Akibat Hukum Tentang Debitur Yang Pailit Menurut Undang-undang Nomor 37 Tahun 2004
Penelitian ini dilakukan dengan tujuan untuk mengetahui bagaimana akibat hukum setelah debitur dinyatakan pailit menurut Undang-Undang Nomor 37 Tahun 2004 dan bagaimana tata cara mengajukan permohonan kepailitan menurut Undang-Undang Nomor 37 Tahun 2004. Dengan menggunakan metode penelitian yuridis normatif, disimpulkan: 1. Akibat hukum setelah debitur dinyatakan pailit menurut Undang-Undang Nomor 37 tahun 2004 adalah 1) debitur kehilangan hak menguasai dan mnegurus harta kekayaannya; 2) perikatan yang muncul setelah pernyataan pailit tidak dapat dibebankan ke budel pailit; 3) tuntutan terhadap harta pailit diajukan ke dan atau oleh kurator; 4) penyitaan menjadi hapus; 5) bila debitur ditahan harus dilepas. 2. Tata cara pengajuan permohonan kepailitan menurut Undang-Undang Nomor 37 Tahun 2004 yaitu undang-undang tidak mengharuskan bahwa permohonan kepailitan dilakukan dengan perantara seorang pengacara dan permohonan harus secara tertulis disampaikan kepada panitera. Sesudah permohonan diterima oleh pengadilan negeri yang berwenang, maka hakim akan menetapkan hari, tanggal, jam dan tempat sidang. Pemeriksaan permohonan kepailitan dilakukan secara cepat dalam rapat permusyawaratan itu dengan majelis hakim. Selanjutnya pembicaraan permohonan kepailitan dilakukan dalam sidang tertutup, sedangkan putusannya diucapkan dalam sidang terbuka untuk umum
Perlindungan Hukum terhadap Kreditur Atas Pembatalan Sertipikat Hak Milik yang Sedang Dibebani Hak Tanggungan (Studi Putusan Mahkamah Agung, Nomor 140/ktun/2011)
The cancellation of the right to land certificate which is being imposed by the collateral right by the decision of the Supreme Court No.140/K/TUN/2011 due to its procedural deficiency in its issuance and this will inflict loss to the creditor because the creditor will lose the object of the collateral of the debitor's credit. The theory used in analyzing this cancellation of the right to land certificate being imposed by the collateral right by the decision of the Supreme Court No.140/K/TUN/2011 was based on the principles of legal protection developed by Satjipto Raharjo supported by the legal certainty developed by E. Utrecht, and the principles of the legal purpose developed by Van Apeldoorn. This normative juridical study was to analyze the decision of the Supreme Court No.140/K/TUN/2011 and related it to the regulation of legislation, legal documents, and the text books related to the formulation of research problems. The data for this study were obtained through inventorying the basic reason of the decision of the Supreme Court. The cancellation of the right to land certificate being imposed by the collateral right waived the object of the collateral right, but since the issuance of collateral right because of the credit agreement made by the creditor and the debtor, that even though the collateral right has been waived, it does not mean that all of the debtor's credit or debt was paid off, because it is still bound by the credit agreement made by the creditor and debtor, and all of the debtor's properties both movable and fixed properties, both available and will be available become the responsibility of all contracts
Penerapan Metode Activity Based Costing System Dalam Menentukan Besarnya Tarif Jasa Rawat Inap Pada Rumah Sakit Umum Bethesda Kota Tomohon
Rumah sakit merupakan organisasi yang berorientasi nonprofit, dimana tugas utamanya adalah memberikan jasa pengobatan, perawatan, dan pelayanan kesehatan. Dalam memberikan jasa pelayanan kesehatan, rumah sakit memperoleh penghasilan dari pendapatan jasa dan fasilitas yang diberikan, salah satunya adalah jasa rawat inap, dimana pendapatan dari jasa tersebut didapat dari tarif yang harus dibayar oleh pemakai jasa rawat inap. Penentuan tarif jasa rawat inap merupakan suatu keputusan yang sangat penting, karena akan mempengaruhi profitabilitas rumah sakit. Penelitian ini dilakukan pada rumah sakit umum daerah kota Tomohon. Penelitian bertujuan untuk mengetahui penerapan metode activity based costing dalam menentukan besarnya tarif jasa rawat inap pada rumah sakit umum Bethesda Tomohon. Metode yang digunakan analisis deskriptif. Hasil perhitungan tarif rawat inap menggunakan metode ABC, bila dibandingkan dengan metode tradisional maka metode ABC memberikan laba yang lebih besar kecuali pada kelas VIP dan Utama I yang memberikan laba lebih kecil. Pihak manajemen sebaiknya mulai mempertimbangkan perhitungan tarif rawat inap dengan menggunakan metode ABC seperti tarif pesaing dan kemampuan masyarakat yang dapat mempengaruhi dalam penetapan harga pelayanan rawat inap. Type I Superconductivity in YbSb2 Single Crystals
We present evidence of type I superconductivity in YbSb2 single crystals,
from DC and AC magnetization, heat capacity and resistivity measurements. The
critical temperature and critical field are determined to be 1.3 K
and 55 Oe. A small Ginzburg-Landau parameter \kappa = 0.05,
together with typical magnetization isotherms of type I superconductors, small
critical field values, a strong Differential Paramagnetic Effect (DPE) signal,
and a field-induced change from second to first order phase transition, confirm
the type I nature of the superconductivity in YbSb2. A possible second
superconducting state is observed in the radiofrequency (RF) susceptibility
measurements, with 0.41 K and 430 Oe.Comment: 6 pages, 10 figure
Quantum wire junctions breaking time reversal invariance
We explore the possibility to break time reversal invariance at the junction
of quantum wires. The universal features in the bulk of the wires are described
by the anyon Luttinger liquid. A simple necessary and sufficient condition for
the breaking of time reversal invariance is formulated in terms of the
scattering matrix at the junction. The phase diagram of a junction with generic
number of wires is investigated in this framework. We give an explicit
classification of those critical points which can be reached by bosonization
and study the interplay between their stability and symmetry content.Comment: Extended version (Appendices C and D and some references added, typos

Enabling matter power spectrum emulation in beyond-ΛCDM cosmologies with COLA
We compare and validate COLA (COmoving Lagrangian Acceleration) simulationsagainst existing emulators in the literature, namely Bacco and Euclid Emulator2. Our analysis focuses on the non-linear response function, i.e., the ratiobetween the non-linear dark matter power spectrum in a given cosmology withrespect to a pre-defined reference cosmology, which is chosen to be the EuclidEmulator 2 reference cosmology in this paper. We vary three cosmologicalparameters, the total matter density, the amplitude of the primordial scalarperturbations and the spectral index. By comparing the COLA non-linear responsefunction with those computed from each emulator in the redshift range , we find that the COLA method is in excellent agreement with the twoemulators for scales up to /Mpc as long as the deviations of thematter power spectrum from the reference cosmology are not too large. Wevalidate the implementation of massive neutrinos in our COLA simulations byvarying the sum of neutrino masses to three different values, eV, eV and eV. We show that all three non-linear prescriptions used in thiswork agree at the level at /Mpc. We then introduce theEffective Field Theory of Dark Energy in our COLA simulations using the-body gauge method. We consider two different modified gravity models inwhich the growth of structure is enhanced or suppressed at small scales, andshow that the response function with respect to the change of modified gravityparameters depends weakly on cosmological parameters in these models.<br

Wildfires, exacerbated by extreme weather events and land use, threaten to change the Amazon from a net carbon sink to a net carbon source. Here, we develop and apply a coupled ecosystem-fire model to quantify how greenhouse gas-driven drying and warming would affect wildfires and associated CO2 emissions in the southern Brazilian Amazon. Regional climate projections suggest that Amazon fire regimes will intensify under both low- and high-emission scenarios. Our results indicate that projected climatic changes will double the area burned by wildfires, affecting up to 16% of the region's forests by 2050. Although these fires could emit as much as 17.0 Pg of CO2 equivalent to the atmosphere, avoiding new deforestation could cut total net fire emissions in half and help prevent fires from escaping into protected areas and indigenous lands. Aggressive efforts to eliminate ignition sources and suppress wildfires will be critical to conserve southern Amazon forests
Junctions of anyonic Luttinger wires
We present an extended study of anyonic Luttinger liquids wires jointing at a
single point. The model on the full line is solved with bosonization and the
junction of an arbitrary number of wires is treated imposing boundary
conditions that preserve exact solvability in the bosonic language. This allows
to reach, in the low momentum regime, some of the critical fixed points found
with the electronic boundary conditions. The stability of all the fixed points
