    Warping the Rules: How Some Courts Misapply Generic Evidentiary Rules to Exclude Polygraph Evidence

    Polygraph tests rely on the hypothesis that a subject\u27s body yields physiologically different symptoms if he or she is lying.\u27 When a polygraph test is administered, a mechanical apparatus records the subject\u27s physiological changes, and the polygrapher conducting the examination interprets the data. The techniques for measuring physiological changes vary in their foci, which may include respiration, blood pressure, cardiovascular function, and skin resistance. The polygraph apparatus records changes to one or more of these foci, and a technician, or polygrapher, then analyzes the results to conclude whether the subject has been truthful. Polygraph results factor into choices ranging from indictment determinations to employment decisions. Between 1981 and 1997, the Pentagon conducted more than 400,000 polygraph examinations. Similarly, state law enforcement officers have conducted thousands of polygraph examinations. Even in the private sector, where federal law significantly limits private employers from requesting polygraph examinations, employee test results may lead to criminal liability. While other segments of society use polygraph results, courts remain reluctant to admit them. Although only two federal circuits employ common law bans against polygraph evidence, district courts in every circuit consistently reject polygraph evidence. Similarly, many state courts have excluded polygraph evidence for all purposes.\u27 Unfortunately, many of these courts can only exclude polygraph evidence by warping generic evidentiary rules to act as per se bans. Important work and areas of study occur all over the world. Collaborations and ability to access sources of data and other resources are increasingly important to scientific progress. In many fields, we see more and more inter-institutional collaborations on research and papers that draw on the strengths of each of these institutions. Exchanges of ideas and collaboration and review of proposals should not be limited to one country, or even to developed areas. Especially in such areas as the health and social sciences and in all of the various fields that study "global and environmental future" issues, participation of scientists in developing areas has become crucial. This is true whether the scientists themselves are indigenous to, or visiting in, those areas; indeed, as the community becomes more international, the distinction between the two is gradually becoming less clear

    Correlation of Structural Analysis and Test Results for the McDonnell Douglas Stitched/RFI All-Composite Wing Stub Box

    The analytical and experimental results of an all-composite wing stub box are presented in this report. The wing stub box, which is representative of an inboard portion of a commercial transport high-aspect-ratio wing, was fabricated from stitched graphite-epoxy material with a Resin Film Infusion manufacturing process. The wing stub box was designed and constructed by the McDonnell Douglas Aerospace Company as part of the NASA Advanced Composites Technology program. The test article contained metallic load-introduction structures on the inboard and outboard ends of the graphite-epoxy wing stub box. The root end of the inboard load introduction structure was attached to a vertical reaction structure, and an upward load was applied to the outermost tip of the outboard load introduction structure to induce bending of the wing stub box. A finite element model was created in which the center portion of the wing-stub-box upper cover panel was modeled with a refined mesh. The refined mesh was required to represent properly the geometrically nonlinear structural behavior of the upper cover panel and to predict accurately the strains in the stringer webs of the stiffened upper cover panel. The analytical and experimental results for deflections and strains are in good agreement

    Comparative Structural and Antigenic Characterization of Genetically Distinct Flavobacterium psychrophilum O-Polysaccharides

    Little is known about the underlying basis of serotype specificity among strains of Flavobacterium psychrophilum, the agent of rainbow trout fry syndrome and bacterial cold-water disease. The identification of different heat-stable O-serotypes among strains of this gram-negative pathogen does, however, suggest structural variations in the O-polysaccharide (O-PS) moiety of cell surface lipopolysaccharide (LPS). A trisaccharide composed of L-rhamnose (L-Rha), 2-acetamido-2-deoxy-L-fucose (L-FucNAc) and 2-acetamido-4-R-2,4-dideoxy-D-quinovose (D-Qui2NAc4NR), where R represents a dihydroxyhexanamido derivative, was previously identified as the repeating unit of Fp CSF259-93 O-PS. Interestingly, the O-PS gene cluster of this strain and that of Fp 950106-1/1, which belongs to a different O-serotype, are identical except for wzy, which encodes the putative polymerase that links trisaccharide repeats into O-PS chains. We have now found from results of glycosyl composition analysis and high-resolution nuclear magnetic resonance, that the linkage of D-Qui2NAc4NR to L-Rha, which is α1-2 for Fp CSF259-93 versus β1-3 for Fp 950106-1/1, is the only structural difference between O-PS from these strains. The corresponding difference in O-serotype specificity was established from the reactions of rabbit and trout anti-F. psychrophilum antibody with purified O-PS and LPS. Moreover, LPS-based differences in antigenicity were noted between strains with O-PS loci identical to those of Fp CSF259-93 or Fp 950106-1/1, except for the genes predicted to direct synthesis of different R-groups in Qui2NAc4NR. The findings provide a framework for defining the genetic basis of O-PS structure and antigenicity and suggest that the repertoire of F. psychrophilum O-serotypes extends beyond what is presently recognized from serological studies of this important fish pathogen

    Forgotten Antibiotics: An Inventory in Europe, the United States, Canada, and Australia

    In view of the alarming spread of antimicrobial resistance in the absence of new antibiotics, this study aimed at assessing the availability of potentially useful older antibiotics. A survey was performed in 38 countries among experts including hospital pharmacists, microbiologists, and infectious disease specialists in Europe, the United States, Canada, and Australia. An international expert panel selected systemic antibacterial drugs for their potential to treat infections caused by resistant bacteria or their unique value for specific criteria. Twenty-two of the 33 selected antibiotics were available in fewer than 20 of 38 countries. Economic motives were the major cause for discontinuation of marketing of these antibiotics. Fourteen of 33 antibiotics are potentially active against either resistant Gram-positive or Gram-negative bacteria. Urgent measures are then needed to ensure better availability of these antibiotics on a global scal

    A new wrinkle on liquid sheets: Turning the mechanism of viscous bubble collapse upside down

    Viscous bubbles are prevalent in both natural and industrial settings. Their rupture and collapse may be accompanied by features typically associated with elastic sheets, including the development of radial wrinkles. Previous investigators concluded that the film weight is responsible for both the film collapse and wrinkling instability. Conversely, we show here experimentally that gravity plays a negligible role: The same collapse and wrinkling arise independently of the bubble's orientation. We found that surface tension drives the collapse and initiates a dynamic buckling instability. Because the film weight is irrelevant, our results suggest that wrinkling may likewise accompany the breakup of relatively small-scale, curved viscous and viscoelastic films, including those in the respiratory tract responsible for aerosol production from exhalation events.Accepted manuscrip

    Sensitivity to Sulfited Foods among Sulfite-Sensitive Subjects with Asthma

    Eight individuals with asthma who had been diagnosed as sulfite sensitive on the basis of double-blind capsule-beverage challenges were subjected to challenges with various sulfited foods, including lettuce, shrimp, dried apricots, white grape juice, dehydrated potatoes (as mashed potatoes), and mushrooms. Four of these patients failed to respond to challenges with any of the sulfited foods. The other four patients experienced a decrease in pulmonary function on double-blind challenges with sulfited lettuce. Two of three of these patients reacted to challenges with dried apricots and white grape juice; the fourth patient has not yet been challenged with these products. Only one of these four patients reacted to challenges with dehydrated potatoes and mushrooms, and, in this case, the response to double-blind challenges with dehydrated potatoes was not consistent. None of the sulfite-sensitive subjects with asthma responded to challenges with sulfited shrimp. It is concluded that sulfite-sensitive subjects with asthma will not necessarily react after ingestion of sulfited foods. The likelihood of a reaction is dependent on the nature of the food, the level of residual sulfite, the sensitivity of the patient, and perhaps on the form of residual sulfite and the mechanism of the sulfite-induced reaction
