    In Klein v. Raysinger the Pennsylvania Supreme Court denied social host liability for the serving of alcoholic beverages to a visibly intoxicated guest who later is involved in a motor vehicle accident. The author assesses the court\u27s opinion in light of the roles traditionally played by the legislature and judiciary, and simultaneously examines the court\u27s reasoning in relation to established Pennsylvania common law negligence principles. The author concludes that while denial of social host liability based on a decision to defer to the legislature in making such a judgment would have been proper, the failure to impose liability on the basis of negligence principles was inconsistent with the general trend of Pennsylvania common law

    Moving Beyond Race, Gender, and Education: Exploring the Relationship Between Disability, Depressive Symptoms and Long-term Financial Outcomes

    Data on poverty status reveals that there is a distinct sub-population of individuals who are at a significantly greater risk of being chronically poor. Although many researchers have examined the demographic characteristics of individuals who are the most likely to be persistently poor, the emphasis has been on race, sex, and education. Little attention has been paid to the role that disability might play in long-term poverty. Therefore, the objective of this paper is to utilize longitudinal Add Health data in order to explore whether or not the presence of a disability might also affect an individual’s likelihood of experiencing financial hardship. We find that in addition to race, gender, and education, individuals with a disability are at greater risk of being poor than their counterparts without disabilities. Overall, having a mental health, physical, or learning disability in childhood or adolescence was associated with straitened socioeconomic outcomes in adulthood

    Carbonate alteration of ophiolitic rocks in the Arabian–Nubian Shield of Egypt: sources and compositions of the carbonating fluid and implications for the formation of Au deposits

    Ultramafic portions of ophiolitic fragments in the Arabian–Nubian Shield (ANS) show pervasive carbonate alteration forming various degrees of carbonated serpentinites and listvenitic rocks. Notwithstanding the extent of the alteration, little is known about the processes that caused it, the source of the CO2 or the conditions of alteration. This study investigates the mineralogy, stable (O, C) and radiogenic (Sr) isotope composition, and geochemistry of suites of variably carbonate altered ultramafics from the Meatiq area of the Central Eastern Desert (CED) of Egypt. The samples investigated include least-altered lizardite (Lz) serpentinites, antigorite (Atg) serpentinites and listvenitic rocks with associated carbonate and quartz veins. The C, O and Sr isotopes of the vein samples cluster between −8.1‰ and −6.8‰ for δ13C, +6.4‰ and +10.5‰ for δ18O, and 87Sr/86Sr of 0.7028–0.70344, and plot within the depleted mantle compositional field. The serpentinites isotopic compositions plot on a mixing trend between the depleted-mantle and sedimentary carbonate fields. The carbonate veins contain abundant carbonic (CO2±CH4±N2) and aqueous-carbonic (H2O-NaCl-CO2±CH4±N2) low salinity fluid, with trapping conditions of 270–300°C and 0.7–1.1 kbar. The serpentinites are enriched in Au, As, S and other fluid-mobile elements relative to primitive and depleted mantle. The extensively carbonated Atg-serpentinites contain significantly lower concentrations of these elements than the Lz-serpentinites suggesting that they were depleted during carbonate alteration. Fluid inclusion and stable isotope compositions of Au deposits in the CED are similar to those from the carbonate veins investigated in the study and we suggest that carbonation of ANS ophiolitic rocks due to influx of mantle-derived CO2-bearing fluids caused break down of Au-bearing minerals such as pentlandite, releasing Au and S to the hydrothermal fluids that later formed the Au-deposits. This is the first time that gold has been observed to be remobilized from rocks during the lizardite–antigorite transition

    Space Use and Movement of Urban Bobcats

    Global urbanization is rapidly changing the landscape for wildlife species that must learn to persist in declining wild spacing, adapt, or risk extinction. Many mesopredators have successfully exploited urban niches, and research on these species in an urban setting offers insights into the traits that facilitate their success. In this study, we examined space use and activity patterns from GPS-collared bobcats (Lynx rufus) in the Dallas–Fort Worth metroplex, Texas, USA. We found that bobcats select for natural/agricultural features, creeks, and water ways and there is greater home-range overlap in these habitats. They avoid roads and are less likely to have home-range overlap in habitats with more roads. Home-range size is relatively small and overlap relatively high, with older animals showing both greater home-range size and overlap. Simultaneous locations suggest bobcats are neither avoiding nor attracted to one another, despite the high overlap across home ranges. Finally, bobcats are active at all times of day and night. These results suggest that access to natural features and behavioral plasticity may enable bobcats to live in highly developed landscapes

    Deposition conditions for the indium-bearing polymetallic quartz veins at Sarvlaxviken, south-eastern Finland

    Polymetallic quartz veins, with up to 1500ppm indium, have been discovered recently in the Sarvlaxviken area within the 1.64Ga anorogenic multiphase Wiborg rapakivi batholith and adjacent 1.90Ga Svecofennian crust in SE Finland. Evidence from primary fluid inclusions in the Sarvlaxviken area provides new information on the hydrothermal transport and depositional processes of metals in anorogenic granites. Fluid inclusions with variable aqueous liquid and vapour proportions (5-90vol.% vapour) occur in quartz, cassiterite and fluorite belonging to three generations of polymetallic quartz veins. Microthermometry indicates that the veins were deposited at temperatures that range from similar to 500 degrees C down to <100 degrees C and salinities from 0 to 16 eq. mass% NaCl. Fluid inclusion data show that the depositional conditions were similar regardless of vein generation. The interpreted depositional processes involve phase separation with a combination of condensation, cooling and boiling of an initially low-salinity (<3 eq. mass% NaCl) aqueous magmatic vapour phase enriched in CO2-F-Cl-S and metals. Fluid inclusions with low salinities dominate, but higher salinities are recorded in metal-rich parts of the veins. The turbulent fluid flow, with complex geometry and temperature-salinity patterns, may explain why sulfide and/or oxide opaque minerals occur irregularly, and are locally the dominating vein minerals, but disappear completely into barren parts of the quartz veins. All fluids are considered to have been generated by the F-rich Marviken granite (and related granite dykes), which show all geochemical criteria for an ore-fertile granite. The quartz veins investigated in the adjacent Svecofennian country rocks are considered to represent the very last stage of a fluid with similar characteristics to the fluid responsible for the ore formation in the Sarvlaxviken area, but that had cooled to <100 degrees C

    Fractionation of rare earth elements in greisen and hydrothermal veins related to A-type magmatism

    This study focuses on concentrations and fractionation of rare earth elements (REE) in a variety of minerals and bulk materials of hydrothermal greisen and vein mineralization in Paleoproterozoic monzodiorite to granodiorite related to the intrusion of Mesoproterozoic alkali- and fluorine-rich granite. The greisen consists of coarse-grained quartz, muscovite, and fluorite, whereas the veins mainly contain quartz, calcite, epidote, chlorite, and fluorite in order of abundance. A temporal and thus genetic link between the granite and the greisen/veins is established via high spatial resolution in situ Rb-Sr dating, supported by several other isotopic signatures (δ34S, 87Sr/86Sr, δ18O, and δ13C). Fluid-inclusion microthermometry reveals that multiple pulses of moderately to highly saline aqueous to carbonic solutions caused greisenization and vein formation at temperatures above 200–250°C and up to 430°C at the early hydrothermal stage in the veins. Low calculated ∑REE concentration for bulk vein (15 ppm) compared to greisen (75 ppm), country rocks (173–224 ppm), and the intruding granite (320 ppm) points to overall low REE levels in the hydrothermal fluids emanating from the granite. This is explained by efficient REE retention in the granite via incorporation in accessory phosphates, zircon, and fluorite and unfavorable conditions for REE partitioning in fluids at the magmatic and early hydrothermal stages. A noteworthy feature is substantial heavy REE (HREE) enrichment of calcite in the vein system, in contrast to the relatively flat patterns of greisen calcite. The REE fractionation of the vein calcite is explained mainly by fractional crystallization, where the initially precipitated epidote in the veins preferentially incorporates most of the light REE (LREE) pool, leaving a residual fluid enriched in the HREE from which calcite precipitated. Fluorite occurs throughout the system and displays decreasing REE concentrations from granite towards greisen and veins and different fractionation patterns among all these three materials. Taken together, these features confirm efficient REE retention in the early stages of the system and minor control of the REE uptake by mineral-specific partitioning. REE-fractionation patterns and fluid-inclusion data suggest that chloride complexation dominated REE transport during greisenization, whereas carbonate complexation contributed to the HREE enrichment in vein calcite

    Acute-Phase CD8 T cell responses that select for escape variants are needed to control live attenuated simian immunodeficiency virus

    The overall CD8 T cell response to human/simian immunodeficiency virus (HIV/SIV) targets a collection of discrete epitope specificities. Some of these epitope-specific CD8 T cells emerge in the weeks and months following infection and rapidly select forsequence variants, whereas other CD8 T cell responses develop during the chronic infection phase and rarely select for sequence variants. In this study, we tested the hypothesis that acute-phase CD8 T cell responses that do not rapidly select for escapevariants are unable to control viral replication in vivo as well as those that do rapidly select for escape variants. We created a derivative of live attenuated SIV (SIVmac239Δnef) in which we ablated five epitopes that elicit early CD8 T cell responses and rapidly accumulate sequence variants in SIVmac239-infected Mauritian cynomolgus macaques (MCMs) that are homozygous for the M3 major histocompatibility complex (MHC) haplotype. This live attenuated SIV variant was called m3KOΔnef. Viremia was significantly higher in M3 homozygous MCMs infected withm3KOΔnef than in either MHC-mismatched MCMs infected with m3KOΔ nef or MCMs infected with SIVmac239Δnef. Three CD8 T cell responses, including two that do not rapidly select for escape variants, predominated during earlym3KOΔnef infection in the M3 homozygous MCMs, but these animals were unable to control viral replication. These re-sults provide evidence that acute-phase CD8 T cell responses that have the potential to rapidly select for escape variants in the early phase ofinfection are needed to establish viral control in vivo
