-digital works. Part III discusses modern technology\u27s impact on the distribution and use of copyrighted material. Part IV explores the means by which the first sale doctrine has grown inapplicable to digital works, addressing the use of license agreements, uncertainty as to the Copyright Act, and the DMCA provisions that render the first sale doctrine incompatible with digital works. Part V discusses the impacts on commerce resulting from frustration of the first sale doctrine. Part VI suggests technological methods to protect copyright owners\u27 interests if a digital first sale doctrine were enacted. Part VII concludes by arguing that Congress should implement a digital first sale doctrine

    Benchmarking animal handling outcomes and analyzing impacting factors on cow-calf operations

    2022 Spring.Includes bibliographical references.Animal handling is an important part of the cattle industry; proper handling of animals can improve animal welfare and increase consumer confidence. One way handling is assessed on cow-calf operations is through producer education programs, such as the Beef Quality Assurance (BQA) program. A part of these producer education programs is assessing animal handling outcomes. However, there has not been much research into the occurrence and implication of cow handling outcomes. The objectives of this study were to: 1) quantify handling outcomes on cow-calf operations in the United States and 2) investigate potential factors that may influence these outcomes. An assessment was developed by refining existing BQA Cow-Calf program outcome definitions in addition to questions about animal factors, facilities, and management factors. Handling outcomes observed included: Prod Use, Miscatch, Vocalization, Jump, Slip/Stumble, Fall and Run. A total of 76 cow-calf operations were sampled in 24 states (Central, n = 17; East, n = 30; West, n = 29), with herd sizes ranging from 10 head to more than 5,000 head. Observations occurred during processing of either cows or yearling heifers through a cattle chute restraint system, regardless of procedure being performed. With herds less than 100 head, all cows or yearling heifers were observed as they moved through the single file alley, into the chute, and upon exiting the chute for a distance of three body lengths. On operations greater than 100 head, a maximum of 100 contiguous head were observed. Results indicate that most participants were BQA trained (70%) and had crossbred herds (63%) with a Docile temperament (57%) and had Daily Visual Contact with their herds (47%). The mean observations for Prod Use (18.1% ± 28.9), Miscatch (2.5% ± 5.1), and Fall (2.5% ± 4.2) exceeded the upper limit of BQA standards. The BQA threshold for Prod Use is 10%, Miscatch is 0%, and Fall is 2%. Vocalization (3.8% ± 7.6), Jump (7.5% ± 9.9), Run (7.7% ± 13.8), and Slip/Stumble (6.3% ± 9.1) were within BQA thresholds (5%, 25%, and 10% respectively). Prod Use had the greatest number of impacting factors including BQA status, Herd Size Group, Temperament, and Visual Contact while Miscatch, Vocalization, and Fall all had single impacting factors (Region, Temperament, Visual Contact, respectively). Visual Contact and Temperament had an association with the majority of outcomes. Future research should focus more in-depth on specific factors and the variety contained within and on the role of veterinarians in handling outcome frequencies

V části teoretické, v souladu se zadáním, se podrobněji rozebírá pojetí doručování ve veřejné správě a je vymezen teoretický a praktický rámec doručování ve veřejné správě jako celku se zaměřením na obce. Cílem části praktické je pak analýza současného stavu v konkrétní obci. V návaznosti na tuto analýzu jsou pak uvedeny hlavní nedostatky a navržena možná řešení ke zlepšení jejího postavení jako odesílatele velkého počtu písemností.The master thesis deals with methods of delivery in public administration with a focus on municipalities. In theoretical part of this work, in accordance with the specifications, is analysed in detail the whole concept of delivery in public administration and there is also set the theoretical and practical frame of delivery in public administration at all. The aim of the practical part is to analyse the current state in a selected Czech municipality.     Tato bakalářská práce se zabývá postavením věřitele a dlužníka ve stávající právní úpravě ČR. V části teoretické této práce, v souladu se zadáním, se podrobněji rozebírá pojetí závazkového práva, spolu s jeho vznikem, změnou či zánikem. Závěr teoretické části pak patří možnostem zajištění pohledávky a jejího vymáhání. Cílem části praktické je pak analyzování současného stavu v konkrétní české společnosti XY s.r.o. V návaznosti na tuto analýzu jsou pak uvedeny hlavní nedostatky při vymáhání pohledávek od dlužníků a navržena možná řešení ke zlepšení jejího postavení jako věřitele.The bachelor thesis deals with position of creditor and debtor in the existing legislation of the Czech Republic. In theoretical part of this work, in accordance with the specifications, is analysed in detail the whole concept of contract law, along with creation, modification and termination of claims. The conclusion of the theoretical part belongs to the possibilities of securing their claims and enforcement. The aim of the practical part is to analyse the current state of Czech firm XY, s.r.o.     PSV-19 Preliminary exploration of caretaker and manager perspectives of on-farm euthanasia on swine operations

    Abstract Employees on swine operations have the critical role of ensuring animal health and well-being, which sometimes involves performing euthanasia. This study aimed to understand caretaker and manager involvement and perspectives on performing euthanasia on swine farms. Individuals were recruited through online (newsletters and emails to companies) and in-person (e.g. Pig Welfare Symposium, MN) methods in the fall of 2019. The survey consisted of 61 questions on topics related to training, methods of euthanasia, perspectives about euthanasia and knowledge of available mental health resources. Thirty-nine individuals participated in the survey (18 caretakers, 21 managers). Half of respondents (50%, n = 20) indicated that they were involved with making euthanasia decisions. The vast majority of respondents “believe that euthanasia is a humane way to end animal suffering” (95%; n = 36) and that “the euthanasia process on-farm is necessary” (97%; n = 34). A quarter of individuals (25%, n = 9) “feel emotionally upset after euthanizing a pig” and 84% (n = 26) indicated it is “easier to euthanize a pig the more they do it.” Additionally, 92% (n = 35) of respondents agreed that they have “enough experience and knowledge to know when to euthanize a pig.” Most of survey respondents (n = 34) agreed that they “feel as though I can communicate with my supervisors if I feel uncomfortable performing euthanasia” and that their “supervisors aim to promote a safe and encouraging work environment” (n = 38). Despite this, a small number of respondents (n = 6) did not feel “as though my supervisors acknowledge concerns that they may have” and did not feel that their supervisors take “an interest in my professional development and/or job performance.” Overall, data suggest that caretakers and managers understand the importance of euthanasia regarding animal well-being and generally feel they can communicate their concerns.</jats:p
