The treatment of mentally disordered offenders under capacity-based mental health legislation

I agree that someone’s lack of mental capacity, or their inability to make proper choices, as I would prefer, has an intuitive moral force as a criterion for coercing them to accept care. The authors of “A Model Law Fusing Incapacity and Mental Health Legislation” (henceforth AML) are right also, I think, when they suggest that this moral force is reflected in the law’s widespread use of “choice based” criteria todetermine when and to what degree a medical patient’s stated wishes will be respected. I also agree that bad legislation can contribute to the stigmatization of the mentally ill.As AML points out, mental health legislation has to incorporate many principles, some of which are in tension with each other. AML uses, as an example, the balance that has to be achieved between maximizing patient autonomy, on the one hand, and ensuring their safety and that of others, on the other. An essential principle in mental health legislation is that mentally disordered offenders need treatment and that the law should seek to ensure that they get it. As would be the case for any law, other principles will need to be respected too; but this one seems crucial. I am not convinced that the need to ensure treatment receives sufficient attention in AML. I also have some concerns over the details of what is proposed

Calls for a new Mental Health Act for England and Wales, and the government’s response to those calls, raise the question of why we have mental health legislation. One answer is that we wish to provide criteria for psychiatric detention and compulsory treatment. It is argued that we are willing to coerce some people with mental disorders in this way when we conclude that their ability to make a proper choice is impaired. Countless marine species are invading new environments with devastating effects on the ecosystem, the local and global economy, and on human health. The frequency of marine invasions has been increasing in recent decades with a respective raised interest of invasive species in the scientific community, and the general public. The Aquatic Invasive Species class (MAR442) at the University of New England offers an informative overview of invasive species, targeting educated readers with a general interest in invasive species biology. Students in the MAR 442 class have worked on identifying the most important topics on marine invasive species, have reviewed the respective literature and written chapters that provide both a broad overview of the general aspects on marine invasions, as well as a set of individual case studies that illustrate different specific aspects of marine invasions. The class, comprised of fifteen junior and senior marine biology students, selected the different topics, presented the material, wrote the drafts, edited the drafts and assembled the final versions into this book. With a wealth of information on invasive species assembled in peer-reviewed articles, books, other literature, websites, data-bases and more, this book cannot claim to be all inclusive. The Long-Baseline Neutrino Experiment: Exploring Fundamental Symmetries of the Universe

The preponderance of matter over antimatter in the early Universe, the dynamics of the supernova bursts that produced the heavy elements necessary for life and whether protons eventually decay --- these mysteries at the forefront of particle physics and astrophysics are key to understanding the early evolution of our Universe, its current state and its eventual fate. The Long-Baseline Neutrino Experiment (LBNE) represents an extensively developed plan for a world-class experiment dedicated to addressing these questions. LBNE is conceived around three central components: (1) a new, high-intensity neutrino source generated from a megawatt-class proton accelerator at Fermi National Accelerator Laboratory, (2) a near neutrino detector just downstream of the source, and (3) a massive liquid argon time-projection chamber deployed as a far detector deep underground at the Sanford Underground Research Facility. This facility, located at the site of the former Homestake Mine in Lead, South Dakota, is approximately 1,300 km from the neutrino source at Fermilab -- a distance (baseline) that delivers optimal sensitivity to neutrino charge-parity symmetry violation and mass ordering effects. This ambitious yet cost-effective design incorporates scalability and flexibility and can accommodate a variety of upgrades and contributions. With its exceptional combination of experimental configuration, technical capabilities, and potential for transformative discoveries, LBNE promises to be a vital facility for the field of particle physics worldwide, providing physicists from around the globe with opportunities to collaborate in a twenty to thirty year program of exciting science. Legitimacy intermediation in the multilevel European polity and its collapse in the euro crisis

This essay re-examines the dual – republican and liberal – foundations of democratic legitimacy in the Western traditions of normative political theory. Considered in isolation, the European Union conforms to liberal standards but cannot satisfy republican criteria. Given these conflicting standards, debates on the alleged European democratic deficit have remained inconclusive. Moreover, they have failed to pay sufficient attention to the multilevel character of the European polity and to the normative potential of legitimacy intermediation in its two-step compliance and legitimating relationships. I argue, however, that the capacity of democratic member states to legitimate the exercise of European governing functions is being destroyed in the present euro crisis, and I briefly discuss the implications of this new constellation.In der westlichen Tradition der normativen politischen Theorie beruht demokratische Legitimität auf der doppelten Grundlage republikanischer und liberaler Prinzipien.
