    This study of a scientific and research nature concerns one of the general principles of EU law, namely the principle of direct applicability. The publication contributes to a long-standing discussion on the direct effect of directives as secondary EU legislation. The main objective of the paper is to present the application of directives in the context of horizontal relations. This problem is of fundamental importance for explaining the mechanisms of direct application of the directives that have not been properly implemented in the national legal orders. Although in previous case law the Court of Justice had essentially opted against the concept of direct horizontal effect of directives, the issue in question, for its complexity, was again examined in one of the most recent preliminary rulings, case C-261/20 Thelen Technopark. Referring to that judgment, the author analyses the possibility of using a directive as a “shield” in the judicial application of law with an aim to eliminate a national law provision inconsistent with the directive from the rationale of the judicial decision. In particular, it concerns the possibility for directives to act in horizontal relations in such a manner that boils down to excluding the application of a provision of national law which is incompatible with it. The question of the possible use of directives as a “shield” is also examined from a slightly different perspective, namely from the point of view of the individual and the possibility to invoke a directive by the individual in the main proceedings where another individual wishes to cause an obligation be imposed on the former under the national law inconsistent with the directive. This problem, as can be argued, is ultimately resolved by the Court of Justice in case C-261/20 Thelen Technopark, which states that a national court hearing a dispute between individuals over a claim based on a national provision contrary to a directive is not required to disapply that provision solely on the basis of EU law.Niniejsze opracowanie o charakterze naukowo-badawczym dotyczy jednej z ogólnych zasad prawa Unii Europejskiej, jaką jest reguła bezpośredniego skutku. Publikacja stanowi wkład do trwającej od dawna dyskusji na temat bezpośredniego skutku dyrektyw jako aktów prawa wtórnego Unii Europejskiej. Głównym celem artykułu jest przybliżenie problematyki stosowania przepisów dyrektyw w kontekście stosunków horyzontalnych. Problematyka ta ma fundamentalne znaczenie dla wyjaśnienienia mechanizmów bezpośredniego stosowania dyrektyw, które nie zostały prawidłowo implmentowane do krajowego porządku prawnego. Mimo że we wcześniejszym orzecznictwie Trybunał Sprawiedliwości zasadniczo opowiedział się za odrzuceniem koncepcji bezpośredniego skutku dyrektyw w płaszczyźnie horyzontalnej, przedmiotowe zagadnienie – ze względu na jego złożoność – ponownie było rozpatrywane w jednym z najnowszych postępowań toczących się w trybie prejudycjalnym – sprawie C‑261/20 Thelen Technopark. Odnosząc się do tego wyroku, autorka poddaje analizie możliwość wykorzystania dyrektywy jako „tarczy” w procesie sądowego stosowania prawa w celu eliminacji z podstawy rozstrzygnięcia przepisu prawa krajowego sprzecznego z dyrektywą. W szczególności chodzi o możliwość takiego działania dyrektywy w relacjach horyzontalnych, które sprowadza się do wyłączenia stosowania niezgodnego z nią przepisu prawa krajowego. Problematyka ewentualnego wykorzystania dyrektywy jako „tarczy” jest rozpatrywana również z nieco innej perspektywy, mianowicie z punktu widzenia jednostki i możliwości powołania się przez nią na dyrektywę w postępowaniu krajowym w sytuacji, gdy inna jednostka chce doprowadzić do nałożenia na nią obowiązku przewidzianego przepisami prawa krajowego sprzecznymi z dyrektywą. Problem ten, jak można argumentować, ostatecznie rozstrzyga Trybunał Sprawiedliwości w sprawie C‑261/20 Thelen Technopark, orzekając, że sąd krajowy rozpoznający spór między jednostkami o roszczenie wywiedzione z przepisu krajowego sprzecznego z dyrektywą nie jest zobowiązany odstąpić od stosowania tego przepisu wyłącznie na podstawie prawa Unii Europejskiej

    The role of nitric oxide in the hypothalamic control of LHRH and oxytocin release, sexual behavior and aging of the LHRH and oxytocin neurons.

    Nitric oxide (NO) affects reproductive processes both at the level of the brain and reproductive tract and this review is focused on its role as an essential regulator of the hypothalamic control of reproduction. The data gathered indicate that glutamate stimulates noradrenergic neurons which subsequently activate NO-ergic cells via alpha1-adrenergic receptors. The released NO diffuses into luteinizing hormone-releasing hormone (LHRH) terminals where it triggers LHRH secretion by activation of guanylyl cyclase and cyclooxygenase. The NO released by estrogen-stimulated NO-ergic ventromedial neurons plays a crucial role in the regulation of sexual behavior. Furthermore, an increased expression of inducible nitric oxide synthase in the LHRH and oxytocin neurons underlies the destructive action of NO on the aging of the hypothalamic neuroendocrine pathways. Within the hypothalamo-hypophyseal system, NO exerts an inhibitory effect in the control of oxytocin secretion. This action seems to employ an indirect mechanism by which NO may modulate the release of GABA.     An ultrastructural demonstration of NADPH-diaphorase/nitric oxide synthase activity in the rat striatal astroglia

    In the present study we have used electron microscopical NADPH-diaphorase (NADPH-d) histochemistry as a visualization procedure for nitric oxide synthase (NOS) to examine patterns of activity in the subcellular distribution of NADPH-d in the rat striatal astroglia. Electron microscopical examination revealed deposition of the NADPH-d reaction product in a nuclear envelope, fragments of endoplasmic reticulum and mitochondria. Predominantly mitochondria of astrocytic "end feet" were labelled. Our ultrastructural observations promote the possibility that astroglial NADPH-d/NOS is involved in adaptation of the local blood flow in the striatal microenvironment

The distance of 100 meters in men is more even temporarily, where women come see a big difference over time

    The principle of priority (primacy) means priority of the applicability of EU law over national law of the Member States. From the point of view of the European Union, this principle applies to all national rules of the Member States, regardless of their place in the hierarchy of legal sources, including constitutional provisions. Such an approach, which essentially means unconditional primacy of EU law over national law, was not confirmed in the judgments of the majority of the constitutional courts of the Member States. Thereby, the Court of Justice of the EU, recognizing the need for “constructive dialogue” with the courts of the Member States, introduced some techniques which allow the coexistence of the EU and national legal rules. In particular, in its recent case law, the Court considered the protection of national identities of the Member States as a justification of the limitation of the scope of the applicability of the principle of priority. Thus the Court allowed the requirement of the protection of national identities made the hitherto absolute principle of primacy relative principle, which allows in certain circumstances the possibility of invoking by the Member States their constitutional values in order to withdraw from the priority of the applicability of EU law.Zasada pierwszeństwa (prymatu) oznacza pierwszeństwo stosowania prawa unijnego przed prawem krajowym państw członkowskich. Zasada ta w tzw. ujęciu unijnym dotyczy wszystkich przepisów krajowych państw członkowskich, niezależnie od ich miejsca w hierarchii źródeł prawa, w tym przepisów konstytucyjnych. Takie ujęcie, oznaczające w istocie bezwarunkowy prymat prawa europejskiego nad prawem krajowym, nie znalazło potwierdzenia w orzecznictwie większości trybunałów konstytucyjnych państw członkowskich. Wobec tego Trybunał Sprawiedliwości UE, dostrzegając konieczność podjęcia „konstruktywnego dialogu” z sądami państw członkowskich, wypracował pewne techniki pozwalające na współistnienie unijnych i krajowych rozwiązań prawnych. W szczególności w swoim najnowszym orzecznictwie Trybunał uznał ochronę tożsamości narodowej państw członkowskich za przesłankę uzasadniającą ograniczenie zakresu stosowania zasady pierwszeństwa. Tym samym Trybunał pozwolił, by wymóg ochrony tożsamości narodowej uczynił z dotychczas absolutnej zasady prymatu zasadę względną, która dopuszcza w pewnych sytuacjach możliwość powołania się przez państwa członkowskie na ich wartości konstytucyjne w celu odstąpienia od pierwszeństwa stosowania prawa UE

    Background: Glomus tumor (chemodectomy, paraganglion) is a rarely occurring tumor built of paraganglia, most often located in the common carotid artery division. This slowly increasing tumor develops mostly between the ages of 45 and 50, and more or less evenly in male and female patients. This article describes the characteristics of tumors such as chemodectomy, diagnostic methods, and procedures for medical treatment. Case report: The article describes a case of tumor in the common carotid artery bifurcation diagnosed as chemodectomy with a very rare bilateral locus. The tumor was accidentally discovered during ultrasonography, and confirmed in computer tomography examination. Conclusions: The first examination should be ultrasonography, complemented with color Doppler. A standard angiographic examination should be performed in the case of planned surgery, with one-time-only embolization of tumor vascularization. Computer tomography examination in the angio-CT option with RT3D reconstruction is an adequate method of imaging a tumour such as chemodectomy

    The enteric nervous system consists of about one hundred million of neurons. In big mammals (including humans) intestinal enteric neuronal cells are grouped into three types of intramural ganglia located within myenteric, as well as outer and inner submucosal plexuses, which are connected by numerous nerve fibres. Both nerve fibres and cell bodies located in the gastrointestinal tract utilise a broad spectrum of active substances. One of them is cocaine- and amphetamine-regulated transcript peptide (CART). The goal of the current study was to determinate the distribution and degree of co-localisation of CART with substances taking part in intestinal motor activity by double labelling immunofluorescence technique. During the study CART-, neuronal isoform of nitric oxide synthase (nNOS)-, vasoactive intestinal peptide (VIP)- and/or galanin (GAL) — like immunoreactive (LI) nerve fibres in the circular muscle layer of the human caecum were observed in all patients studied. The degree of co-localisation of particular substances with CART depended on their type. The majority of CART-LI fibres contained simultaneously nNOS, slightly lower degree of co-localisation was observed in the case of the VIP, while simultaneously CART- and GAL-positive nerve fibres were observed less often

    Hypothalamic orexins as possible therapeutic agents in threat and spatial memory disorders

    Orexin-A and orexin-B, neuropeptides produced exclusively in the lateral hypothalamus, have been implicated in various functions, including memory. Their levels are elevated in certain pathological states, such as PTSD, and lowered in other states, e.g., memory deficits. Recent developments have shown the possibilities of using orexins to modulate memory. Their administration can improve the results of test animals in paradigms such as passive avoidance (PA), cued fear conditioning (CFC), and the Morris water maze (MWM), with differences between the orexin used and the route of drug administration. Blocking orexin receptors in different brain structures produces opposing effects of memory impairments in given paradigms. Therefore, influencing the orexinergic balance of the brain becomes a viable way to ameliorate memory deficits, shift PTSD-induced recall of stressful memories to an extinction path, or regulate other memory processes
