    Operational-Investigative Activities of Judicial Authorization: Features of Performance

    The scientific article is devoted to the study of issues related to the peculiarities of performing operational-investigative activities of judicial authorization enshrined in the Federal Law “On operational-investigative activities” The questions of performing operational-investigative activities and the restrictions on the constitutional rights of citizens, connected with them, are raised. Performing operational-investigative activities, requiring judicial authorization, is impossible without clear knowledge and understanding of not only the Federal Law “On operational-investigative activities” but also the decisions of both the Constitutional Court and the European Court of Human Rights. Understanding these documents makes it possible to competently and fully, in compliance with all the requirements of the law, draw up the necessary documents to obtain the permission of a court, competently and clearly determine which activity should be conducted in each case, taking into account the technical and other features of both the activity itself and the allocated funds. Purpose: to conduct a scientific study of operational-investigative activities of judicial authorization; to analyze the legislation governing the specifics of performing these activities, the powers of the subjects of operationalinvestigative activities when performing the considered activities. As the methods and methodology of conducting the work, formal-logical and dialectical methods, sociological, and historical methods were used. The scientific article is based on a sociological, theoretical, and historical method, on a set of techniques for understanding the legal status of an official, the theory of authorities, and a comparative analysis of legislative norms. The main methodological approach used in the scientific article is the theory of operational-investigative legislation, developed in the works of Russian lawyers. Main results: the study made it possible to identify the advantages and disadvantages of the regulatory framework governing the specifics of conducting operational-investigative activities requiring judicial authorization, as well as significant errors in law enforcement practice. Conclusions and substantiation of the novelty of the work: based on the analysis of the Federal Law “On operational-investigative activities”, insufficient legal elaboration of the legal regulation of operationalinvestigative activities of judicial authorization is substantiated. The ways of solving the existing problems are proposed, including by amending the current legislation on operational-investigative activities

    Registration of atmospheric neutrinos with the Baikal neutrino telescope

    We present first neutrino induced events observed with a deep underwater neutrino telescope. Data from 70 days effective life time of the BAIKAL prototype telescope NT-96 have been analyzed with two different methods. With the standard track reconstruction method, 9 clear upward muon candidates have been identified, in good agreement with 8.7 events expected from Monte Carlo calculations for atmospheric neutrinos. The second analysis is tailored to muons coming from close to the opposite zenith. It yields 4 events, compared to 3.5 from Monte Carlo expectations. From this we derive a 90 % upper flux limit of 1.1 * 10^-13 cm^-2 sec^-1 for muons in excess of those expected from atmospheric neutrinos with zenith angle > 150 degrees and energy > 10GeV.Comment: 20 pages, 11 figure

    The modelling of the hadronic cascades generated by the nuclei of the primary cosmic rays in the Earth's atmosphere has been performed for a purpose of theoretical investigation of the muon groups and analysis on the base of the obtained results and experimental data of the underground telescope of the State Scientific Centre "Institute of Nuclear Investigations of the Russian Academy of Sciences". The fluctuations of the muon multiplicity have been investigated. The modelling results have been used for development of the new methods of obtaining data about chemical composition of the cosmic rays. The analysis of the underground telescope data has been performed, the results in the wide interval of nuclei energies which add sufficiently the world data obtained by other methods has been performed.     Features of growing chickpea in the foothill zone of the Kabardino-Balkarian Republic

    In the foothill zone of the Kabardino-Balkarian Republic in 2013-2015, studies were carried out in order to study the effect of growth regulators and rhizotorfin on the formation of elements of the structure of the chickpea crop. The objects of research were the varieties of chickpeas “Golden Jubilee” and “Privo 1”. The background for testing biological preparations was pre-sowing inoculation of seeds with rhizotorphin based on nitrogen-fixing bacteria and their treatment with microelements (P120K60MoV). The following drugs were used: Albit, Alfastim, Potassium / sodium humate with microelements. The use of growth regulators and rhizotorfin has a positive effect on field germination, the duration of the growing season and the yield of chickpea. The analysis of the data in our studies showed that the cultivation of the chickpea variety “Golden Jubilee” in the foothill zone of the Kabardino-Balkarian Republic is more profitable

    In the conditions of the Kabardino-Balkarian Republic, in the mountainous zone, field studies were carried out to identify the effectiveness of the use of drugs based on biologically active substances on the yield and quality indicators of potatoes in the mountainous zone of the Kabardino-Balkarian Republic. The following potato varieties Goryanka and Nart 1 were studied as objects of research. The following preparations were the subject of research: Lignohumate AM, Polydon iodine, Fulvigrain Stimulus Pro, Zircon and BisolbiSan, Zh, Succinic acid. Analysis of the data obtained in the course of the research shows that in the variants of the combined use of Lignohumate AM and preparations based on biologically active substances, a stable and high increase in potato yield was noted in all years of the study. The highest yield for the Goryanka variety was noted in the variants of joint application with the Zircon preparation - 8.1 t/ha or 34.5%, for the Nart 1 variety in the variant of the combined application of BisolbiSan - 10.7 t/ha or 36.0%. The use of the drug Lignohumate AM led to an increase in the yield of tubers for varieties Goryanka and Nart 1 by 22.6% and 26.3%, respectively

    The plants capable to occlude the maximum quantity of the heavy metals (HM) from soil solution are studied. Plants - indicators of accumulation of heavy metals are allocated, the new directions on decrease in toxicity of the soil are offered. For the purpose of studying of sorption abilities of bean herbs studied accumulation of heavy metals on phases of development of plants. Biological features bean which are capable to occlude heavy metals from the soil and air and by that to clear the polluted site are established. Plants can be the main bioindicators of impurity of soils. For a start in different environments the content of heavy metals by means of a method of chemical analysis control was defined, then compared maximum permissible concentration and drew a conclusion about danger of complex influence to the person and a biota For strengthening of sorption brought tseolitsoderzhashchy clays of Alanit of a local origin at crops of bean herbs. It is revealed that the maximum sorption abilities are found in plants vyazelya motley, and in mix with an amaranth, sowed cherezryadno the maximum effect on decrease in heavy metals on the polluted site is reached.     The effect of using biologically active substances on the initial growth indicators of potato tubers

    Studies to identify the effectiveness of using preparations based on biologically active substances. Potato varieties Goryanka and Nart 1 and the following preparations were studied as objects: Polydon iodine, Fulvigrain Stimulus Pro, Zircon and BisolbiSan liquid, Succinic acid. Analysis of the data obtained during the research shows that potato tubers’ treatment before planting with preparations based on biologically active substances contributed to an increase in the rate of tubers’ germination. In the experimental options with application of Fulvigrain Stimul Pro at a dose of 3.0 l/t and BisolbiSan – 10 ml/t, an increase in the sprouts’ weight relative to the control option by 34.2% and 26.4% was noted; root weight increased by 20.8% and 21.6%, respectively. The use of Succinic acid at a concentration of 10 g/l led to an increase in the bud number by 32.4%, the weight of sprouts and roots - by 36.8% and 27.1%, respectively. Pre-planting tubers’ treatment with preparations based on biologically active substances led to an increase in the rate of seedlings’ emergence in the Goryanka variety by 11.1 – 27.1%, in the Nart 1 variety - by 10.1 - 21.2%
