Comment s'accorder sur les normes ? Le droit et la Gouvernance face Ă Internet

Il y a un besoin criant de renouveau entre ce que l’auteur appelle la société civile et les pouvoirs de décision C’est pourquoi sont apparues au fil des années des formes alternatives d’organisations collectives, ouvertes et autorégulées. On parle alors de gouvernance.
L’auteur explique cette évolution de la relation droit/gouvernance non seulement par les limites de la législation à proprement parler mais également par le développement de nouvelles techniques et technologies comme Internet qui ouvrent la porte à de nouvelles possibilités de coordination plus efficaces ainsi qu’à la protection d’intérêts divers au même titre que la loi. Internet devient alors un nouvel observatoire d’où l’on peut développer de nouvelles méthodes de gouvernance, le tout dans une optique de consensus sur la norme. En effet, il ne s’agit pas ici d’écarter le droit au profit de nouvelles formes de gouvernance ou vice-versa. On cherche à créer un système complémentaire qui viendra pallier aux faiblesses d’une législation rigide et complexe par moment et qui produira tout de même une dynamique juridique au niveau national et international
Three-Strikes Response to Copyright Infringement: The Case of HADOPI
International audienceAnother notable example of how copyright enforcement has moved well beyond addressing specific infringing content or individuals into Internet governance-based infrastructural enforcement is the graduated response method, terminating the Internet access of individuals that (allegedly and) repeatedly violate copyright. The case of the French Hadopi (Haute Autorité pour la Diffusion des Œuvres et la Protection des droits sur Internet), law first, agency next, both highly controversial, illustrates this strategy of dubious effectiveness for the purpose it is meant for, but of high disruptive potential for Internet users and access rights – and potentially affecting other, perfectly legitimate activities as a collateral effect. In this paper, we will describe the unexpected and perverse effects of this law using the notion of legislative serendipity to explain why this law has never reached the target it was intended for
Network Analysis of the French Environmental Code
We perform a detailed analysis of the network constituted by the citations in
a legal code, we search for hidden structures and properties. The graph
associated to the Environmental code has a small-world structure and it is
partitioned in several hidden communities of articles that only partially
coincide with the organization of the code as given by its table of content.
Several articles are also connected with a low number of articles but are
intermediate between large communities. The structure of the Environmental Code
is contrasting with the reference network of all the French Legal Codes that
presents a rich-club of ten codes very central to the whole French legal
system, but no small-world property. This comparison shows that the structural
properties of the reference network associated to a legal system strongly
depends on the scale and granularity of the analysis, as is the case for many

The Network of French Legal Codes
We propose an analysis of the codified Law of France as a structured system.
Fifty two legal codes are selected on the basis of explicit legal criteria and
considered as vertices with their mutual quotations forming the edges in a
network which properties are analyzed relying on graph theory. We find that a
group of 10 codes are simultaneously the most citing and the most cited by
other codes, and are also strongly connected together so forming a "rich club"
sub-graph. Three other code communities are also found that somewhat partition
the legal field is distinct thematic sub-domains. The legal interpretation of
this partition is opening new untraditional lines of research. We also
conjecture that many legal systems are forming such new kind of networks that
share some properties in common with small worlds but are far denser. We
propose to call "concentrated world"

La transparence des algorithmes face à l'Open Data : Quel statut pour les données d'apprentissage ?
International audienceCet article s'intéresse aux problématiques liées à l’application d’algorithmes dans les décisions administratives, et plus particulièrement aux données et méthodes utilisées dans ces applications. Le législateur s’est jusqu’à présent focalisé sur la transparence de la “décision” qui n’est qu’un certain type de traitement de données. Mais rien n’est précisé sur les données qui vont influencer ces algorithmes, c’est à dire les données qui se trouvent en amont de la décision. On fait l’hypothèse dans cet article que ce droit à l’explication devrait porter aussi sur les données utilisées pour entraîner ces algorithmes.On fera d’abord un rappel de l’évolution des politiques d’Open data, puis on parlera des nouvelles tendances vers l’algorithmisation du droit et de l’administration dans le contexte du gouvernement ouvert et le rôle joué par les données au sein de ces nouveaux processus décisionnels. Enfin, on analysera la difficulté d’assurer une réelle transparence pour de nouveaux types d’algorithmes (e.g. les algorithmes d’apprentissage automatique) qui seront de plus en plus utilisés au sein de l’administration. Nous soulignerons notamment la nécessité - actuellement encore peu explorée - de garantir non seulement l’accès au code source de ces algorithmes, mais aussi l’accès aux bases de données qui les ont entraînés, ainsi qu’aux critères de sélection utilisés pour construire ces base d’apprentissage
