Provenience research in the book collection of the Jewish Museum in Prague: a current case of Provenance Research

Ce colloque s’est tenu les jeudi et vendredi 23 et 24 mars 2017, à la Bibliothèque universitaire des langues et civilisations et à la Bibliothèque nationale de France, Il a été organisé par le Centre Gabriel Naudé de l\u27Ecole nationale supérieure des sciences de l\u27information et des bibliothèques (ENSSIB), l\u27Institut d\u27histoire du temps présent (IHTP, UMR CNRS Paris 8) et l\u27Université Paris Diderot (EA Identités, cultures, territoires), avec le soutien de la Bibliothèque nationale de France, de la Bibliothèque universitaire des langues et civilisations (BULAC), de la Fondation pour la Mémoire de la Shoah, de la Claims Foundation, de la Fondation Maison des Sciences de l\u27Homme et du Deutscher Akademischer Austauschdienst. Au cours de ce colloque, une douzaine de livres, datant du XVIIe siècle et retrouvés dans ses collections par la Bibliothèque centrale et régionale de Berlin (Zentral -und Landesbibliothek) ont été restitués à trois ministères français (ministère des Affaires étrangères, ministère de l\u27Intérieur, ministère de la Justice) auxquels ils avaient été spoliées en juin 1940. Un registre manuscrit d\u27état civil des années 1751-1771, spolié à la commune de Verpel (Ardennes) lui sera également restitué. The concept and legal consequences of exceeding the scope of self-defence and necessity

Excessive Use of Force in Self-defence and Necessity - the term and legal implications This work is submitted as a Master thesis on the Charles University in Prague, Faculty of Law. It deals with the use of excessive force in self-defence and necessity, the terms used to evaluate such excess and the implications that it has in the Czech law and in some common law jurisdictions, namely in the Irish republic. In the introductory chapters I have described the general meaning and the use of self-defence and necessity in the Czech legal doctrine. What follows are the limitations placed on these defences under the Czech Criminal Code. Then I went on to explain the specifics of excessive use of force in situations where there was some necessity to use force, but the force actually used did not fit within the relatively broad boundaries of the Czech reasonableness test. The terms used in this context are also defined and the legal implications of such an excess are further elaborated on. I have briefly referred to the changes proposed by the new Criminal Law Bill. The following part deals with the pleas of necessity and selfdefence under the Irish law, specifically addressing the recognition of excessive self-defence as a partial defence to a murder charge. V této práci jsem se pokusil popsat instituty nutné obrany a krajní nouze s ohledem na pojem a důsledky vybočení z jejich mezí. Dále jsem zařadil exkurz do odpovídající úpravy v angloamerickém právu. Na závěr jsem vybral několik myšlenek, jejichž realizace by dle mého názoru mohla přispět ke zlepšení současné právní úpravy. Nejprve jsme se tedy věnovali obecnému pojednání o nutné obraně a krajní nouzi s uvedením podmínek a mezí, za jejichž splnění lze v jejich rámci jednat. Vzájemné rozlišení takových podmínek, které stav nutné obrany či krajní nouze konstituují (existence útoku nebo jiného nebezpečí přímo hrozícího či trvajícího proti zájmu chráněnému trestním zákonem, u krajní nouze navíc subsidiarita a neexistence povinnosti nebezpečí snášet), od mezí, v nichž se lze při jednání samotném pohybovat (zcela zjevná nepřiměřenost obrany způsobu útoku potažmo disproporce následků při odstraňování nebezpečí), bylo potřeba k dalším úvahám o překročení těchto mezí. Stručně byla zmíněna také otázka tzv. putativní nutné obrany a krajní nouze. Posléze jsme se soustředili na problematiku excesu, tedy vybočení ze zmíněných podmínek a mezí těchto okolností vylučujících protiprávnost. Hledisko přiměřenosti akcí u nutné obrany bylo konfrontováno s hlediskem proporcionality následků u krajní nouze.
